Defense just said a change of venue is now off the table. This is the first time they’re saying this.
They were considering moving if they could not find a fair and impartial jury for their clients.

Probably has to do with the 11/1 split on the jury of their peers.

Trial began on 10/18/21 with jury selection & ended 11/3/21. Jurors summoned for Superior Court on Monday, October 18th & Monday, October 25th: Monday, October 18th: Jurors with summons numbers: 1-67 are to appear at 8:15 am, 68-135 are to appear at 8:25am, 136-200 are to appear at 8:55am, 201-268 are to appear at 1:00pm, 269-335 are to appear at 1:15 pm, 336-400 are to appear at 1:30pm, 401-468 are to appear at 3:00pm, 469-535 are to appear at 3:15pm, & 536-600 are to appear at 3:30pm. 10/20/21: Judge originally had two panels of 20 scheduled for each day (AM & PM), now shifting to just one panel a day. 10/19/21 Day 2: These 8 jurors still in the jury pool today: #s 39, 41, 44, 52, 62, 72, 76, & 79. 10/20/21 Day 3: Seven qualified today: #s 140, 143, 158, 161, 167, 168 & 170. 11/3/21 Wednesday, Jury Selection Day 12: Final jury selection begins with 65/64 qualified. Court in recess, Judge & attorneys are reviewing 8 of the black jurors struck by the defense. The Court finds it does appear there's intentional discrimination in the panel. He says the racial overtones in the case have been a challenge; hard to escape those discussions with the panel. The judge has denied the motion to re-seat some of the 8 black potential jurors struck by the defense. The jury will remain 11 white people & one black person. The defense struck 11/12 potential black jurors. Defense said a change of venue is now off the table.
A panel of 12 people was chosen Wednesday. 16 total jurors selected-including the four alternates-there are 5 men & 11 women. The jury will be impaneled just before opening statements. Trial starts on Friday, 11/5/21 @ 9am.
Federal charges: *Travis James McMichael (34/now 35) & *Gregory Johns McMichael (64/now 65) indicted (4/28/21) & charged (5/11/21) with Federal crimes of 1 count of interference with rights (hate crime), 1 count of attempted kidnapping & 1 count of using, carrying & brandishing firearms during & in relation to a crime of violence & Travis: 1 count of discharging a firearm. Both plead not guilty. No bond.
Trial set to begin on 2/7/22 @ 9a. Next motions hearing on 11/19/21.

I'm having the same thoughts, especially after some of the Bubba comments by the defense. My thoughts are still that the defendants do not think they did anything wrong at all. Never have, never will.

Headed back to Brunswick for the Murder trial for the death of Ahmaud Arbery. The judge told the Jury they do not need to return until tomorrow at 9 a.m. Today the judge will rule on a few motions and discuss proceedings with the Defense and State before opening statements start.

State's pre-trial motions are done. Remaining are motions from the defense are: -motion regarding showing Confederate vanity plate on McMichael's truck. -motion on officer's body cam. -motion to seat all jurors in jury box. -motion to eliminate some language from the jury charge.

Attorney Frank Hogue asks that jury be all seated in jury box instead of socially distanced in the courtroom "because of the diminishing [COVID] numbers and the importance of trying this case in a normal fashion."

Defense attorney Kevin Gough: "We are entitled to see the faces of the jurors. We are entitled to see jurors that are not masked... I think we have a constitutional right to see the jurors as we present evidence."

Court is going on a one-hour recess for lunch.

Juror #579, who was seated in absentia when she had a doc's appt Wednesday, alerted the Court that she's now bedridden with back troubles so she can't sit up straight and is on narcotics, is now excused. Juror #282, also a white woman, takes her place.

If I was selected to serve on that jury, I would hate for the general public to assume that I would vote to acquit this gang of idiots because the victim's race is different from mine. They clearly ran him down, surrounded him and posed an immediate threat to his life. They sealed their fate by videoing the whole thing and confessing on the spot! Their excuses were pitiful.
If Aubrey had been able to take control of the gun and shoot his attackers it would have been justifiable self defence. MOO
