No charges for man involved in deadly Walker County road rage shooting, police say

I saw this elsewhere and it reminded me of the Sara Morales case. In this one, Danny Claire was driving an SUV and swerved into the path two motorcyclists were attempting to pass him. Contact was made with the SUV and one of the motorcyclists. They pulled over and the situation escalated with Claire being shot dead. No charges against the shooter at this time.

I agree, there are similarities. But.... there are also some differences:

- The deceased was not pointing a weapon at the shooter (harder for him to claim fear of death or serious injury).

- It looks like there could be visible damage to the deceased's truck. This makes it easier to establish that the shooter was a mutual participant in an escalating encounter.

I have suspicion (completely unfounded) that police and DA's dont want to use the legal inability to charge the man who shot Morales as a precedent giving people the idea that one can be "locked, loaded and looking for a reason".

Rather, the DA may be willing to push the prosecution envelope a little to nip such ideas in the bud.
