IMO, 20 years isn't long enough to hold these monsters.

Thanks for the updates, everyone. This case is just so heartbreaking. Kyra will only be 8-13 years old when the 🤬🤬🤬's get out. How do you think she is going to feel knowing that they are back in her community?

Are the grandparents going to move her out of the area? Or will she be forced to live with the terror that they are going to come and get her?

A possible 5 years with time off for good behavior and mom could be out in 2.5 years, less if time served counts. What will Kyra do then?

Good for Idaho legislators.

I really think it is time to do something about all the plea deals and indeterminate sentencing. Some of these POSs get off so easy it is mind boggling.

Could be a silly question, but did monster-mom lose her parental rights? If so, I would be seriously tempted to change names and head out before she has a prayer of being released. Or the other one.

This is so very sad and heartbreaking the way some adults abuse and mistreat the babies in the world. These people never seem get more than a slap on the wrist and then they want that reduced to nothing. :behindbar

I agree. These people get a slap on the wrist and then are able to walk out of jail. In the meantime, Kyra has to use prosthesis to walk with. It's not right.

This creep-show: Charles W Smith, who's atty told the world what a great guy he is; he described lil' Kyra's abuser as a nice guy and a good babysitter! Mr atty do you have children you would like to hire him to care for??

Someone is logging in on his MySpace acct... His picture with the pumped up biceps, from abusing children is still there, but it is private.

They never found the cause of the baby's injuries. Even after 3 months in the hospital recovering, she still has years of surgeries ahead of her... She has just learned to walk again. And her momster sat crying over her own prison sentence!

Please!! You'll be out and young enough to start over, before your lil daughter is fully healed!

Smith, the mom's live-in boyfriend and babysitter of the 2 Wine girls, 3 and 6 at the time of the injuries; was sentenced to the max of 10 years. The judge said he would give more time if he could!!

The mother who was said to be suffering from a disassociation, a form of denial that prohibited her from understanding the severity of Kyra’s injuries ... yet she knew that she couldn't let other's see her lil girl... including relatives and a former babysitter who was coming over to see the girls!! Christina Hayes got 5 yrs plus 5 years indeterminate sentencing.

After the hearing Christina's mother cried and said it is hard to understand her daughter being guilty of something she didn't comprehend!

I don't believe it!! Neither did the courts....

Payne, the prosecutor, argued that the defendant knew how extreme her daughter’s injuries were because she prohibited neighbors, friends and relatives from seeing the girl before county deputies made a welfare check at the Hells Gulch home in June 2008.

I'd love to have this judge give lessons to these pro criminal judges who let them off with a slap on the wrist!

We are supposed to be more advanced than an eye for an eye, but how about a year for a year. You mess with someone, leave them messed up for life, you give up your life. Either DP or Life w/o Parole...

One of the stories posted on WS today made me think of little Kyra Wine, and wonder about the criminal disposition of her mother's momster's case. Several others were following this horrific case so I thought I'd update it. I found this:

Kyra Wine's mom faces 5 years in prison for abuse

http://www.nwcn.com/topstories/stories/NW_051609IDN-kyra-wine-KS.c7c17bb.html

Basically, Christina Haynes pled guilty and would normally face a 10-yr prison sentence for her crime(s). But since she cooperated and took a plea deal, she may only end up serving five years.

She's scheduled to be sentenced on July 17th

Maybe someone has already said this, but if they were convicted of attempted murder I wonder if the sentence would be longer? Sorry if this sounds like it's out in left field; I'm not a lawyer !

Stronger child abuse sentencing will see Senate vote
February 24th, 2010

A proposal to double the maximum sentence for felony injury to a child from 10 to 20 years in prison was approved by a Senate panel Wednesday. It now faces a vote by the full Senate. Sen. Joyce Broadsword, R-Sagle, began working on the proposal after hearing about the case of Kyra Wine, a 3-year-old girl in northern Idaho who was abused by her mother’s boyfriend last June. During a Senate Judiciary and Rules Committee Wednesday, Broadsword said another case involving a 2-month-old girl whose leg was broken, reported by the Spokesman-Review, is another example of why penalties should be strengthened.
