The Elkhart County Prosecutor’s Office says 29-year-old Franklin Elmore Jr. and 27-year-old Cheyenne Elmore face preliminary charges related to the death of Franklin’s child.

WNDU further spoke with the boy’s biological mother, who lives in Alabama. She told the outlet she had contacted the state’s Department of Child Services on multiple occasions because of things her son told her. The agency, she said, told her “they could do nothing because they didn’t find any bruises.”

“But when my son tells me that he goes to bed hungry at night when he gets in trouble, I don’t care if there’s food in that house,” she said. “There could be a thousand dollars worth of food in that house. Are they feeding it to him? Is he eating it?”

“The system is corrupt intentionally because it makes a lot of money and doesn't care for the safety of children," said Emerson Earhart, Protester.

People close to the boy referred to him as Justin.

Organizers said full custody of Justin was given to his father by the Elkhart County Court system at the request of his biological mother.

They also said Justin’s mother and grandmother had reported numerous times to DCS over concerns they had for Justin's well-being.

An investigation revealed the two were home with the boy just before 9 p.m. on Aug. 3 when the father allegedly attacked the child in his playroom.

Court paperwork stated that surveillance video from the home that day showed Franklin Elmore Jr. pacing in the yard with his hands on his head before Cheyenne Elmore called 911. He could reportedly be heard muttering the word “jail” as he walked back into the house.

Franklin Elmore Jr., 29, got 55 years for the murder of Justin Elmore and another 10 years for related crimes, to be served consecutively, WNDU reports.

“I’m satisfied with it. It’s better than what I thought he would get,” said Miranda McBride, Justin’s mother, outside the Elkhart County Courthouse. “I wish he’d have more, death row would be great. But most likely by the time he gets out, he’ll probably be dead anyways.”
Dad Gets Decades in Prison for Beating Death of 6-Year-Old son

After he pleaded guilty and his begging forf a lighter sentence was denied by the judge, Cheyenne Elmore changed her plea to guilty. She is expected to be sentenced on January 13, 2026.
