I'd say because his own team called Sandra's death a suicide-- including the State's Medical Examiner. An investigation by the US Attorney's Office and analyses by other forensic experts, have challenged this initial finding.
The Office of the Chief Medical Examiner has stated they will review their findings if new evidence emerges, but as of March 2025, the official cause of death on Birchmore's death certificate remains suicide.

Attorney Shaun Martinez, who represents the commission, revealed during his opening statement that federal prosecutors allege Devine contacted Birchmore on Feb. 1, 2021, the day Farwell allegedly strangled her during an evening visit to her apartment.

Attorney Robert Stowe, who represents Devine, said during the hearing that the case against his client is a “big lie.”

The letter to the Massachusetts Speaker of the House was included in a public records request that NBC10 Boston received for thousands of pages of Norfolk District Attorney Michael Morrissey’s emails from a private account. Lawmakers allocated funding in a supplemental budget passed late in 2024.

Argh. Crazy-making. Devine had been abusing his power for years. A trail of disciplinary issues going back to (at least) 2015, but the SB connections are "the big lie," despite clear and overwhelming evidence.
What is he fighting for? Surely whatever was left of his career is over?
The Stoughton Police Department launched an internal investigation after her death and found in 2022 that both Farwells and Devine engaged in “inappropriate” relationships with Birchmore, according to McNamara.
The disciplinary hearings this past summer also delved into Devine’s history at the Stoughton Police Department, including a 60-day suspension and demotion from deputy chief to patrolman in 2015 after an internal investigation unrelated to Birchmore.
That earlier investigation sustained findings of conflict of interest, abuse of position and untruthfulness after Devine ordered a subordinate to use police resources to investigate a personal matter linked to an extramarital affair at the time, according to Martinez.
