Initially, Saltmarshall said he was sleeping on a bed with his daughter, got up to use the restroom and when he returned a short time later, the child wasn’t breathing, Lt. Jeffery Smith said. That’s when Saltmarshall said he called 911 and started performing CPR.
This is from the original article in the first thread post. I'm thinking that she was accidentally suffocated due to co-sleeping. I also base that off of what the grandma said, too. Some of her injuries could have been the result of the CPR, if done improperly on a child that could happen. As for the rectal tearing, that could have been the result of a hard BM, they really don't say how severe that injury was, only that it was observed.

The Wayne County Prosecutor's Office released the following information:

After an extensive investigation and based upon the June 16, 2017 report from the Wayne County Medical Examiner, it has been determined that the cause of death of the child was asphyxia and the manner of death was determined to be an accident. Mr. Saltmarshall and his daughter were determined to have slept adjacent to each other on an adult sized bed and upon waking Mr. Saltmarshall found the child unresponsive. Today WCPO moved to have the case was dismissed in the best interests of justice. The motion was granted by Judge Sabrina Johnson.

The mother had been in the room but left for work, leaving the baby with James.

Police say the mother should not have been there. Zuleika Moreno lost custody of the baby and another 3-year-old girl, removed by Child Protective Services. The state offender tracking website shows Moreno is on probation for 3rd Degree Child abuse until 2021.

So if I understand things, Janiyah's death has been ruled an accident as a result of co-sleeping. Her dad's mother, who previously had custody of Janiyah until she was removed from her home by CPS in April, claims that her son intended to kill Janiyah.

Janiyah's mother had been in the room with father and baby until she left for work but under law was not supposed to be in the home because she is still on probation from a conviction of 3rd Degree Child abuse until 2021. She also lost custody of her other kids according to the paternal grandmother.

It's not clear when the medical examiner's office determined the initial findings were incorrect.

Jeffrey Smith said at the arraignment, according to WJBK-TV, Fox 2 News. "As the interview progressed, (Saltmarshall) said Janiyah initially slipped off the bed on the floor, and struck her head. Throughout the interview, Saltmarshall denied any responsibility in touching and damage to the anus."

Saltmarshall, who was extremely emotional during his arraignment, told Fox 2 he fell asleep on a bed in an Inkster hotel room with his daughter in his arms. When he awoke, she wasn't breathing. He immediately called 911.

The details are far from clear but it does seem like Janiyah's dad has been falsley accused of murder in a case where co-sleeping was the actual cause of her death. So sad. :(
