Circumstances:
Kimora was last known living with her mother at an apartment complex in Flint. In November of 2016 an investigation into abuse of other children in the home brought DHHS agents to questions where Kimora was. Interviews of the mother and father brought confessions that Kimora had been beaten to death and buried in a shallow grave. Her remains have yet to be found.

Khairy Joshuawon Simon pleaded guilty to second-degree murder and removing a dead body without permission of the medical examiner on Tuesday, June 12, before Genesee Circuit Judge Geoffrey L. Neithercut.

Simon, 27, admitted to killing his daughter Kimora Lee Simon in 2015 and investigators believe he put her body in a backpack and buried her along railroad tracks near the Evergreen Regency apartments.

Simon will testify against Finley, Leyton said, and the Genesee County Prosecutor's Office won't object to a sentence on the low end of the sentencing guidelines.

Leyton said Simon could face between 13.5 years to life in prison when he is sentenced on July 11.

Mom pleads to killing 3-year-old daughter, collecting welfare benefits

Erika Shantae Finley, 29, pleaded no contest to second-degree murder, first-degree child abuse, first-degree child abuse in the presence of another child, tampering with evidence, lying to a police officer and welfare fraud, according to Genesee County Prosecutor David Leyton.

"I expect she's going to get a lengthy prison sentence," Leyton said. "Had we not made the offer, there would have been a trial and more trauma for the extended family."

Both Khairy Simon and Finley are set to be sentenced on Sept. 5 before Genesee Circuit Judge Geoffrey L. Neithercut.

He pleaded guilty in June to second-degree murder and removing a dead body without the permission of the medical examiner and agreed to testify against Finley.

She pleaded no-contest in August to five charges — including second-degree murder, first-degree child abuse, tampering with evidence and welfare fraud. (A no-contest plea essentially has the same effect as a guilty plea, but the defendant does not admit the accusations against them.)

Finley was sentenced on Wednesday to 15 to 40 years in prison, according to a prosecutor’s spokesman. Simon was sentenced the same day to 12 to 40 years.
