UNDATED - A young mother is charged with an unthinkable crime. She's behind bars, accused of stabbing and trying to kill her baby boy.

Now, Kristy DeHuff is about to be moved from a jail cell to a mental hospital. A judge has ruled she's not competent to stand trail.

The one bright spot in this tragic story is that Drake is home from the hospital and recovering well.

"He's at that magic age where he's just starting to take a few steps. He's forming his first, few words, and teeth are popping out all over the place. It's just such an awesome time for him, and it's so heartbreaking that Kristy can't be there to share with him," Colvin said.

Thank you, Texas Mist, for giving us that fabulous news about Drake. That made my day. I've thought from the first that poor Kristy is suffering from some serious break. Hopefully she will get the help she needs. I know there will be many yelling "off with her head" but I doubt she even remembers the crime. That's what is so fascinating and frightening about the human brain. A break is really that....a break from the reality of normal.

Filly--I hadn't checked this thread for a while. Your description of the guy on PCP made me make a mental note to not ever try that one. No facing the furniture north over here.

On a personal note, I would like to report that I'm probably the only human being (other than my sweet guy) to graduate from Huntington Beach High School in 1972 (home of the surfing championship of the world and where we could go barefoot to class) and not be a pot head. Never tried it. NEVER..........until it was proven to help with seizures. I live in Oregon (think OMMP). I don't like smoke but a drop of tincture under the guidance of a trusted neuro is doing wonders. Just sayin'.

did they ever figure out if the dad smoked but didnt inhale?

A woman accused of stabbing her baby could be reunited with her family in the coming weeks after being found not guilty by reason of insanity...

DeHuff was convinced at the time that evil forces were going to kill her and turn the baby into the Antichrist. He said DeHuff thought if she killed herself and her son, they would both go to heaven."She figured she was saving (her son) from a fate worse than death," Foster said.Shortly after her arrest, DeHuff was diagnosed with schizo-affective disorder with depressive symptoms. She was evaluated and initially found incompetent to stand trial. She received anti-psychotic medication at the state's Center for Forensic Psychiatry and eventually became competent.Foster said a forensic psychiatrist he hired, a clinical psychologist at the Forensic Center and a forensic psychologist hired by the prosecution all found DeHuff to be not criminally responsible, meaning she was unable to control her behavior and appreciate the wrongfulness of her actions, and therefore legally insane.

DeHuff's parental rights were terminated. She appealed. From the appeal judgement, July 2011:

The trial court also did not clearly err in concluding that termination of respondent’s
parental rights was in the child’s best interests. There was clear and convincing evidence that
before the incident respondent was a loving and devoted mother who provided proper care and
custody for the child. There was also evidence that respondent had the support of her parents,
her husband, and her husband’s parents. Respondent’s treating therapists and psychiatrist
testified that respondent was not currently a threat to the child or others and was motivated to
continue treatment.

However, there was also clear and convincing evidence that family reunification under
the circumstances would be a very long and arduous process and that it had not even begun yet.

Respondent was not ready to parent, and it was unclear when she would be ready. Her treating
psychiatrist, Dr. Anthony Wolf, testified that “t would be too idealistic to think that a patient
once on a standard regimen of medications was never going to experience symptoms ever
again.”

Wolf explained that schizoaffective disorder was by its nature episodic and manifested
itself in the future. Ward had testified that some patients decompensate even when medicated.
Respondent had been taught to recognize the symptoms and would be able to address them and
seek help for them, and respondent’s support system would also be in place to help respondent
recognize and identify any symptoms.

However, respondent’s friends and family all testified
that they had never noticed anything different or wrong about respondent in the month leading
up the incident. Moreover, respondent’s husband was home with respondent during the incident
and was unable to prevent it.

This really strikes close to home. I had a friend in the Boy Scouts that this happened to. She was committed but the ACLU got her released, she was the only survivor.
