so woke up to some coverage of yesterday's events.

“At this point, discovery is being held hostage. We have not received one piece of paper, not one. If the government is not prepared to move forward with this case, this case never should have been charged back in December, when it was charged,” an attorney representing Bradley Bartholomew said.

At the start of the hearing, the lawyers for the Bartholomew’s accused the Michigan Attorney General’s Office of withholding evidence, saying they haven’t received anything additional to the probable cause affidavit.

“I do understand the argument the defense is making regarding bond. I also understand the complexities of this case. However, it hasn’t been going on for a month for nothing,” the judge said. “It sounds like there’s information out there that the defense is certainly entitled to. I will make a determination, regarding what we’re going to do with the case, regarding bond after we have the show [cause hearing].”

The request was made during a hearing on January 13, where defense attorneys said the state has produced no formal discovery despite a 21-day deadline. According to the defense, no police reports, autopsy results, or physical evidence have been provided.

Attorneys told the court the only document they have reviewed is the probable cause affidavit, which they say they first obtained through social media rather than directly from prosecutors.

They asked the courts to dismiss the case or consider bond for the defendants that have been in custody since their arrest more than a month ago, stating that it’s past the 30 days that the hearing was adjourned to allow discovery to be turned over.

I sure hope the state has some ACTUAL evidence against the Bartholomew's and not just the meth fueled accusations of one meth head against another. Because I am starting to wonder if the state has any evidence at all.

I mean, we assume they have - at the very least - the crime scene photos and the medical examiners findings on Rebecca's body which support the meth fueled accusations of said meth heads.

But as far as actually prosecuting the case... They are really going to need to submit discovery at some point, and (just a wild stab in the dark here)... perhaps turning up to court might be a good idea?

Both the Wexford County Prosecutor's Office and Department of Attorney General have been in "constant communication about discovery" with the defense, said Kimberly Bush, a spokesperson for the Department of Attorney General, in an email.

"As you can imagine, discovery on this case is voluminous and includes many pieces of sensitive information. Unfortunately, the defense team denied our request to safeguard and preserve evidence from public dissemination until the trial. There has been no delay in providing discovery on our behalf, and any allegations contrary are simply an attempt to move this case from the court of law to the court of public opinion."

translation, we (AG's office) want to dictate whether and how the discovery can be disseminated. While it is the court's purview to seal or unseal documents, we feel we have the right to withhold discovery until the defense capitulates and agrees to what we want regardless of whether the court has ordered the records sealed or not.

I am not liking this. JMO
