A convicted murderer who received more prison time because he stabbed his girlfriend to death in the presence of her 14-year-old son must be re-sentenced because although the teen was in the house, he didn't see or hear the slaying, the Minnesota Supreme Court has ruled.

In an 11-page order published Thursday, the court found that the "aggravating factors" that triggered Raymond Clyde Robideau's 38-year-sentence for second-degree intentional murder were not accurate. The ruling reversed a state Court of Appeals decision that said the sentence was justified.

Wasn't her 14-year-old son finding her bloody body enough? The Son was present in the home also.
