"A district judge has rejected the latest challenge by death-row inmate John Lotter's attorneys, who claimed it would be unconstitutional to execute him because he functions intellectually as a child.

In an order Thursday, Richardson County District Judge Vicky Johnson said the claim is "time barred" because it was raised too late....

Lotter, 47, has maintained his innocence in the Dec. 31, 1993, triple murder at a Humboldt farmhouse that inspired the 1999 movie "Boys Don't Cry."...

Lotter was sentenced to death for his role in the 1993 killings of Brandon Teena and two witnesses, Lisa Lambert and Philip DeVine. ..."

I agree that both are equally guilty since they went there with a clear plan to kill.That every other thing that has come out of that little weasel Nissan's mouth has been a lie.He threw Lotter under the bus to save his hind end from the chair , and i dont think he is trying to save John by admitting to being the killer .I feel like number one, being the killer of someone who is seen as gay may in his mind earn him some cred in the joint.Nunber 2, Tom is a deeply disturbed man (stating the obvious) and after reading the book written by Aphrodite Jones and seeing his extensive psych record and history of self harm, abandonment issues etc. i feel like he is having one of his moments of "guilt" that sociopaths like him sometimes have.Unlike psychopaths , sociopaths feel emotions albeit shallow emotions. Personally, i always felt like Tom was the worse of the 2 and that he was the actual killer.In the book it is stated clearly that Nissen and not Lotter beat the hell out of poor Brandon , and it was Nissen who raped vaginally and anally according to Brandon while Lotter attempted rape but was unable to do so.If it were up to me ,id say kill both degenerates right now!
