A local judge Tuesday ruled double-homicide suspect Naythen Aubain is not competent to stand trial.

Aubain will be under constant observation at a mental health facility, where professionals will be able to determine when he becomes competent to stand trial. While Naythen Aubain is under supervision at the mental health facility, the District Attorney’s Office will seek to present the matter to a grand jury so as to preserve the county’s right to prosecute the suspect at a later date.

There is a video that was taken at the scene of the car accident where he was physically trying to enter a person's home, pushing on the door. Unreal. Thankfully there were fireman there or who knows what he would have done to the residents if he got inside.

Along with the deaths of his grandmother, Katherine Aubain, and his landlord, Jane Wentka, Aubain is now also charged with attempting to kill a neighbor and with killing his landlord’s dog.

A not guilty plea was entered on Aubain’s behalf when he appeared before Judge Robert L. Bauer this morning. Aubain was indicted Feb. 22 on two counts of first-degree murder and one count each of attempted first-degree murder, fourth-degree mischief and torture to an animal.

Judge Bauer said that Aubain is ‘legally incompetent to proceed’ due to mental health evaluations following the Jan. 6 double homicide. Bauer returned Aubain to the mental health treatment facility where he is staying, and set a court date for one year from today to see if Aubain is recovered enough to proceed.

At some point during the attacks, authorities said Aubain attempted to kill his neighbor, James Critelli, and damaged Critelli’s motor vehicle. Authorities said Aubain also killed Wentka’s pet dog.

The Oneida County district attorney says after Aubin allegedly killed his grandmother, he tried to get his neighbor to come out of the house so he could kill him too.

The DA says he was armed and prepared to kill that person, and made statements that his intent was to kill him.

‘We acknowledge this is as far away as you can get on attempt. Generally, what people typically look for and what jurors often look for is an intervening fact, very close in time and proximity and in this case it's a little more extenuating,’ said DA Scott McNamara.

According to the New York State Department of Corrections and Community Supervision, Aubain previously served five years in prison, from 2008 to 2013 for robbery. While in prison, he was convicted of promoting prison contraband for possessing metal weapons. He is currently on parole until 2020.”

Aubain Accepts Deal, Pleads Guilty to Manslaughter in 2019 Double Homicide

The man accused of killing his grandmother and her landlord in January 2019 appeared once more in court on Friday to plead guilty to the 2019 crimes.

According to Oneida County District Attorney Scott McNamara, Naythen Aubain has accepted a plea agreement and pleaded guilty to two counts of second-degree manslaughter. He is to serve 15-to-30 years in state prison. His sentencing has been scheduled for March 25.
