"You have an otherwise healthy woman who ends up in a snowbank, nude, and who probably froze to death, and there was no reason why that would happen accidentally or by suicide," the prosecutor said. "So the theory is somebody caused her to be there."

"She may have been rendered unconscious somehow — likely was rendered unconscious before she got there — but there is no evidence of that discovered by the medical examiner on her body or by toxicology," Healy said.

Healy recalled the night Kimberly went missing, which included a brutal wind chill that caused the temperature to drop below 5 degrees. The night also included a heavy snowfall.

So, in summary, she wasn't shot or stabbed. She wasn't poisoned, her tox report showed up nothing. No blunt force trauma, no strangling. They don't have a clue how she died, other than likely freezing to death. They searched Rouland's home, took his computer, took electronics and other evidence, but found nothing there either.

The real mystery is how was she knocked out -- if she was knocked out -- and how do you prove it was Thomas Rouland that did it. And how can they potentially take it to a grand jury? They have to have something else, right?

I wonder if the rape victim has provided troopers with any evidence/statements on the case. Based on the reports, it looks like she was dating Rouland. I wonder if he told her anything or even if she may have seen something -- if they were dating at the time of Kimberly's disappearance.

The rape victim told investigators that she and Rouland had only been dating about 3 weeks prior to the rape (they met online), so, no, they apparently weren't together last year at the time of the homicide.

Who else would want Kimberly dead? She died the night before she was going to move out, and he admits to a fight that night over financial issues (she had used her income tax return to pay for her new apartment, and he felt entitled to some of that money).

Her body was exposed to the elements for almost a month before she was found, so that may have affected toxicology, and whether or not she was suffocated. The cold would have preserved a lot; however, there could have been animals damaging evidence (as with the Ramsaran case).

Apparently not - probably because she didn't have any on when she left the house. Perhaps in shower when killed or rendered unconscious?

I just keep thinking of parallels between this case and the Jennifer Ramsaran case (who was also found nude on side of road - covered by snow most of winter). Her cause of death was also not determined (although she did have sides of being hit on the head and defensive wounds. However, her husband was found guilty of her murder - primarily because of circumstantial evidence.

More developments: Thomas Rouland's rape victim had a "stress induced seizure" during a preliminary hearing on Tuesday. Right now, it's not clear if prosecutors have enough evidence to take rape charges to a grand jury. He almost got released from jail but is being held on a probation violation.

Nothing new on Kimberly Rouland charges however.

Thomas Rouland, 39, of Newark was accused of raping a 33-year-old woman he was living with in December, but before and again during the hearing, the alleged victim suffered from seizures.

"She was not able to obviously, to testify. Because of the way the law is, if we cannot put on a complete case at a preliminary hearing, it gets released," said prosecutor Chris Bokelman.

The alleged victim was able to tell the court she'd lived with Rouland for a few weeks, and that in mid-December, he pushed her to a sofa and had sex with her, but that she'd blacked out

"If she wants to go forward, we'll evaluate the case along with her testimony and other evidence to see how strong this case is and whether or not we want to go to grand jury," Bokelman said.

Wayne County District Attorney Rick Healy confirmed last week Kimberly Rouland's death has been ruled a homicide. Healy said the location of where the body was found was too far from Kimberly's home to walk without clothing in that weather.

Healy said toxicology reports showed no evidence of poison, drugs or alcohol in her system. He also said there were no marks or signs of trauma. He said all of this evidence is a factor in determining Rouland's death a homicide.

The woman was clearly post-ictal and traumatized -- most people with epilepsy are not in their "right mind" for at least an hour or two following a seizure (even if they think they are). Their memory and other cognitive functions are severely affected, and even if she'd said she was ok to go ahead with the hearing, it should have just been rescheduled for a few days later.

Now, a probable rapist, a possible murderer, and a child abuser is walking the streets again.

With this bail associated with the rape charge lifted, Rouland posted $1,000 cash bail for a violation of probation charge associated with a previous child endangerment conviction, and has been released from jail.
Before the preliminary hearing began on Tuesday, emergency medical technicians appeared to tend to the alleged victim, who had been subject to multiple seizures, in a separate room off the courtroom before the hearing began.
Despite signs of medical trouble, the woman went on with the preliminary hearing.
Before she was led into the courtroom to begin her testimony, she could be heard crying as family members consoled and encouraged her.
When she was brought before the judge, she requested to sit facing away from Rouland, who sat shackled next to his attorney, Wayne County First Assistant Public Defender Andrew Correia.

Rouland is charged with second-degree burglary and petit larceny...

The suspect stole a kitchen stove electrical cable "by cutting the cable and crawling under the trailer to remove the cable as well," a release said.

She was wearing boots, yoga pants, and a lightweight black coat. Rouland was the subject of a massive search during the month of February 2015.
