A Manhattan judge dismissed a shoplifting charge against a teenager caught with a dead baby in her Victoria’s Secret shopping bag after she allegedly tried to steal from the lingerie boutique in 2013.

Prosecutors conceded Thursday that they had not filed a certificate of readiness in a timely manner and the misdemeanor petit larceny case against Tiona Rodriguez, 17, had to be dropped.

Prosecutors are still investigating whether to bring murder charges against the teen.

Tiona Rodriguez, 19, was charged with second-degree murder for the 2013 death of her baby boy, whose limp body was discovered in her shopping bag by a guard at the Herald Square shop who thought she was shoplifting.

“The defendant planned and carried out the murder of her newborn infant and then callously shoved him in a bag with the plan of — in her words to “take this s–t and dig a hole, put it somewhere, lol, then we go eat IHOP,’” ADA Rachel Ferrari said at her Manhattan arraignment.

I don't understand why she didn't bring the baby ALIVE to a hospital anonymously or leave the baby ALIVE somewhere to be found. This is not the story of a scared and panicked teenager. No sympathy for her either.
Why would any female carry out a pregnancy with the intention of killing the baby as soon as it's born. She needs to spend a long time in jail and once released she needs to be placed on some serious birth control so that she only gets pregnant when she knows she actually wants a baby. Sickening story.

They also believe she killed a second baby back in 2012, when she had it in her bath tub. Ferrari said it was unclear whether the baby was a stillborn, but they had proof of her discussing the birth.

The young woman who was toting her dead baby around in a plastic bag when a guard mistook her for a shoplifter admitted Wednesday to killing the newborn in exchange for 16 years in prison.

Tiona Rodriguez, now 21, copped to charges of first-degree manslaughter under extreme emotional disturbance before Manhattan Supreme Court Justice Thomas Farber in exchange for the sentence.

She’s slotted to return to court for sentencing Feb. 6.

Mother found shopping at Victoria’s Secret with dead baby in bag is sentenced

Tiona Rodriguez was sentenced Thursday to 16 years after pleading guilty to manslaughter in January, the District Attorney’s Office stated.

The young woman, sporting jailhouse duds and a giant white cross, shook her head when a judge asked Thursday if she’d like to say anything.

“We hope this brings justice to the baby boy who never got to live his life,” prosecutor Chloe Kendall said before Manhattan Supreme Court Justice Thomas Farber imposed sentence.

“This is a horribly sad and tragic case,” Farber commented before handing down the sentence, which also carries plus five years post-release supervision.
