Officer Frye testifies about the short conversation he had with Luigi Mangione in the cop car:

"Defendant asked us for our names. I believe he also apologized for the inconvenience. I said the fake ID was a bit ridiculous."

Direct Exam of Officer Frye continues. We are shown a still from 9:43AM where he indicates the backpack is a foot away from Mangione, where he is sitting at the table. State asks where he parked at the station, and he indicates that they have assigned spots to park- they parked in Station "6." Frye says they walk Mangione inside to intake. He is asked about the Intake Officer at the front desk, and if they help with searches or inventory- he says yes. Frye then explains that searches are standard once at intake. Prisoners are allowed one layer of clothing, and anything additional gets stored in a locker.

Frye is asked about necklaces, watches or jewelery- prisoners are not allowed.Frye is asked about where searches take place, and he says in front of the defendant or detainee, so they can confirm nothing was stolen. He confirms this is standard operating producer. We're about to watch BWC from the TurnKey Officer Holman at 10:10AM. There is an ambulance in the background for a homeless person unrelated tp the case.


It's 10:11AM, and we see Detweiler and Frye walk Mangione to intake where his shoes are removed, his items are placed on the table as he faces hte wall. Holman asks if there has been a positive identification (or real ID) on the defendant. Detweiler says yes, "Luigi..."


Mangione is leaning with his head tilted looking up, watching the BWC footage being played where he's asked the color of his eyes-he answers brown. His height and weight, he answers (cannot make out what he says), and if he's right or left-handed (right).

He's also asked if he's single and has all of his teeth. Inaudible, but "yes" is indicated.

Detwiler goes outside again, so we get footage of more moments we haven't seen yet.Officer Frye wrote Luigi's last name wrong, so he asks Luigi to correct it. We also see a district attorney employee come in and snap this picture inside the McDonald's:

Luigi initially declines to give an emergency contact number, but the officers press him -- for if he were "to die or anything like that." He eventually gives them his mom's info.

At 10:27 AM, Luigi is locked in a holding cell in the police station.


In court, Luigi looks like he's taking a lot of notes today. Half the time I look up at him he's got his head down, writing.



Back to Frye's bodycam footage from the intake room, Frye says he recovered "a bus ticket of some sort" from Luigi's pocket.

We see him holding the piece of paper, he says it's a "bus pass for Pittsburgh."

We're still watching another angle where Mangione is being questioned about the spelling of his name, and Officers are removing his pants. His bottom half is blurred again.

Mangione is whispering to Karen Agnifilo again as they both watch the footage. Karen whispers back and smiles, using her hands. Mangione nodded his head and they continue talking. The screen was showing him putting his clothes back on.

Frye is showing a bus ticket on BWC footage that he says he removed from Mangione's back jeans pocket. He also removed another receipt or bus information from his other pocket that had a destination of Pittsburgh.

It's 10:33AM, another angles shows officers still at the intake, holding Mangione's Maryland ID, and asking about is passport. An officer is speaking on the phone to someone, saying that Mangione went to Best Buy the day prior and bought some USB drives and a digital camera (based on a receipt found). He mentioned that he had a hand gun and some kind of tactical gear. The state hands Frye a physical piece of evidence- I think some kind of hard drive- he confirms, and it's entered into evidence. He also confirms via the screen; the string, the watch, the mask, and the change.

We are then shown a photo of the necklace- it's a silver chain with a silver USB drive- the chain was maybe 1MM or so thick. We then see photos of all Mangione's clothes, jacket and shoes. Karen Agnifilo objects and they approach the bench.

One of the cops is on the phone while they're searching Mangione's bag.

"Found all kinds of goodies. He has a handgun and a suppressor ... (flipping thru receipts) Yesterday, he went to Best Buy, bought some USBs and a digital camera."

We're looking at photos again of Mangione's black sneakers, Columbia brand, almost like they could pass for hiking shoes. They are relatively clean. Looking at his dark jeans, those appear relatively dirty with some white marks on them. We are now shown a Lowe's brown paper bag (small size). A light-ish green coat, one black glove, the tan beanie, the belt, another layers of pants or black long johns (pretty wrinkled).

Frye indicates they were all processed as evidence. Frye is now being asked about transporting Mangione to the courthouse shortly after for his arraignment.

Frye is shown the official criminal complaint (and it's on the screen), and says DA Weeks had full control of charges. Frye is asked and confirms he has no knowledge of any NY laws regarding search and seizures. He is asked about several NYPD officers and asked if he knows them- "No." Frye confirms he had only been to NY once, and that was to testify in front of the grand jury for this case.

LIVE at New York Criminal Court — tracking critical developments in the case of slain United CEO Brian Thompson.

Exactly one year ago today, Thompson was killed, and the man accused of murdering him — Luigi Mangione — is back in court as the suppression hearing continues.

Mangione’s defense team is asking the judge to suppress evidence seized from his backpack without a warrant — including items linked to Thompson and writings prosecutors say reveal motive and intent.

Had to do a search for pic of Brian Thompson.

One year ago today, Brian Thompson was murdered in cold-blood in the early morning on his way to a conference outside an entrance to a New York hotel. Let that sink in.

Frye confirms he never told suspect he couldn't leave the McDonalds, he never mentioned the NY CEO shooting, and both he and Detweiler never took their weapons out.

It's 9:41AM on the BWC footage, and Frye confirms that Detweiler has now moved the backpack. He says he was aware of the backpack from the moment he walked in. Lt. Hanley's voice is in the background trying to run the Rosario ID again.

We hear Detweiler call to McCoy to replace where he was standing by the backpack and suspect so he could step outside. Frye confirms.

McCoy approaches suspect, and we hear him ask him if he has any weapons on him. We can't make out the answer.

McCoy picks up the backpack and moved it to another table at 9:43AM. He then picks up a laptop and moves it to the table with the bag.

McCoy asks suspect, "Do you know what this nonsense is all about? Suspect (Mangione) answers, " We're going to find out, I guess."

McCoy also moves the CVS bag to the table with the laptop and backpack as well. It's 9:44AM.

Patrolman Fox enters at 9:45AM (K9 Officer) with the ID. You can see customers leaving and walking around in the background of the McDonald's.

It's 9:47AM, and Detweiler approaches suspect and tells him that he's under investigation, and if he gives a false name, he will be arrested. Mangione provides his real information and DOB, with his arms crossed. He's asked why he lied by Patrolman Fox- Mangione answers, "Clearly, I shouldn't have." He's asked again, and answered, " That was the ID I had in my wallet."


We're now at 9:49AM, and Mangione is being mirandized. It's explained again that he provides them with anything false, he will be arrested.

This all seems very normal to me.
They start out being guarded a bit because the call was in reference to this person looking like a known suspect in a murder. They take measures to ensure their safety and those in the McDonalds while they talk to LM. This seems pretty standard for LE and nothing odd about it. He hands over an ID and the first run returns nothing. They then move the bag to another table at 943 (based on the timeline given this is done AFTER the first run of the ID seems to suggest the person is not real) and it says an officer is running the ID again. As soon as that ID is known to be fake, which means LM has given them a false name AND the ID with it, they have probable cause to search the bag. I don't see where a warrant would be needed at that point. I think it's safe to say searching his bag BEFORE putting it in a police car to take it to the police station is something reasonable to do. I am willing to bet any time an officer arrests someone they are going to search the personal items that person has with them before putting them into the police car for their safety. Once at the jail a more detailed search can be done and an inventory so that the person being arrested has it documented how much money and other items were brought in with that person when they were booked. They get those items back when they are released (unless those were items of evidence such as stolen items, items used in crimes, drugs/drug money, etc)

Back from lunch, Marc Agnifilo told Judge Carro that he feels the state is engaging in “gamesmanship,” arguing that prosecutors changed the order of their witnesses despite knowing he was scheduled to cross-examine the next witness, Officer Fox, who is now unavailable and due in the Southern District for another case following the rescheduling.

The state responded that it is not gamesmanship, stating they were simply trying to get the female officer back to her family. Judge Carro wants the schedule to remain the same, and says that she's an important witness. Officer Frye returns to the stand for cross.

The state indicates they have a few more questions for Officer Frye.

After a few housekeeping items, the state is finished with Frye. Jacob Kaplan is now cross-examining Frye and started by asking him how many times he met with the DA's office before testifying. He says several. Kaplan asks if they comment on his answers, he says sometimes. Frye confirms that he also went over his answers before court this morning.


Kaplan confirms that before arriving at the McDonald's, Frye and Detweiler were doing a "training" as he was a newer patrolman. He says it was an "informal training." Kaplan asks about the 911 call, and if he remembers the description of the suspect. Frye states yes, "blue medical mask, black jacket, tan beanie."

Frye is asked what he knows about the shooter- he did not know the weapon/gun had not yet been recovered.

Kaplan asks if he and Detweiler crafted a game plan before they arrived at the McDonald's since they received word it could be the NY CEO Shooter. He says no. Frye confirms he turns on his body-cam when he enters the McDonald's. Kaplan asks about a lag with the audio when turning on the body-cam, and Frye confirms there is a lag when turning it on.


We're shown a still of Mangione at the corner table at the McDonald's. Kaplan is asking about the layout and position of officers, indicating that there is space for the suspect, Mangione, to get up from the table if he wanted to.

We are shown Mangione pulling down his facemask on the BWC, and Kaplan asks if Frye recognized him. He says he had a very "high suspection" at that point, but did not relay to Detweiler.

"Did Detweiler tell you he recognized him?"

OBJECTION, Judge says he can answer

"He did not indicate to me"


Kaplan is asking Frye about the false ID, and points out he mispronounced "Rosario" on the ID. Kaplan asks why he would think that the man in the corner at the McDonald's would be the NYC Shooter, and if it would be a big deal if he arrested the NYC Shooter- OBJECTON, SUSTAINED. BWC continues to play of Mangione standing up and first getting frisked.

Kaplan asks Frye if he thinks the frisk is about 15 seconds.

Frye isn't sure, so they play the footage again. Frye says more than 15.

Kaplan: Did you hear Detweiler ask him why he was nervous?

Frye: Yes

Kaplan: Was that the same question the prosecutor asked you this morning?

OBJECTION, SUSTAINED.

Kaplan asks if anything prevented himself or Detweiler from moving the backpack at the time (it was 9:31AM) after the frisk. He asks Frye if it's same to assume he didn't move from his spot next to the table for the next 25 minutes. He says yes.

Kaplan points out that Frye asks Mangione about traveling to Altoona, and points out it's not a crime to travel. He asks if Frye had training on how to question or interrogate subjects. He says yes, it was a 6 month training course at the police academy.

Kaplan: Did they teach you it was OK to lie when talking to a suspect at the police academy?

Frye: Technically speaking, yes.

Kaplan: But when you were speaking to him you yourself had information that that he could be the NYC shooter.

Frye: yes

Kaplan: But at that point, you weren't investigating him for a fake or fraud ID.

Frye: Correct

BWC continues to play of Frye's small talk with Mangione. Kaplan points out a McDonald's employee walking around, as well as customers. Kaplan asks if at no point did they stop anyone from walking around in back, and he confirms they did not.


Kaplan confirms that based on their small talk conversation about travel, it is not a crime to travel from NY to Altoona. He also asks about the statement Frye made about getting Mangione out of there "quickly" once his ID clears, which Frye confirms to be "not true." He also asks him about Detweiler's statement to Mangione regarding the loitering policy at McDonald's being untrue- Frye says he has never heard about a policy like that.


Detweiler is overheard on BWC telling Mangione he was at the McDonald's 6x in the last week. Kaplan asks Frye if he knew that to be true- he's not sure.


It's 9:41AM, and Detweiler has now moved the backpack, and Kaplan asks Frye if the suspect tried to prevent them from moving it or touching it. He confirms the suspect did not.

It's now 9:43AM, and Kaplan states they've been there for 13 minutes and asks if they are primarily there is because of the resemblance of the NYC Shooter- that's why they were called there, although the ID is currently being run. Frye says yes, they were called because he was suspected to be the NYC Shooter.

Kaplan asks if any of Mangione's movements at McDonalds (eating and wiping his mouth, sitting) would give him any concern for his own safety in those 13 minutes. Frye says no. Another customer is visible walking out.



Backpack comes up again, and Kaplan asks if Mangione said "Don't move or touch my backpack." Frye says no.

Kaplan also pointed out that the backpack wasn't moved significantly far away, being placed on a neighboring table behind them when initially moved. Kaplan is now pointing out how many officers are on the scene at 9:45AM: They count 9 officers.

I know the defense is just doing their job. I understand why and often when there is nothing, they have to try to make something. I get it.. BUT let me just show a different scenario.

Police show up to McDonalds and show their hand immediately. Ask this guy if he's LM and then LM reacts by grabbing his gun and causing a shootout at the McDonalds where innocent people are now put at risk.

We'd be having a hearing right now where LM might or might not be alive to participate in it and where those responding officers might or might not be alive to participate in it. The defense would be asking LE why they rolled up to the McD's where they knew innocent civilians were at and confronted LM like they did. I'm sure they'd be saying something like you could have lied to him couldn't you have? You could have gotten him out of the store then told him what was up. Of course, either way LE is never going to be seen as the good guys in the eyes of the defense, something always needs to be picked apart or criticized to fit some narrative to make their cold-blooded murderer client look good.
