NY - UnitedHealthcare CEO Brian Thompson fatally shot in Midtown. #12 *Arrest*

KA asked what he told Wasser when they had to pull over, and he had to hand the evidence bag to her to bring back to the station.

Fox explains that he recieved a call that he was needed back at the McDonalds from a higher-up. KA hands him a document, and asks if he recognizes it.

Fox: Yes, it's a map of the McDonalds on Plank Rd. to the Altoona PD.

KA: Does this fairly and accurately represent the distance from Altoona PD to the McDonald's?

Yes, offered into evidence.

The map is shown on the evidence screen, and Fox is explaining the route he took. He drew it on the map in his possession.

KA asks him to draw and describe where they stopped to pass off the bag.

Judge Carro mentioned that if Fox touches the screen in front of him with his finger, he can draw or trace his route and we can all see it on the evidence screens. They are attempting to have Fox do this...

KA: So you took Union Ave, Union Ave pivots North, you stopped around 10th Ave....so you're almost at the precinct?

Fox says he stopped by Tuckahoe park, he got out of the car to give to Wasser, but she did not get out of the car. He did not have his BWC on.

KA confirms he then went back to the McDonald's. She asks what time he returned to the McDonald's but he does not remember.

She asks what he did after that.

Fox says he went back to the precinct to get assistance with tracking Mangione.

KA asks if that was around 10:30AM, he thinks yes.

KA comments that Mangione's arraignment was later in the evening and asks what Fox did in between.

Fox says that he began tracking Mangione (in PA- where he went, where he stayed etc).

KA: And you were doing this for the NYPD? This wasn't for the PA case?

KA: And you spoke to ADA Seidemann that day?

Fox: I don't remember

KA: But you told him that day you'd help him if he got a ticket because of parking..

Fox says his BWC was on when transporting Mangione to the Blair County Courthouse (it's about a 21 minute drive from Altoona PD), but Fox said his BWC died shortly after.

KA asks if he remembers saying something along the lines of, " It's the ultimate bad guy catch."Fox doesn't remember what he said..

KA asks if Mangione commented during the ride that, "This is a really nice town," and "it was a nice McDonald's"

Fox: Yes Ma'am

KA: And you were laughing together?

Fox: Yes Ma'am.

@Kyle_Schnitzer

Fox gave a spirited response when asked what he knew about the CEO shooting prior to Dec. 9, 2024, saying that it was a "violent act of cowardice that targeted a defenseless human being."

KA asks about the statement he testified hearing Mangione say during direct ("All these people are here for a mass murder- wild"), and points out that his body-cam had died.

KA also asks Fox if Mangione expressed concern about the McDonald's worker.

Fox: He was asking if we were going to release her name to the press. We told him that's not how we typically handle, they remain anonymous. And he said, 'good it wouldn't be good for her if it got out.'

KA: And you wrote in your report that he was genuine in saying that?

Fox: Yes.

KA: And you felt like he was genuine was he apologized for everything that happened that day?

Fox: As genuine as someone who just assassinated a man could be

KA: Objection

Carro: No, that'll stand.

Defense has no further questions and State is conducting the redirect.

Luigi just moved his chair closer to Kaplan, and they are whispering while looking at Patrolman Fox.

Seidemann is asking about the Mangione "mass murderer" comment.

State: Was it before or after the arraignemnt?

Fox: After

State: Do you know what time that was?

Fox: I know it was late at night, but I don't know what time that was

Defense gets up for one question about the size and blade of the knife, and as she sits back down, whispers something to Mangione. Fox was dismissed as a witness and both sides just approached the bench.

The quote from Patrolman Fox regarding “assassinating a man” appears to be slightly inaccurate. However, Fox himself seemed to misspeak while attempting to make the remark. Another reporter interpreted it as, “As genuine as someone who just assassinated the CEO Shooter could be” ...this phrasing doesn’t make literal sense, but supports the likelihood that Fox misstated what he intended to say??

Respectfully, my thoughts...

Whomever murdered Brian Thomson should have not killed him; I do not condone murder. However, the policies of United Healthcare have led to deaths and suffering on a mass scale, infinitely greater than one life taken. We can recognize that someone is a victim of a crime without rewriting their history or pretending they have not contributed to harm.

There are people that support LM because they believe he committed this horrific crime, but I get the impression that the majority of the people supporting LM do not believe he is the one that killed Brian Thompson. My stance is regardless of if he is the murderer, the state must prove that he is beyond a reasonable doubt. If they cannot meet that burden then he should not be convicted. If LEO do not mirandize LM when they were supposed to that is very problematic.

Re. the black bolded : Agreed ... we can recognize that Brian Thompson is a victim of a crime, but I was not trying to rewrite his history, and at this time we don't know if he directly contributed to harming anyone, or knew about others doing so ?
Not sure my comment reflected that.

Re. the purple bolded : Wow, I'd not read anywhere that LE hadn't Mirandized LM ?
Where did you read that ?
I'm trying to catch up from the last thread and this one and may have missed it, thanks in advance.

One bit of speculation that most likely has no merit yet is that IF BT was going to expose anyone else, was this murder a planned hit ?
For much of this case I assumed LM worked alone.

But other possibilities have occurred to me.
Just thinking out loud.
Imo.
