Phoenix was with his mom, Nicole Serna, who has custody but is supposed to be supervised with the boy, per a DHS safety plan. They were last seen around 8 a.m. at their Gresham home.

Serna has custody of Phoenix, but only as long as they remain under a supervision safety plan administrated by the Department of Human Services.

Nicole Serna was charged with second-degree theft and possession of methamphetamine earlier this year, according to local court records.

Who was supposed to be supervising her? Did she somehow distract this person and leave? Who called LE to do a welfare check?

On Saturday morning, Burgess [foster mother?] said she was in the bathroom and Phoenix was sleeping when Serna took him and ran down the street with her boyfriend before they reportedly turned the corner. She thinks they got in a car and sped off. Phoenix's biological mom, Nicole Serna, also lived at the home as a part of supervision guidelines created by the Department of Human Services.

Serna has an alleged history of drug use, police are concerned about the toddler's safety without supervision.
