Murder? Was she alone? Suddenly went in to labor? Took the baby to the hospital within an hour? Sounds like a series of traumatizing events that ended in this newborn (who likely had a 50/50 chance at survival) dying. A lot went wrong here but I don't see murder based on the information provided. MOO.

Agreed. I hardly see this as a case for murder.

While this woman definitely made some bad decisions (IDK what criminal charges would be appropriate for using cocaine while pregnant), I agree charging her with murder is WAY too extreme here. Giving birth is extremely hard on one's body, especially since she (seemingly) did it at home with nobody else around. How did she even get to the hospital? I assume she drove herself, and if that's the case I imagine she wouldn't have physically been able to drive right after the baby was born. So the fact she managed to get herself and the baby to the hospital within an hour is pretty impressive.

It's important to note that drug use can be connected with premature births, but it should be pretty easy to tell wether or not the baby had cocaine (or any other drugs) in her system. Even if the cocaine use DID cause the premature labor, murder still seems excessive. There could be a case for child endangerment if this is true, but it sounds like nobody knows at this point.
 
In Wednesday's ruling, Frey wrote, "the Commonwealth has not presented evidence to establish the element of malice prima facie. Confusion and indecisiveness in the wake of an unanticipated home-delivery, at an extremely premature 23 weeks, does not equate to malice."

23-week gestation infant
The baby girl died at 4:23 PM on Tuesday, March 7.
November of last year, Truax visited a clinic to terminate the pregnancy but the procedure was unsuccessful.
In February, Truax went to the hospital for abdominal pain, at which time the doctor notified her that she was still pregnant.

Was there no follow-up appointment or bloodwork after her abortion in November to confirm the termination or did she just not go for a follow-up? Trying to wrap my head around her having to be informed at the ER visit in February that she was indeed still pregnant (she would have been between about 18-22 weeks at the Feb. ER visit)

Agreed. Apparently she went to a clinic to terminate the pregnancy and somehow it wasn't successful -- that is unusual, IMO, but I guess it happens... dunno. SMH.
Then when the baby was born, IMO, she did whatever she could at the time, seems to me, and the best she could. I just don't see this as a murder based on what I have read so for -- JMO.
This is upsetting, again JMO.
