it is completely bizarre... honestly they should have let the people decide DP or no DP based on mitigating or aggravating circumstances. although he claims to be on the spectrum and having certain issues and disabilities, I still think his level of functionality is quite high and he also fit enough to kill 4 young healthy people in a single go, so mitigation seems scarce..like almost non-existent.

Visual Snow? not really a mitigation factor either..like saying you can't give me the DP because I have tinnitus...

I think it was disgraceful and I was not satisfied. I hope somehow it all gets reversed and sent to a jury trial. mOO
I think it would be VERY risky to go to trial now.

So many uncertainties. There was a minefield the prosecution needed to move through.
---The DNA admission into evidence could implode.
---And the two survivors, not calling 911 until noon the next day? They would have been really poor witnesses during cross examination, imo.
---And there were potential questions about the phone and the cell towers because it moved through areas with no cell coverage, leaving the defense free to fill in the gaps themselves.

I was nervous about the trial as it was approaching. I think the confession was a very lucky thing to happen just in time. IMO

Just stepping aside from the individual in question, I actually have a real problem with this staff member not facing some kind of charge. The cameras are there for safety. The prisoner does not have any control or veto for them being there. They film them all the time - sleeping, dressing, using the toilet. The duty of care breach is one I find disgusting. I don't care who the subject was or what he did - I care that someone exploited that position of power for money. And they're not getting any consequences for it. If you did it in a school, in a hospital, in a public bathroom, you'd be charged. But it's an inmate, oh, never mind?

I think his family did give in to his whining and complaints

A lot seem to believe this about his family, but what do people really think they would have done so differently if he were their son to raise? Keeping in mind you want to have a relationship of some kind with your son, you want it to feel positive at least sometimes, and you need some cooperation by him, so he'll participate in seeing doctors, therapists, and going to rehab.

Keeping in mind you want to have a relationship of some kind with your son, you want it to feel positive at least sometimes, and you need some cooperation by him, so he'll participate in seeing doctors, therapists, and going to rehab.

I personally have spoken to many "hopeless" parents, "stuck" with a bewildering stranger in their home, their son, who they don't like, or even want to recognize as their son.

We can't always "blame" parents, because often children raised in the same household turn out completely differently. People may not agree with me, but I see BK's family a victim of BK as well. Who wants to be the parent of a mass killer of a heinous crime? Or sibling?

Oh, I agree. I am sure there isn't actually "more or different" that *some* of these families could have done. We don't know either way really.

The reason schools, like WSU, take a long time to deal with these issues is, to a great extent, fear of lawsuits. More lawsuits will not fix that problem. Almost any termination of employment risks a lawsuit, especially with state employees. Most terminations will be reviewed by lawyers to assure due process was taken. Student terminations may also generate due process complaints.

If, somehow, this lawsuit progresses, there will be attempts to squash most subpoenas (in some cases, these are actually required to be contested by federal rules, especially with HIPPA rules - I don't know about FERPA).

In addition, if all records are released, the personal privacy of all persons making a complaint, in what was assumed to be a confidential manner, will be violated.
