True, but that isn't what I am doing here. We can all find out at the trial. Many have made the assumption that JITB is what the DD was. That is probably correct, but I don't recall seeing it as a known fact anywhere. DD didn't say so, LE didn't say so. The correct answer to "Do we know what Xana ordered" is that we not only don't know what food item(s) she ordered, but we can't even say for a fact that it was JITB. We only assume based on what we have seen and putting pieces together. (that is 'we' as in the generic 'we')

But supposed she ordered DD JITB the day before, the bag was still there because they reused paper bags in the house for other things and the DD for that night was actually from somewhere else and THAT packaging was already in an evidence bag somewhere? That fits what we have seen, too.

At the moment, I, personally, can't say for absolute sure that JITB is what was ordered that night, though I do lean that way. MOO, of course.

The speculative scenario I shared recently about Xana noticing BK’s car circling her house was an exercise in seeing if I could get at least a part of an interesting theory posted in the comments section of this Gray Hughes video to make sense, given the known facts and the claims of the DD driver.

The commenter, guidothechihuaha, stated that Xana saw BK, and that he saw her, as well, which I left as an implied reason that BK stopped on the road next to Xana’s house just before the DD driver arrived. BK wanted to watch Xana watching him (well, his car).

The possibility that Xana noticed BK circling the house, that she pressed against the second floor window as she peered into the darkness, and that BK saw her too, is chilling and I hope none of it occurred.

However, I don’t know how it would actually work that BK noticed her looking out the window as he passed the house multiple times before the murders.

In this case, he’d have to know she’d be awake when he entered the house minutes later, even without knowing that the second driver was from Door Dash.

Would BK really sneak upstairs to murder Maddie (and possibly Kaylee) knowing someone was awake and able to call 911 mid-murder? That seems unlikely to me.

If BK saw Xana in the window with the palm print and went in anyway, he would have absolutely intended to kill her, too, IMO. But to have the chance to do that without her ruining his plans with an immediate call to 911, he would have killed her first.

I suppose it’s possible he indeed killed Xana first, but would that work with DM’s testimony, the thud, etc?

The Door Dash driver can definitely answer that. Also if Xana had a habit of ordering Jack In the Box food. I can't conceive of re-using bags that food is delivered in, because usually some grease leaks out from the food, and these bags are thin.

Still no order on the continuance (or the alternate suspect).

Alas, my definition of “in short order” and Judge Hippler’s differ.

As is par for the course, I cannot find the link now, but SOMEWHERE in all of these documents is a Door Dash ticket that showed a delivery from JITB, delivered to 1122 King Road, at 3:59. Gray Hughes also showed it in a video at some past time as well. JMO

The DoorDash receipt shows the subtotal for Xana’s order, 22.35. Did anyone ever try to sleuth what she might have ordered?

Yes. It was like a snack pack thing. I am not even sure if they offer it anymore. There is no Jack in the Box in Moscow, so this was in Pullman. They have something similar for $22.99 now (game day munchies). JMOO, as I have never eaten from JITB.

Thanks! So the “subtotal” on the DoorDash receipt doesn’t include the DoorDash fee?

I remember hearing that the only nearby Jack in the Box was in Pullman, and I believe the restaurant was open until 3 am?

Anyway, it makes sense that the DD driver, MM, picked up the order—though from Moscow, she was staying in Pullman with her boyfriend, at least at the time of her traffic stop in September 2024.

can you imagine that 7 foot tall skinny weirdo standing in the shadows? it's so disturbing and they can't hide his size or his weirdness in court. he is extremely unlikeable and unsympathetic. I can think of things that would help but I'm not going to say because I don't want to help him.

when the jury hears how he drove over there later that morning...any doubt will be erased.

@SteveP, both The Pocono Record article and the recent Daily Mail article say the same thing about the court documents, but neither provides a link to the docs.

The subpoenas for the two men are not yet on the Pennsylvania Cases of Interest page for Kohberger, though the list is “selective”: Commonwealth v Kohberger

I wonder when or if they will appear. We should know then whether the prosecution or the defense called them to be witnesses.

All of the witnesses called including the two today are to appear in court at 9"00 am on June 30th except for Maggie Sanders who got a continuance to July 7 at 9"00 am. The first 5 witnesses summoned appears to be by the defense.

Also unlike the previous five summons, there are no amended exhibits, so we still don’t know whether the two new witnesses are called by Bill Thompson or Anne Taylor. (Unless I’m missing something 😊).

At one time, I thought that perhaps the DD delivery was made to the back slider, based on a supposition from Gray Hughes, using gps coordinates from DD, which contained a number that could not be discerned, with one of the guessed digits placing the delivery at the back. However, that was never a given, but only a thought, and after seeing the traffic stop video, where the woman told the officer that she takes hydrocodone for extreme pain from Fibromyalgia and arthritis, I am now of the opinion that it nay have been very difficult for her to negotiate the hill on the back side, especially in the dark, and so I believe that she very likely delivered to the front door, and was perhaps parked in the driveway area, or the street in front of the house. JMO
Yes, your reasoning above added to the thoughts of safety for a woman out alone at 4 am, I think she used the front door. So much safer to be on the front steps under a porch light, near the Main Street and visible by neighbours etc.

A DD driver at 4am has to be vigilant and aware of robbery or carjacking and a woman has added fears about assault or kidnapping. So I do believe she used the front door.

Thank you. I can at least search for it. Never mind. You guys are the best @PunishThenForgive and @SteveP .

Now I know that the DD was in fact JITB and that goes in the top half.
