Tomasz Komenda was a Polish man who, on 16th June 2004, was sentenced to 25 years in prison for the rape and murder of 15-year-old Małgorzata Kwiatkowska.
On the night of 31st December 1996-1st January 1997, Małgorzata Kwiatkowska, a resident of Jelcz-Laskowice, spent a night out at the Alcatraz disco in Miloszyce at Główna Street 7A. She was last seen with three men who ran the place: Krzysztof K. and Andrzej W., and Ireneusz Matuszak, identified by witnesses. She was found dead the next morning. In 1999, a Polsat program, Television Investigation Bureau, featured a drawing of a man with whom the then 15-year-old girl was allegedly playing. After the program, Dorota P. called the police, claiming that the person in the drawing resembled her neighbour's grandson, Tomasz Komenda. Crime experts even stated that a hair found in a balaclava that was at the crime scene belonged to Komenda. Twelve people gave him an alibi that he had spent that New Year's Eve in Wrocław. Despite this, Komenda was detained on 19th April 2000. Komenda claimed that he was threatened, intimidated and beaten by police officers until he confessed.
In 2016, the case was reopened when several officers began reviewing the files from the case. On 16 May 2018, Komenda's convictions were overturned by the court, as there was no evidence to prove his guilt. Tomasz Komenda spent 6,540 days in prison. During his prison time, he appealed four times and was physically and mentally abused. Komenda died from lung cancer on 21st February 2024.
