*Trial set to begin (Federal Child 🤬🤬🤬🤬 & gun) (@ 9am ET) – ME - *Marc J. Karun (21 @ time of crime/53/now 56) charged (12/14/19 in Maine-Federal ) & indicted (11/6/19) & arraigned (12/14/19) with possessing a gun with an obliterated serial number, stemmed from allegedly owning a rifle that had its serial number filed away. Plead not guilty.
Police found 60 weapons & 15,000 rounds of ammunition in his Stetson home. As a convicted felon not legally allowed to own firearms.
*Indicted (3/10/21 in Maine-Federal) charged & arraigned (5/18/21) with possession of child p0rnography. Plead not guilty.

4/20/23: Motion to extend time for trial-granted. Next pretrial hearing on 5/10/23 @ 9am. 8/16/23 Update: The Court denied the defendant’s motion to re-open consideration of the motion to suppress evidence 7 set the case for jury selection on 9/5/23. Defense filed a motion to continue the case to the 11/7/23 trial list. It is likely that the case can be resolved with a conditional plea of guilty that preserves the defendant’s right to appeal the denial of various pretrial motions. Counsel for the Government does not object to the motion. Defendant waives his rights under the Speedy Trial Act & requests that the period of time requested be excluded from computation pursuant to the Act. HEREBY ORDERED THAT: 1. The defendant’s unopposed motion is hereby GRANTED. 2. Trial is continued to 1/2/24. 3. Plead not guilty. $5M bond. Pretrial hearing on 3/1/24.

*Trial set to begin (@ 9:30am ET) - IL – Danica Shernay Ford (22) (found in Woodland Memorial Cemetery on Nov. 12, 2018, Joliet; Id’d Nov. 20, 2018) – *Deiontae Shawnrico McMillian (24/now 29) (BF) charged & indicated (2/13/19) & arraigned (12/18/19) with 2 counts of 1st degree intentional murder & 1 count of 1st degree murder. Plead not guilty. $2M bond. And indicted (11/21/18), arrested (11/22/18) & arraigned (12/18/18) in Fayetteville, N.C. (was extradited to Illinois) also charged (11/12/18) with concealing a homicide. Plead not guilty. $2M bond.

11/17/23 Update: Continuance by Defendant. People present by Erin M. Krone. Defendant present in custody of Kthe Will County Sheriff, Pro Se. Matter comes on for State's motion to continue. Motion is heard & is granted over defendant's objection. Date of 12/4/23 is ordered stricken. On motion of the Defendant, matter is continued for jury trial. Subpoenas are continued. Defendant remanded. Case to follow. Jury trial set to begin on 1/2/24 @ 9:30am.


Thursday, January 4th:

*Sentencing Hearing (@ am PT) - CA – Roman Anthony Lopez (11) (last seen Saturday morning Jan. 11, 2020, found later in evening dead in a storage bin in the basement, Placerville) – death is being investigated as suspicious. *Jordan Thomas Piper (35/now 38) “father” arrested (2/3/21), charged (2/4/21) & arraigned (2/9/21) with 1 count of child abuse likely to cause injury or death & causing cruel & extreme pain for revenge, extortion or sadistic purpose, 1 count of torture & 1 count with willfully failing to provide food, shelter & medical attention to the child. Plead not guilty. $1.05M bond. Additional charge (10/29/21) & arraigned (11/19/21) of murder. Plead not guilty.

10/26/23 Update: Piper accused of murder & child abuse in the death of his 11-year-old son, Roman Lopez, unexpectedly changed his plea Thursday & was convicted in the boy’s death. A preliminary hearing to determine whether Piper should stand trial as charged initially was scheduled to begin next Tuesday morning in El Dorado Superior Court. But that hearing has now been vacated. Instead, Piper appeared Thursday afternoon in Judge Vicki Ashworth’s courtroom & pleaded guilty to 2nd degree murder in Roman’s death. Piper remains in custody & is scheduled to return to court 11/21/23 his sentencing hearing.
11/21/23 Update: The sentencing of Piper was postponed Tuesday after issues getting him logged on to the courtroom's Zoom call. New sentencing date on 1/4/24.
*Lindsay Marie Piper (38/now 41) “stepmother” - Plead no contest (5/16/22) to 2nd degree murder. Sentenced on 7/8/22 to 15 years to life with the possibility of parole. Her guilty plea (deal) will dismiss these charges: child abuse, poisoning & torture.
*Federal Criminal complaint filed (6/21/22) & charged (6/23/22) of sexual exploitation of a child/🤬🤬🤬🤬🤬🤬🤬🤬🤬🤬🤬. Plead guilty on 3/20/23 to a plea deal. Sentenced on 10/23/23 to 15 years in prison & 7 ½ years parole.

*Trial set to begin (@ 9am MT) - CO - 23 month old baby girl (died Jan. 2, 2022 from fentanyl (10 times the amount necessary to kill an intolerant adult user), Brighton) - *Alonzo Ray Montoya (31/now 32) arrested & charged (3/30/22) & arraigned (8/4/23) with child abuse resulting in death & [distribution of a controlled substance (Sched I or II)-decided 11/30/22]. Plead not guilty. $250K bond.
Trial began on 11/29/22 & ending 11/30/22 for distribution charge (Montoya only). No idea what happened.
Trial set to begin on 1/8/24 (thru 1/19/24).

12/20/23 Update: Judge Kevin Randolph has denied motions to suppress Troconis’ police interviews & to suppress DNA evidence. Randolph’s conclusion: “The search warrant for defendants DNA was facially valid & did not lack probable cause. The defendant knowingly, intelligently & voluntarily waived her rights when she spoke to the police on June 2, June 6 & August 13.” “She had the assistance of competent counsel before & during the interviews. Though police used, at times, deceptive tactics her will was not overborne.” See post #113 page 6. Pretrial hearing set on 1/4/23 per court site @ 10am.
1/4/24 Update: Judge Kevin Randolph said during an emergency hearing at the state Superior Court in Stamford Thursday that the juror in question had contacted the court earlier this week after he unexpectedly was fired from his job Dec. 31. Citing “adverse financial circumstances,” the juror had asked the court to excuse him from the jury so he could begin searching for a new job, according to Randolph. The juror’s dismissal, however, leaves only 6 regular jurors & 2 alternate jurors for Troconis’ trial. Additionally, one of the eight remaining jurors already has contacted the court to inform them he contracted COVID-19 over the New Year’s holiday weekend. Schoenhorn also asked that the case be dismissed due to the three-day delay & was denied. ** 6 men/4 women, now 4 men/4 women. The jury selection will happen on Tuesday, 1/9/24 & Wednesday, 1/10/24 with the trial now beginning Thursday, 1/11/24.

Thursday, Jan. 11th:
*Bench Trial continues (Day 47)-CLOSING ARGUMENTS! (@ 10am ET) – NY - New York vs. Donald J. Trump (76/now 77), Donald Trump, Jr. (45) & Eric Trump (38/now 39) & the Trump Organization, Inc. (Allen Weisselberg (75/now 76) & Jeffrey McConney) are being sued by Letitia James, the New York Attorney General, who is leading a civil investigation (which cannot result in criminal charges filed on 9/21/22) & has spent years looking at whether the company committed various acts of fraud over several decades. In the civil case, Ms. James has filed a lawsuit against Trump & two of his children accusing them of "astounding" fraud & deception.
New York is seeking $250 million in financial penalties & asked the court to ban Trump, Donald Trump Jr. & Eric Trump from serving as an officer or director in any corporation registered or licensed in New York. James also requested the court ban the former president & his business from acquiring real estate in New York or from applying for loans from any New York financial institution for five years. James's civil case accuses Trump of lying from 2011 to 2021 about asset values at the Trump Organization, as well as his own net worth, in order to obtain better terms from lenders & insurers.
Lawsuit against: Donald John Trump, Donald Trump, Jr, Eric Trump, Allen Weisselberg, Jeffrey McConney, The Donald J. All charges against Ivanka Trump were dismissed in June, 2023.

The lawsuit’s remaining 6 counts allege similar acts of fraud (that Trump inflated his assets on statements of financial condition that he submitted to banks & insurers for personal gain).

New York appellate court temporarily paused gag orders on Thursday, 11/16/23 & NY AG Letitia James & representatives for Judge Arthur Engoron have until Wednesday, 11/22/23 to file a response to the appellate judge's stay of the limited gag order imposed last month on Trump by Engoron, according to the appellate judge's order. Trump's reply is then due on 11/27/23 before the appellate court decides whether to fully lift the gag order. The civil fraud trial is expected to wrap up in mid-December.
Trump’s request for an expedited grant of leave to appeal the gag orders in his civil fraud trial was denied Monday (12/5/23) afternoon. Trump still has an avenue to appeal the decision to a higher court; however, the effort will take longer than his lawyers would like. Trump’s lawyers now face a deadline of Monday, Dec. 11 to file their papers to the First Department.

Court will adjourn until 1/11/24, when both sides will present closing arguments after submitting written summations. The parties must submit legal briefs summarizing their positions before returning to court for oral arguments. The briefs are due on 1/5/24.
Defense attorney Christopher Kise also promised to submit a written argument for a directed verdict that will ask Judge Engoron, for a fifth time, to end the case for lack of evidence. Engoron has not promised to even read such a filing, but said that he "probably" would. This was denied (see below).
Trump has lost his appeal to throw out the limited gag orders & associated fines in his civil fraud trial. In a decision Thursday, New York's Appellate Division, First Department rejected Trump's request to annul & vacate the limited gag orders imposed by Judge Arthur Engoron that prohibit Trump & attorneys from commenting on the judge's staff. In addition to Thursday morning's appellate decision denying Trump's appeal, a panel of appellate judges issued an additional order Thursday denying his request to elevate his appeal to New York's highest court.
Re Direct Verdict: 12/18/23 Update: Decision & Order Denying Defendant’s Motions for a Directed Verdict. For at least the fifth time, Trump on Monday lost an attempt to dismiss his civil fraud case through a maneuver seeking a directed verdict in his favor. In tossing Trump's latest challenge, Manhattan Supreme Court Justice Arthur Engoron reminded the former president that "a lie is still a lie."

1/4/24 Update: Plaintiff's (State of NY) proposed findings of Fact & Conclusions of Law filed by Letitia James, AG of the State of NY.
The Court should order disgorgement which as of October 27, 2023 totaled $369,948,314, consisting of: (i) $168,040,168 in saved interest on four commercial real estate loans; (ii) $139,408,146 in profit from the sale of OPO; (iii) $60,000,000 in profit from the sale of Ferry Point; and (iv) $2,500,000 in bonuses paid to Weisselberg & McConney.
The People respectfully request that the Court conform the pleadings to the evidence pursuant to CPLR 3025(c), find all defendants liable on counts two through five, and find all entity defendants and individual defendants Weisselberg & McConney liable on counts six and seven, and upon such order and the Court’s prior SJ Decision, enter final judgment granting disgorgement and other equitable relief described above.

Friday, Jan. 12th:

*Sentencing Hearing (@ am CET) – France - *Charlotte (14/now 18) on Mar. 16, 2017 & lodged a complaint in 2019, after hearing about the sexual assault of two other little cousins of Lelandais, aged 4 & 6. *Nordahl Lelandais (36 @ time of crime/40) charged & indicted (2/27/20) with sexual assault on a minor under aged 15 & threatening or intimidating a victim in order to prevent her from reporting the crime or to retract her statement. *not her real name.
Trial began on Nov. 27, 2023.
Oct. 31, 2023 Update: Lelandais to stand trial on 27 November, 2023 for sexually assaulting one of his cousins. The teenager, who was 14 at the time of the events, lodged a complaint against Lelandais in 2019. The former dog handler has already been convicted of abusing two other young cousins. Lelandais faces charges once again. The former dog handler, now aged 40, is to stand trial on 27 November for "sexual assault on a minor aged 15" and "threatening or intimidating a victim in order to prevent her from reporting the crime or to retract her statement", said the Charleville-Mézières prosecutor, confirming information from RTL. The victim is a little cousin who was 14 at the time of the incident.

Nov. 27, 2023, Monday, Trial Day 1: Nordahl appeared before the Magistrates' Court in Charleville Mezières (Ardennes). The trial has allegedly started at 13.30 hrs & will be closed session. After a five-hour hearing, the public prosecutor requested two years' imprisonment. Judgement has been postponed until 12 January, 2024.

*Hearing & Trial set to begin (@ 9am PT) – CA – Blaze Bernstein (19) (Jan. 2, 2018, Lake Forest; found Jan. 9, 2018; he was stabbed 19 times in his neck; 14 times on the left, 5 on the right & 1 stab wound in his left knee) – *Samuel Lincoln Woodward (20/now 25) arrested & charged (1/17/18) & arraigned (11/9/18) with 1 count of felony murder with a hate crime enhancement for killing someone because of their sexual orientation & sentencing enhancement-personal use of a knife. Plead not guilty (again on 11/9/18). $5M bail, bail revoked (11/9/18). In custody of the Theo Lacy jail.
Trial was set to begin on 7/15/22 with jury selection was vacated for competency evaluation. Found competent (10/21/22) to stand trial.

1/2/24 Update: The trial was supposed to begin the day after New Year’s Day has been moved to August. The trial against McMillian was rescheduled after he told Judge Carmen Goodman on Monday that he was looking for a new lawyer & he’s having discovery issues with prosecutors. As a result, Judge Goodman decided to reschedule McMillian’s two-week trial for 8/5/24. Since spring 2022, McMillian has been serving as his own lawyer after he parted ways with his previous defense attorney, Paul Napolski.

Oct. 31, 2023 Update: Lelandais to stand trial on 27 November, 2023 for sexually assaulting one of his cousins. The teenager, who was 14 at the time of the events, lodged a complaint against Lelandais in 2019. The former dog handler has already been convicted of abusing two other young cousins. Lelandais faces charges once again. The former dog handler, now aged 40, is to stand trial on 27 November for "sexual assault on a minor aged 15" and "threatening or intimidating a victim in order to prevent her from reporting the crime or to retract her statement", said the Charleville-Mézières prosecutor, confirming information from RTL. The victim is a little cousin who was 14 at the time of the incident.

9/13/23 Update: Motions hearing before Second Circuit began today, 9/13/23 at 10am. Trump is trying to delay the Carroll I trial (based on his defamation of her from 2019. Judge Lewis Kaplan heard arguments from Trump’s defense attorney Alina Habba & Carroll’s attorney Joshua Matz. A federal appeals court will quickly consider Trump’s claim that presidential immunity protects him from being held liable for statements he made in 2019 when he denied that he sexually attacked a New York writer in the 1990s, the court said Wednesday. The 2nd U.S. Circuit Court of Appeals in Manhattan issued an order to say it will expedite the appeal a day after Trump attorney Alina Habba told a three-judge panel of the court that the appeal raised “an important question that will affect the delicate balance between the judiciary & the executive branch for many years to come.” The 2nd Circuit set a schedule for written arguments to be filed within a month. In its two-page order Wednesday, the 2nd Circuit denied an application by Trump to stay lower-court proceedings during the appeal, but it said it was in the interest of all sides for the appeals court to resolve the issue of presidential immunity expeditiously.
11/3/23 Update: District Judge Lewis A. Kaplan has ordered an anonymous jury in the next Carroll trial, citing Trump's conduct including his violation of the gag order in the ongoing civil fraud trial. (The jury in the previous Carroll trial, also before Judge Kaplan, was also anonymous.
11/17/23 Update: A federal judge rejected Trump's bid to add a new expert witness just two months before a trial addressing how much Trump owes for defaming the writer E. Jean Carroll, saying Trump "made his own bed" by waiting too long. Trump had claimed he would suffer "extreme prejudice" without a new damages expert for the scheduled Jan. 16, 2024, trial.
12/14/23 Update: U.S. Appeals Court rejects Trump's request for immunity from E. Jean Carroll's defamation lawsuit. The ruling upholds a federal judge’s decision to reject his claim of immunity, finding had waited too long to raise it as a defense. The trial will now go ahead on 1/16/24.
12/21/23 Update: Trump is asking a federal appeals court to delay his defamation trial set for next month in a lawsuit brought by E. Jean Carroll so he can consider other legal moves, including potentially taking the case to the US Supreme Court. 1/12/24 Friday, Trial Day 2: State's witnesses: Sgt. Jamie Pearston of the Connecticut State Police's Western District Major Crimes Unit.
Without jurors - Defense is arguing against photos that include images of things that didn't test presumptive for blood. Judge Randolph said he would review relevant cases regarding blood evidence during the recess. After spending time reviewing case law, Judge Randolph allowed Supervisory Assistant State's Attorney Michelle Manning to enter into evidence tests of stains found in the garage of Jennifer that were "presumptive for blood.
State witnesses continued: Retired state police detective Matthew Reilly, evidence officer at the scene.
Schoenhorn then asked the court to withdraw several photos from evidence because Reilly didn't recall a red dot on the measuring device. The jury was asked to leave the room while the judge hears arguments on the evidence. But when the jury returned, Schoenhorn filed an objection to including the photo of the device, which Randolph denied.

The court discussed the issue of presumptive tests for blood repeatedly Friday. Since the issue needed to be discussed outside of the jury's presence again, the jury was let go for the weekend at 4:25pm. They may or may not be back Tuesday, 1/16/24 depending on the weather since a storm is predicted, Randolph said. Monday is a state holiday & no court will be held.

7/3/23 Update: Tommy Schaefer, currently serving an 18-year prison sentence in Bali for the murder of Sheila von Wiese, could be released from Indonesian custody and return to the United States as early as spring of 2026. Schaefer acknowledged his part in von Wiese’s brutal murder in 2014, but called his federal indictment for conspiracy to murder von Wiese “vengeful.” He also reiterated his contention that he never meant to kill her until a heated argument took place in her hotel room. Schaefer has already had four years and two months shaved off his sentence, and in August he will receive another six-month reduction.” With effectively 18 months off his sentence annually, Schaefer can expect release as early as April of 2026 & possibly earlier.

6/16/23 Update: Mack stood before U.S. District Judge Matthew Kennelly as he asked her questions. She spoke confidently & calmly as the judge asked whether she was giving up her right to remain silent at the motion hearing. “Yes, your honor,” Mack responded from a podium. After the judge explained the charge against her, Mack pleaded guilty to one count of conspiracy to kill a U.S. national. The judge set 12/18/23 as sentencing date for Mack. Mack struck a deal with federal prosecutors that would cap her prison sentence at 28 years. But key questions remain. Among them is whether U.S. District Judge Matthew Kennelly will credit Mack with the seven years she spent imprisoned in Indonesia. Another is whether Kennelly will accept the deal at all. Despite the cap on Mack’s sentence, she still seems to face a wide range of outcomes in December. That’s largely because prosecutors have taken the position that Mack should not be credited for the time she spent imprisoned in Indonesia. Mack’s lawyers disagree. As a result, Mack could potentially walk free after her sentencing. Or she could wind up serving a sentence that would keep her behind bars for another 20 years. It’s more likely her sentence will land somewhere in between.
12/18/23 Update: Sentencing date has been rescheduled on 1/17/24. Lawyers for Mack have asked a federal judge in Chicago to impose the minimum sentence of 15 years in prison & grant her credit for nearly 10 years already spent behind bars for her role in the headline-making murder of her mother. While Mack is eligible for a life sentence, the written plea agreement includes a provision saying that Mack could not withdraw her plea if Kennelly agrees to sentence her to 28 years in prison or less. Kennelly is not obligated to go along with that; if he goes above a 28-year sentence, Mack could withdraw her guilty plea. Prosecutors are slated to file their own sentencing request later this week.

1/17/24 Update: Mack was sentenced Wednesday to 26 years [The Judge originally sentenced her to 28 years with 2 years credit awaiting trial in jail] in federal prison for helping to murder her mother at a Bali resort. In addition to the prison sentence, U.S. District Judge Matthew Kennelly ordered Mack to pay about $260,000 in restitution to her mother’s estate pay a $50,000 fine. Means Mack will not be eligible for release until she is more than 48 years old.
 

She had already served seven years in Indonesia after being convicted in 2015 of covering her mother’s mouth to muffle her cries while Tommy Schaefer beat Wiese-Mack with a fruit bowl in a hotel room.

Mack’s attorney estimates that she will be imprisoned for roughly 20 years, accounting for the credit she was given for the two-plus years she spent in custody in Chicago after completing her jail term in Indonesia.

10/26/23 Thursday, Trial was cancelled. 11/1/23 Update: Johnston’s trial, set to begin in mid-October, was delayed after her defense attorney Jeremy Scheider filed some additional evidence: written notes from an Upper West Side neuropsychologist, according to court documents & a recent hearing. Those notes must be reviewed by prosecutors from the Manhattan DA’s office & a new trial date is expected to be set at a hearing 11/9/23. The delay appears to be tied to Schneider’s pursuit of a “psychiatric defense” for Johnston. In conversations with WSR, attorney Schneider has described Johnston as having an “extensive mental health history, going back probably 20 years.”

1/19/24 Friday, Trial Day 4: Trump’s legal team requested a mistrial in Carroll’s defamation case against him because she “actively deleted evidence”—despite the judge denying Trump’s mistrial request for the same reason earlier this week (Wednesday). In a Friday letter to US District Judge Lewis Kaplan, Trump's attorney Alina Habba asked for a mistrial because of what she described as Carroll's failure to preserve evidence relevant to the case. "Plaintiff admitted that she deleted multiple email messages pertaining to purported death threats made to her," Habba wrote. If Kaplan decided not to cancel the rest of the trial — which is expected to conclude by the middle of next week — he should at least tell the jury not to award her any damages related to the death threats or tell the jury that she did something wrong, Habba said. From the letter: For the reasons set forth above, President Trump respectfully requests that: (i) a mistrial be declared; (ii) Plaintiff be precluded from seeking damages relating to death threats purportedly made to her & all testimony related to same be stricken from the record; or (iii) the Court include an adverse inference charge against Plaintiff relating to her willful violation of her discovery obligations & the spoliation of relevant evidence. both sides filed written arguments at the judge’s request on whether Trump’s lawyers can argue to the jury that Carroll had a duty to mitigate any harm caused by Trump’s public statements.

1/18/24 Thursday, Trial Day 6: Brief arguments from Schoenhorn & Supervisory Assistant Stat's Attorney Michelle Manning about testimony expected from a state police blood pattern analysis expert. Prior to testimony resuming Friday, the judge said he had been given an unsigned note by a marshal indicating a possible jury issue. "One of the jurors discussed something about the case & it was all over social media," Randolph quoted the note as saying. "Said it was like 'Gone Girl.' A brief mention, several other jurors said 'Don’t discuss this.'" The judge then broke to speak with the prosecutors & Troconis' lawyers in his chambers. The judge re-reading the note into the record, saying that though it was unsigned, it had been authored by one of the jurors & identified another juror by name. Randolph said he intended to question the juror who wrote the note, allowing the lawyers to ask questions through him about it. The judge said he then would talk to the juror who was identified in the note concerning communications they had with other jurors. The questioning of the juror would take place on the record, the judge said, but without audio or video being broadcast & closed the courtroom just after 11am. After closing the courtroom for about 45 minutes to question jurors, Judge Kevin Randolph said he dismissed one juror who had reportedly made a reference to "Gone Girl," a 2012 novel subsequently made into a film about a woman in a troubled marriage faking her own death. After dismissing the juror, the judge said he then asked each other juror whether they could continue to be objective. "Without exception, every juror indicated that they would be able to afford the state & the defense a fair & impartial trial," Randolph said. There are now a total of nine jurors & alternates, after an alternate juror was dismissed on Wednesday.

Trump's reply is then due on 11/27/23 before the appellate court decides whether to fully lift the gag order. The civil fraud trial is expected to wrap up in mid-December.
Trump’s request for an expedited grant of leave to appeal the gag orders in his civil fraud trial was denied Monday (12/5/23) afternoon. Trump still has an avenue to appeal the decision to a higher court; however, the effort will take longer than his lawyers would like. Trump’s lawyers now face a deadline of Monday, Dec. 11 to file their papers to the First Department.

1/11/24 Update: Police on Long Island responded Thursday morning to a bomb threat at the home of Judge Arthur Engoron, who is presiding over Trump’s civil fraud case, a source with direct knowledge of the situation told NBC News. The threat came hours before closing arguments in the trial were scheduled to begin, with those arguments expected to proceed. A Nassau County bomb squad was called to Engoron’s home & was investigating Thursday morning; it is unclear whether Engoron was home at the time.

Attorney Kise asks for permission to have Trump speak. Engoron, "Do you promise to comment on the facts & the law?" Trump starts talking immediately without agreeing. Trump has started addressing the court in the closing arguments of his civil fraud trial. Saying it was a political witch hunt, blah blah blah. Judge cut him off after 5 minutes.
Judge Engoron concluded the day by estimating that he would issue an opinion in the case by 1/31/24. He then ended the proceedings.

1/26/24 Friday, Trial Day 6: Closing arguments by Carroll’s attorney Roberta Kaplan. [Trump walks out in the middle of her closing & returned before start of defense]. Defense attorney Alina Habba. Carroll’s attorney Shawn Crowley gave rebuttal.
Judge Lewis Kaplan instructed the jury on the law, nine jurors began deliberating how much money, if any, Trump should pay in damages for making two defamatory statements about Carroll in 2019. Told them they can deliberate during lunch also. In filings to the court, Carroll's lawyers have indicated they're seeking at least $10 million in damages, but their statements to the jury have reflected a potentially higher number based on Trump's repeated defamatory statements during the two-week jury trial. Carroll's lawyers argued that Trump made 22 defamatory statements last Tuesday, when opening arguments were delivered in the case & that overall he's made more than 100 defamatory statements, both in & out of court, during the two-week trial.
Following Judge Lewis Kaplan's instructions to jury members, the jury has retired to deliberate. The judge gave the parties 45 minutes to get lunch, so the court will not accept a jury note or a verdict until starting at 2:25pm ET. If there is no verdict by 4:30pm ET, court will break for the day unless the jury signals a desire to stay later.

Anya had a history of mental health problems & was institutionalized in 2014 & 2016 for erratic behavior. Johnston’s early years in a Russian orphanage, where she’d been adopted. Johnston is currently hospitalized at Mount Sinai St. Luke’s undergoing psychiatric evaluation.
Trial began on 1/22/24 with jury selection & ended on 1/25/24. Opening statements & trial began on 1/26/24.

If the jury returns a “not responsible” verdict, Johnston would proceed to court hearings to assess her dangerousness & determine appropriate confinement to a NY forensic psychiatric center. Evaluations & court oversight would continue during treatment; such post-acquittal confinement can sometimes continue for decades.
If the jury convicts, Johnston would face a minimum sentence of 15 years to life in state prison.

10/17/23 Tuesday, Trial Day 14, Verdict: Jurors reached their decision after deliberating for two-and-a-half days. The jury reached a guilty verdict for all the defendants in the case on Tuesday. Siraj Wahhaj was found guilty of all his charges. His two sisters, Hujrah & Subhannah, were also found guilty of kidnapping. They were acquitted on charges of conspiracy to provide material support to terrorists & providing material support to terrorists. Lucas Morton was guilty of terrorism charges, conspiracy to commit kidnapping & kidnapping that resulted in the boy’s death. A sentencing date has yet to be scheduled.

All four defendants will remain in custody pending sentencing, which has not yet been scheduled. At sentencing, Siraj, Hujrah & Subhanah Wahhaj, and Lucas Morton each face up to life in prison. Per the terms of her plea agreement, Leveille faces up to 17 years in prison.

*Maryam Jany Leveille (35/now 40) (wife of Siraj) plead guilty to a federal firearms charge & a conspiracy charge & faces up to 15 years in prison. She admitted acting with her four co-defendants to transport firearms from Georgia to New Mexico “for use in establishing a firearms & military tactics training range,” according to the plea agreement. Under the agreement, prosecutors agreed to drop the remaining charges against Leveille following sentencing, which has not been scheduled.

*Bench Trial continues (Day 49)-JUDGE’S VERDICT! (@ 9:30am ET) – NY - New York vs. Donald J. Trump (76/now 77), Donald Trump, Jr. (45) & Eric Trump (38/now 39) & the Trump Organization, Inc. (Allen Weisselberg (75/now 76) & Jeffrey McConney) are being sued by Letitia James, the New York Attorney General, who is leading a civil investigation (which cannot result in criminal charges filed on 9/21/22) & has spent years looking at whether the company committed various acts of fraud over several decades. James also requested the court ban the former president & his business from acquiring real estate in New York or from applying for loans from any New York financial institution for five years. James's civil case accuses Trump of lying from 2011 to 2021 about asset values at the Trump Organization, as well as his own net worth, in order to obtain better terms from lenders & insurers.

New York appellate court temporarily paused gag orders on Thursday, 11/16/23 & NY AG Letitia James & representatives for Judge Arthur Engoron have until Wednesday, 11/22/23 to file a response to the appellate judge's stay of the limited gag order imposed last month on Trump by Engoron, according to the appellate judge's order. Trump's reply is then due on 11/27/23 before the appellate court decides whether to fully lift the gag order. The civil fraud trial is expected to wrap up in mid-December.
Trump’s request for an expedited grant of leave to appeal the gag orders in his civil fraud trial was denied Monday (12/5/23) afternoon. Trump still has an avenue to appeal the decision to a higher court; however, the effort will take longer than his lawyers would like. Trump’s lawyers now face a deadline of Monday, Dec. 11 to file their papers to the First Department.
New York's highest court has upheld the limited gag order in Trump's civil fraud trial. "On the Court's own motion, appeal dismissed, without costs, upon the ground that no substantial constitutional question is directly involved. Motion for a stay dismissed as academic," New York's Court of Appeals said in a two-sentence ruling issued Tuesday, 1/16/24.

1/25/24 Thursday, Trial Day 48: Motions hearing. 1/25/24 Update: New York Attorney General Letitia James’s office wrote in a letter to the judge overseeing Trump’s civil fraud trial Tuesday that the affirmation of Shkreli’s lifetime ban should embolden the judge to seek the same penalty for Trump. James has asked the judge to force Trump to pay nearly $370 million as a penalty & to issue a lifetime ban on Trummp & two top executives from doing real estate business in New York. Her office also asked for a five-year ban on Trump’s adult sons, Donald Trump Jr. & Eric Trump. Trump’s legal team forcefully pushed back against the characterization, reiterating arguments made at trial that there are no victims of the fraud alleged by the attorney general. Engoron said he hopes to issue a decision in the case by 1/31/24, though it could come at any time.

1/26/24 Update: The Trump Organization has cooperated with its independent monitor but risks putting out inaccurate financial statements, according to a report issued on Friday by a court-appointed monitor. The report comes ahead of an expected ruling in a $370 million civil trial involving Trump's company. The report – issued at the request of Judge Arthur Engoron to summarize the 14 months of the Trump Organization's court-appointed monitorship – found that the company has been cooperative, implemented some changes & issued necessary corrections to financial statements. However, based on her review of over 3,000 documents, retired Judge Barbara Jones identified that the Trump Organization often provided documents "lacking in completeness & timeliness." Jones also said that the Trump Organization still lacks a formal compliance department, issued statements that include errors & misstatements & operates in a manner that reflects "a lack of effective governance." "it does not appear that there are adequate accounting & presentation standards, procedures, or training associated with the preparation of financial disclosures. To the extent adequate standards & procedures do exist, they do not appear to have been followed across the organization." A footnote tucked into a court letter suggests that Trump lied to the government for years about a mysterious $50 million loan [between Donald J. Trump, individually & Chicago Unit Acquisition for $48 million] that apparently never existed—a lie that tax experts said suggests potentially major tax evasion. If true, that would essentially be an admission from the Trump Organization that all the financial disclosures Trump has filed with the federal government listed an entirely fictional debt worth tens of millions of dollars, which Trump claimed he personally owed to one of his own companies. It’s unclear why the debt is listed in the “more than $50 million” category on those statements when, according to the Jones letter, it was really $48 million, which would have fallen in the “$25 million-$50 million” range. But another unusual thing happened last year: Trump paid his taxes. A lot of them—$29 million, in fact, according to a previous status letter from Barbara Jones. If Trump were hit with the 39% capital gains tax on that $48 million, that would come out to a little more than $18 million.

1/17/24 Update (1088) Notice of Sentencing hearings as to Subhanah Wahhaj, Hujrah Wahhaj, Lucas Morton, Siraj Ibn Wahhaj & Jany Leveille on 3/6/24 in Albuquerque Cimarron Courtroom before Chief District Judge William P. Johnson: Subhanah Wahhaj is set for Sentencing at 9am. Hujrah Wahhaj is set for Sentencing at 9:30am. Lucas Morton is set for Sentencing at 10am. Siraj Ibn Wahhaj is set for Sentencing at 11am. Jany Leveille is set for Sentencing at 1:30pm. If the 4 defendants set in the morning need additional time, the Court will carry over into the afternoon & commence Ms. Leveille's sentencing upon the conclusion of the other defendants' sentencings. If Ms. Leveille's sentencing can not be concluded on 3/6/24, sentencing will be continued on 3/7/24.
*Maryam Jany Leveille (35/now 40) (wife of Siraj) plead guilty to a federal firearms charge & a conspiracy charge & faces up to 15 years in prison. She admitted acting with her four co-defendants to transport firearms from Georgia to New Mexico “for use in establishing a firearms & military tactics training range,” according to the plea agreement. Under the agreement, prosecutors agreed to drop the remaining charges against Leveille following sentencing, which has not been scheduled. Sentencing was continued from 3/6/24.
