10/26/23 Thursday, Trial was cancelled. 11/1/23 Update: Johnston’s trial, set to begin in mid-October, was delayed after her defense attorney Jeremy Scheider filed some additional evidence: written notes from an Upper West Side neuropsychologist, according to court documents & a recent hearing. Those notes must be reviewed by prosecutors from the Manhattan DA’s office & a new trial date is expected to be set at a hearing 11/9/23. The delay appears to be tied to Schneider’s pursuit of a “psychiatric defense” for Johnston. In conversations with WSR, attorney Schneider has described Johnston as having an “extensive mental health history, going back probably 20 years.”

These defamation charges were postponed by Judge Lewis Kaplan on 3/30/23. Carroll's first defamation lawsuit against Trump was filed in November 2019. But that case has been put on hold while Trump argues that a federal law protects him from being sued for defamation for comments he made while president. And was amended to Trump’s comments made on 5/10/23.

1/19/24 Friday, Trial Day 4: Trump’s legal team requested a mistrial in Carroll’s defamation case against him because she “actively deleted evidence”—despite the judge denying Trump’s mistrial request for the same reason earlier this week (Wednesday). In a Friday letter to US District Judge Lewis Kaplan, Trump's attorney Alina Habba asked for a mistrial because of what she described as Carroll's failure to preserve evidence relevant to the case. "Plaintiff admitted that she deleted multiple email messages pertaining to purported death threats made to her," Habba wrote. If Kaplan decided not to cancel the rest of the trial — which is expected to conclude by the middle of next week — he should at least tell the jury not to award her any damages related to the death threats or tell the jury that she did something wrong, Habba said. From the letter: For the reasons set forth above, President Trump respectfully requests that: (i) a mistrial be declared; (ii) Plaintiff be precluded from seeking damages relating to death threats purportedly made to her & all testimony related to same be stricken from the record; or (iii) the Court include an adverse inference charge against Plaintiff relating to her willful violation of her discovery obligations & the spoliation of relevant evidence. both sides filed written arguments at the judge’s request on whether Trump’s lawyers can argue to the jury that Carroll had a duty to mitigate any harm caused by Trump’s public statements.

1/18/24 Thursday, Trial Day 6: Brief arguments from Schoenhorn & Supervisory Assistant Stat's Attorney Michelle Manning about testimony expected from a state police blood pattern analysis expert. Prior to testimony resuming Friday, the judge said he had been given an unsigned note by a marshal indicating a possible jury issue. "One of the jurors discussed something about the case & it was all over social media," Randolph quoted the note as saying. "Said it was like 'Gone Girl.' A brief mention, several other jurors said 'Don’t discuss this.'" The judge then broke to speak with the prosecutors & Troconis' lawyers in his chambers. The judge re-reading the note into the record, saying that though it was unsigned, it had been authored by one of the jurors & identified another juror by name. Randolph said he intended to question the juror who wrote the note, allowing the lawyers to ask questions through him about it. The judge said he then would talk to the juror who was identified in the note concerning communications they had with other jurors. The questioning of the juror would take place on the record, the judge said, but without audio or video being broadcast & closed the courtroom just after 11am. After closing the courtroom for about 45 minutes to question jurors, Judge Kevin Randolph said he dismissed one juror who had reportedly made a reference to "Gone Girl," a 2012 novel subsequently made into a film about a woman in a troubled marriage faking her own death. After dismissing the juror, the judge said he then asked each other juror whether they could continue to be objective. "Without exception, every juror indicated that they would be able to afford the state & the defense a fair & impartial trial," Randolph said. There are now a total of nine jurors & alternates, after an alternate juror was dismissed on Wednesday.

James's civil case accuses Trump of lying from 2011 to 2021 about asset values at the Trump Organization, as well as his own net worth, in order to obtain better terms from lenders & insurers.

New York appellate court temporarily paused gag orders on Thursday, 11/16/23 & NY AG Letitia James & representatives for Judge Arthur Engoron have until Wednesday, 11/22/23 to file a response to the appellate judge's stay of the limited gag order imposed last month on Trump by Engoron, according to the appellate judge's order. Trump's reply is then due on 11/27/23 before the appellate court decides whether to fully lift the gag order. The civil fraud trial is expected to wrap up in mid-December.
Trump’s request for an expedited grant of leave to appeal the gag orders in his civil fraud trial was denied Monday (12/5/23) afternoon. Trump still has an avenue to appeal the decision to a higher court; however, the effort will take longer than his lawyers would like. Trump’s lawyers now face a deadline of Monday, Dec. 11 to file their papers to the First Department.

1/11/24 Update: Police on Long Island responded Thursday morning to a bomb threat at the home of Judge Arthur Engoron, who is presiding over Trump’s civil fraud case, a source with direct knowledge of the situation told NBC News. The threat came hours before closing arguments in the trial were scheduled to begin, with those arguments expected to proceed. A Nassau County bomb squad was called to Engoron’s home & was investigating Thursday morning; it is unclear whether Engoron was home at the time.

Attorney Kise asks for permission to have Trump speak. Engoron, "Do you promise to comment on the facts & the law?" Trump starts talking immediately without agreeing. Trump has started addressing the court in the closing arguments of his civil fraud trial. Saying it was a political witch hunt, blah blah blah. Judge cut him off after 5 minutes.
Judge Engoron concluded the day by estimating that he would issue an opinion in the case by 1/31/24. He then ended the proceedings.
