7/27/21 Update: Bentaas scheduled for a change of plea hearing at 9am on 10/8/21. Her last court date was supposed to be a jury trial starting on April 12 that was canceled & not rescheduled. Bentaas will now be plead guilty. It is unknown which of the three "not guilty" pleas Bentaas plans to change during her next hearing. Charged with first- & second-degree murder & first-degree manslaughter. A sentencing hearing is also scheduled for Bentaas after her change of plea hearing. The sentencing hearing is set for 9am on 12/2/21. Both hearings will be presided over by Judge Bradley Zell.
10/8/21 Update: Bentaas plead guilty to 1st degree manslaughter under what is known as an Alford plea which allows her to maintain her innocence while authorizing the court to enter a guilty plea. In exchange, the State dropped 1st & 2nd degree murder charges. Bentaas will be sentenced on 12/2/21. She faces the possibility of life in prison.

GUILTY - SD - Sioux Falls, WhtMale, UP17189, Newborn, born alive, Feb'81 *ARREST in 2019* - Baby Andrew

12/2/21 Update: The prosecution is recommending Bentaas serve 40 years in prison with the chance of parole in 10 years in connection with the death of her child. During the first portion of the sentencing, the state called two witnesses: Lee Letz, who found the body & Detective Michael Webb, who was responsible for solving the cold case. Judge Bradley Zell called a lunch recess shortly after 11am & will administer the sentence afterward. The defense called their four witnesses after a brief recess. A psychologist did a forensic psychiatric evaluation on Bentaas in February 2020, where she diagnosed Bentaas as having experienced "Complete Pregnancy Denial." "She never named him but accepted the name the church gave him," aid Dr. Cara Angelotta of Northwestern University. Bentaas's sister Michelle Fischer was next to the stand followed by Bentaas's daughter Melissa Feilmeier & son Justin Bentaas. Before the judge called the final recess Raleigh Hansman, of the defense, addressed the court & said the death of Andrew happened to Bentaas & not because of her. Hansman described Bentaas' Alford plea as a compromise & said her client never admitted to killing her child. The court is in recess until noon when Zell will sentence Bentaas. The state is requesting 40 years while the defense said time served is enough punishment. Bentaas entered an "Alford" plea on count three of first-degree manslaughter on Oct. 8, 2021, which in South Dakota is treated as a "guilty" plea. Two murder charges she faced were dropped.
Judge Zell: Under the proven facts of this case, Theresa may be guilty of manslaughter in the second degree for failure to provide medical attention. But that is even a stretch under these facts. Legally Theresa is guilty & is to be treated as guilty in manslaughter of the first degree. At the time, Theresa was 19 & little to no criminal activity. Since that time, she has had no criminal activity. There is nothing regarding Theresa to rehabilitate this matter. As for deterrence, this court has seen time & time again that heavy sentences & death penalties has not stopped major crimes. Judge Zell sentences Bentaas to South Dakota women's prison for 10 years with nine years suspended with credit for time served. No fine. Judge Zell: Is this sentence what your family wanted? No. Is it what some in the community want? No. That's not my job. "I do hope that this brings closure but also inclusion to the whole family."

12/3/21 Charging Hearing: Judge & attorneys - Holmes' counsel have raised a few objections to the gov't's proposed jury instructions, which are mostly based on the 9th Circuit model instructions.
for more info see post #995 here:
CA - Elizabeth Holmes (Theranos) Wire Fraud
Judge Davila won't rule on the “willful” language, but he notes that the government proposed including the word "willful" in their jury instructions, which are modeled after the 9th Circuit. He also tells defense counsel that their proposed instructions "seem to be lengthy" & need editing.
Judge Davila asks the parties about scheduling. Holmes' counsel Kevin Downey says prosecutors told him they don't currently plan to call rebuttal witnesses & "evidence will likely conclude during next week." Judge Davila says the jury will get the case "certainly by the 20th." Prosecutor Robert Leach thinks they'll get it by at least the 17th. Trial continues on Monday, 12/7/21.

11/10/21 Update: On Wednesday, Peterson appeared via a live video feed from San Quentin while Stanislaus County District Attorney Birgit Fladager, defense attorney Pat Harris & Superior Court Judge Anne-Christine Massullo sparred over who will be allowed inside the courtroom when Peterson is re-sentenced to life in prison without possibility of parole. Judge Massullo said, “I have to follow the rules of this courtroom. That’s six feet of distance & masks. That leaves very few options for the court.” The judge said she plans to have 16 seats for Laci’s supporters, 6 seats for Peterson’s supporters & the remaining 15 seats for the public & media combined. A lottery system will be used to decide who sits in those 15 seats. In addition to preparing for the sentencing hearing, on Wednesday Judge Massullo set a date for an evidentiary hearing as part of Peterson’s battle for a whole new murder trial. The evidentiary hearing will begin on 1/25/22 & end on 3/4/22. There will be about 5 hours of testimony each day. Nice will be called to the witness stand as the primary witness. Legal experts said Nice pleading the fifth will help strengthen Peterson’s case. Media cameras will not be allowed in the courtroom for the evidentiary hearing, the judge said. Peterson’s next court date is set for 11/17/21 at 10am so that the judge can review Peterson’s probation report from San Quentin State Prison. He will likely be transferred to the San Mateo County Jail within the next couple weeks. The district attorney has made sure that Peterson will not be granted bail when he arrives as an inmate in Redwood City. Formal sentencing to life without the possibility of parole on 12/8/21.
11/17/21 Update: For new trial: Next evidentiary hearing will begin 1/25/22 & end on 3/4/22 about 5 hours each day for testimony. 11/29/21: Peterson has left death row in San Quentin & was moved to the San Mateo County Jail, officials confirm. He was transferred Monday morning ahead of his re-sentencing hearing next week on 12/8/21. Update!

Monday, December 6th:
*Trial was set to begin-MISTRIAL! (Blackburn murder) (@ 9am CT) - IN - Amanda Blackburn (28) (was 12 weeks pregnant shot to death, Nov. 10, 2015, Indianapolis) - *Larry Jo Taylor, Jr. (18/now 24) arrested & charged (11/23/15) & arraigned (11/25/15) with murder willful intent, murder in the course of a burglary, murder in the course of a robbery, murder enhancement, carrying a handgun without a license, criminal confinement, 2 counts burglary (11/10/15), 2 counts of theft (11/10/15), 3 counts of rape (11/3/15), robbery resulting in serious bodily injury (11/3/15), public indecency & public nudity. Plead not guilty. Held without bond.
Watson & Gordon confessed that Taylor was the shooter. In the Nov. 3, 2015 case, tests found that Taylor's DNA matched samples found on the victim & her clothing.
Trial was set to begin on 12/6/21 for murder only, but was declared a mistrial by Judge Grant Hawkins when a juror found out that Amanda was pregnant.

12/1/21: Pretrial hearing on 12/6/21 @ 9:30am for other charges besides murder. 12/3/21: State's final witness list filed. 12/6/21: Motion to amend information filed (amend information interlineation, motion). Tracking with jury trial. Next pretrial conference hearing on 12/9/21 @ 9:30am.
12/6/21 Monday, Trial Day 1: Jury selection began. Was seated with 12 jurors & 3 alternates. BUT! Judge Grant Hawkins declared a mistrial. Taylor is one of three men originally charged & the only one who was not given a plea deal. Taylor is not facing charges for the death of the unborn baby, which is why the judge declared a mistrial when jurors found out about the pregnancy. “This just being a mistrial indicates nobody did anything wrong, it was just a set of facts that came up & they determined that they could no longer go to the jury & get a fair outcome,” John Tompkins, a criminal defense attorney said. The other defendants in the case, Jalen Watson & Diano Gordon, accepted a plea deal & agreed to help prosecutors with the case against Taylor. Officials tell us we should learn more information later this week about when jury selection begins again. One juror asked Judge Grant Hawkins why this case is taking so long. Judge Hawkins cited COVID, whittling down 100 witnesses to 33 & a series of attorneys over the years. Order granting motion to amend information. Parties will meet with Judge on Wednesday, 12/8/21 @ 1pm.

*Rolando Gonzalez-Hernandez (26) (shot to death, Nov. 4, 2015, Indianapolis) - Larry Jo Taylor, Jr. (18/now 24) charged (12/29/15) with murder, felony murder & robbery resulting in serious bodily injury.

Judge Davila asks the attorneys about the length of closings. Defense counsel says they think their closings will be split between end of day Thursday & Friday morning.
Defense counsel doesn’t want to ask the jury to deliberate the week of Dec 27, because it could impact the verdict. Prosecutors say let’s wait to hear what their preference is. Sounds like they’ll be deliberating on Christmas Eve unless they reach a quick verdict. Closing arguments begin on 12/16/21 for Day 38.

State says Isaak acted with premeditation, one of the reasons why the state is asking for life in prison without parole. And shown no remorse. Defense asks that Isaak should be sentenced to life with the possibility of parole & that the sentences be served concurrently. Isaak finally spoke. "I can honestly tell you that I am not a murderer & that is all I have to say". Judge stated Isaak showed no remorse & granted what the prosecutor requested. On the first 4 counts of murder in the first degree he was sentenced to LWOP, each to run consecutively, not concurrently as Isaak's attorney requested. The remaining 3 charges, 10 yrs, 5 yrs & 1 year to be served concurrently to the murder sentences. Credit for 1000 days served.
