Phillips (58) & Calvin Lee Phillips (53) (Nov. 19, 2015, Pembroke) - *Christian “Kit” Richard Martin (51/now 53) arrested & charged (5/11/19), indicted (5/10/19) & arraigned (5/22/19) with 3 counts of 1st degree murder, 1 count of arson, 1 count of attempted arson, 2 counts of 2nd degree burglary & 3 counts of tampering with evidence. Plead not guilty. Held without bond, changed (10/16/19) to $3M bond.
May, 2016 was convicted of 2 counts of mishandling classified materials & 2 count of assault on a child; sentenced to 6 months in jail & discharged from the military.
Trial began on 6/2/21 with jury selection & concluded the same day. Trial started on 6/3/21 (Day 1) & ended 6/16/21 (Day 9) & was held in Hardin County moved from Christian County due to pretrial publicity. Jurors: 10 men & 4 women (2 are alternates). Juror is excused (6/7/21) for medical reasons. 1 alternate left. For deliberations: 8 men & 4 women.

The same jury that found him guilty will decide his sentence, the charges carry a max of life without parole on each murder count. Openings by Commonwealth DA Barbara Whaley & Defense attorney Olivia Adams. Victim impact statements: Probation person with sentencing report. John Phillips, Calvin’s father. Matt Phillips, son of the Phillips' & Ed Dansereau's daughter Erin Hilton. Defense had no witnesses. Closings by both sides. 8/26/21 Update: During the hearing Thursday, Martin’s defense attorney Douglas Moore presented arguments that prosecutors misled the jury & committed “prosecutorial misconduct” with misstatements regarding cell phone evidence & the results of DNA testing of hair. Assistant Attorney General Alex Garcia said all the grounds asserted by the defendant during the hearing were all thoroughly litigated during the trial. After hearing both sides, Chief Circuit Judge John Atkins, who presided over the trial, denied both motions for a new trial & prosecutorial misconduct.

Hauschultz (14 @ time of crime/16/now 17) charged (2/4/19) & arraigned (3/19/19) with 1st degree reckless homicide, 3 counts of abuse of a child intentionally causing bodily harm & 3 counts (felony) of substantial battery. $150K cash bond. Bond reduced (1/30/20) to $100K cash. Posted bond (4/13/20) & released from custody.

5/10/21 Update: Damian has agreed to a plea deal & will plead guilty to a felony homicide charge, the most serious of seven charges against him & the plea agreement includes a recommendation that he be sentenced Friday to 12 to 17 years in prison & the other charges will be dismissed. But Judge Jerilyn Dietz is not bound by that, and may sentence the teen to up to 40 years in prison & 20 of probation. Plea hearing on 6/25/21 & sentencing on 9/2/21.
6/25/21 Update: Damian plead guilty to 1st degree reckless homicide & will be sentenced on 9/2/21.
*Timothy Scott Hauschultz (48/now 50) (great uncle) – Motions hearing on 10/7/21. Pretrial conference hearing on 11/8/21 & trial set to begin on 12/6/21.
*Tina Marie McKeever-Hauschultz (35/now 38) (great aunt) – 3/12/21: plead no contest to 2 counts of child abuse-failing to prevent bodily harm & the 2 counts intentionally contributing to the delinquency of a child were dismissed. Sentenced to 5 years in prison & 5 years extended supervision.
Hauschultzes were court appointed guardians for Ethan & his 2 siblings in 2016.
Friday, Sept. 3rd:
*Sentencing Hearing for both (@ 9am ET) – MI – Emma Rose Bingaman (2) (July 30, 2018, Mt. Morris Township; died from torture & abuse, weighed less than 10 lbs.) – *Destiny Danielle Bingaman (23/now 26) arrested (7/30/18), charged & arraigned (8/2/18) with 1st degree felony murder, 1st degree child abuse, torture & 2 counts of 1st degree child abuse committed in front of another child. Plead not guilty. Held without bail.
*George Bingaman (32/now 35) arrested (7/30/18), charged & arraigned (8/2/18) with 1st degree felony murder, 1st degree child abuse, torture & 2 counts of 1st degree child abuse committed in front of another child. Plead not guilty. Held without bail.
4 yr old girl & 1 yr old boy removed & placed in temporary foster care.
Jury trial was set to begin on 1/20/21-cancelled.
