*Brett Aaron Boettler - 5/1/19: Boettler withdrew his not guilty plea, and instead plead guilty to the charges. A judge sentenced (technically) received a life sentence, but the district attorney’s office said that he will end up serving 30 years in prison & 15 years on probation.
*Kevin Don Garcia-Boettler - 5/1/19: Garcia-Boettler withdrew his not guilty plea, and instead plead guilty to the charges. A judge sentenced to 25 years.


*Trial continues with Jury Selection Voir Dire (Day 7) (@ 8am MT) - CO - Dylan Nicholas Redwine (13) (Nov. 19, 2012, Broomfield; found about 8 miles up Middle Mountain Road, a dirt road that cuts through the San Juan National Forest, about 100 yards from the road, directly off an ATV trail on June 27, 2013 & Nov. 1, 2015 his skull was found) - *Mark Allen Redwine (55/now 58), "father" indicted (6-20-17) of 2nd degree murder & child abuse resulting in death. 11/3/20 Jury Selection Day 4 Tuesday: No public/no cameras. Jury voir dire. Continues on 11/4/20.
11/4/20 Jury Selection Day 5 Wednesday: no public/no cameras. Brief hearing in morning regarding subpoenas. Audio will resume in the afternoon of 11/5/20 at the conclusion of individual voir dire.
11/5/20 Jury Selection Day 6 Thursday: Trial has been temporarily suspended after District Judge Jeffrey WIlson overseeing the case said he woke up Thursday morning with mild COVID-19 symptoms & is now awaiting test results before being able to resume court proceedings. Wilson said he was tested via nasal swab Thursday morning, the results of which should be available Saturday. He also took a blood test, which came back Thursday afternoon showing a negative result. According to procedures put in place to hold the trial during the pandemic, Wilson said court proceedings will be suspended until the nasal swab test comes back. If both tests come back negative, the trial will resume as planned, though opening statements, which were scheduled for Monday, will have to be pushed back a few days to complete jury selection. If the nasal swab test comes back positive, Wilson said he will declare a mistrial, effectively canceling the trial. Jury selection continues on Monday, 11/9/20.
11/6/20 Friday: The Court has received negative test results for COVID for the Judge. Court orders that for the 39 jurors who have participated in individual voir dire & have not been excused for cause, the Court will complete voir dire process on Monday, 11/9/20. Vori dire shall be conducted according to the following schedule: 8:30am: 19 members of the venire in the courtroom with 14 in the training room; 8:45am: State attorney voir dire, 45 minutes each side; 10:15am: Excuse the 19 jurors from the courtroom, conduct challenges for cause, then clean the courtroom; 10:30am: Attorney voir dire of the 14 jurors from the training room, 20 minutes each side; 10:45am: Excuse the 14 jurors from the courtroom, then conduct challenges for cause. (@ 9am PT) – WA – Jody Loomis (20) (Aug. 23, 1972, Mill Creek) - *Terrence Miller (30 @ time of crime/77/now 78) arrested (4/10/19), charged (4/12/19) & arraigned (4/15/19) with 1st degree premeditated murder. Plead not guilty. $1M bond reduced (5/31/19) to $750K, back (7/17/19) to $1M. Out on bond.

With that, the defense rested without calling any witnesses. Rebuttal by deputy prosecutor Bob Langbehn. Jury started deliberations. Jurors deliberated for about four hours Friday. Superior Court Judge David Kurtz sent them home for the weekend, and instructed them to resume their discussions Monday, 11/9/20.

Charges for the 10/13/06 assault on 2 women in North Natomas (Sacramento County). The new charges (1/7/19) include 9 counts encompassing a brutal attack against a Martinez woman in 1996. *Sentencing Hearing (@ 9am ET) – FL – Nubia Barahona (10) (missing Feb. 11, 2011, W. Palm Beach, found Feb. 14, 2011 soaked with chemicals in the back of her father’s truck along side Interstate 95 in Palm Beach County), (Victor (10) injured; had acid thrown on him; he was released from hospital 3/2/11) – only for *Carmen V. Barahona (60/now 70) (adopted mom) arrested (2/12/11), charged (3/7/11) & indicted & arraigned (3/24/11) with 1st degree murder & 14 counts of aggravated child neglect/abuse. Plead not guilty. $1M bond.
2/21/20: Plead guilty to 1st degree murder & aggravated child abuse. Plea deal gives her a life prison sentence in exchange for testimony against her husband. Sentencing has been deferred until she testifies against her husband as agreed. If she fails in this agreement, she will be facing a sentencing hearing before a jury. Sentencing set for 8/3/20 @ 9am. 8/3/20 Update: Sentencing has been rescheduled for 10/8/20.

Friday, Nov. 13th:
*Sentencing Hearing (@ 8:45am CT) – in MI/TX – Michael Lee Swearingin (32) & Jenna Kay Scott (28) (Jan. 4, 2019, Temple; found in Clearview, OK 1/9/19) – for *Ginell Marie McDonough (Army Staff Sgt.) (37/now 38) (Mark’s wife) arrested (1/11/19) & charged (2/19/19) for harboring a fugitive & charged with obstruction of justice. $75K bond reduced to $10K, released on bond with GPS monitor.
Maxwell also was hiding out in McDonough’s Michigan home, according to law enforcement officials. McDonough hasn’t been charged yet with a crime in Texas, and she was released from the Michigan jail after her bond was decreased from $75K to $10K.
Trial was set to begin on 2/11/20, but plead guilty.
1/30/20 Update: MCDonough plead guilty Jan. 31 to a felony count of harboring a felon & her sentencing is set for Nov. 13. She faces up to 9 months in prison. According to her attorney, Michael Oaks, her defense team is seeking probation as punishment for her part in covering up the murders of two innocent people. Muskegon County Circuit Judge Annette Smedley has agreed to a sentence of time served and probation, court records show.

*Sentencing Hearing (@ 1:30pm PT) – CA – Elizabeth Sullivan (31) (reported missing Oct. 14, 2014, San Diego; found Oct. 6, 2016 in San Diego Bay) – *Matthew Scott Sullivan (29 @ time of crime/33/now 35) “husband” arrested (1/31/18 in Wyoming, Delaware, extradited 2/9/18), charged & arraigned (3/4/19) with 1st degree murder. Plead not guilty. $2M bond. Judge changes (3/13/20) to no bond.
Trial began on 2/18/20 with jury selection, trial started on 2/21/20 and ended on 3/11/20. Jury: 7 men/5 women & 4 alternates. Jurors’ took about 8 ½ hours (3 days) to reach a verdict of guilty of 2nd degree murder, plus allegations of using a knife in the killing.

GUILTY - CA - Elizabeth Sullivan, 31, San Diego, 13 Oct 2014 *Arrest*

3/13/20 Friday Day 14: Just over a day of deliberations, the jury panel acquitted Sullivan of a first-degree murder charge, but convicted him of second-degree murder, plus an allegation of using a knife in the killing. Sentencing is scheduled for April 13. 4/13/20 Update: Next hearing on 5/28. Not sure if this is a sentencing hearing or just a hearing. Sentencing continued to 6/18/20.
6/18/20 Update: Don’t believe sentencing happened. Court site has Motions hearing on 9/18/20 at 9:30am & sentencing at 1:30pm.
9/18/20 Update: Defense attorney Marcus DeBose presented a lengthy motion before San Diego Superior Court Albert Harutunian III on numerous grounds for a new trial, including a request to interview jurors about their verdict. Harutunian ruled that DeBose had not shown a basis to unseal confidential juror information. San Diego Superior Court Judge Albert Harutunian III denied Sullivan motion for new trial. Sentencing has been rescheduled to 11/13/20.

11/9/20 Monday Day 7: Monday session had to be conducted by phone because the court's in-house WebEx system failed today. Also on Monday, Redwine’s public defenders–Justin Bogan & John Moran–said members of their team also have COVID-like symptoms. Bogan said his office is awaiting test results for his staff, though one member did test negative. Bogan asked Judge Wilson to declare a mistrial, even though the defense attorneys are still awaiting test results to see whether they have contracted the coronavirus. DA Champagne added he is concerned Redwine’s public defenders are “intentionally” trying to delay the trial by claiming they had COVID-19 symptoms. In the lead up to the trial, Redwine’s public defenders tried multiple times to delay the trial citing COVID-19 concerns, all denied by Judge Wilson. Judge declares mistrial for Redwine. Case to be postponed for 6th time in two years. Next Status conference hearing on 11/13/20 @ 11am.

Thursday, November 5th:
*Sentencing Hearing (@ am CT) – IN – Curtis Gilbert Collman III (8) (June 21, 2018, Seymour, Jackson County; dies of meth overdose (18,000 nanograms, 180 times the lethal does, thought it was cereal) – *Curtis Gilbert Collman II (41/now 43) “father” arrested (6/21/18), charged (6/26/18) & arraigned (6/29/18) with neglect of a dependent causing death, pointing a firearm, possession of meth, intimidation & theft. Also charged with failure to maintain his sex offender registration status. Stems from a 2006 conviction of a Class D felony of sexual misconduct with a minor. $51,510 cash only bail.
Refused to call 911 & threatened others who tried to call. Faces 20-40 years in prison.
Trial began on 10/5/20 & ended 10/8/20 with a guilty verdict on all charges.

10/8/20 Day 4 of Trial: Closing arguments. Jury received case. The seven-man, five-woman panel returned with that verdict after deliberations of less than two hours & returned a verdict of guilty Thursday of neglect of a dependent causing death. The jury also found Collman guilty on 4 additional counts: intimidation with a deadly weapon, a Level 5 felony, possession of methamphetamine between 10 and 28 grams, a Level 4 felony; and Class A misdemeanor charges of theft and pointing a firearm at another person. After the jury returned with the verdict, they were also asked to determine if Collman was guilty of being a habitual offender since he had prior convictions for sexual misconduct with a minor in August 2009 & dealing in cocaine or narcotic drugs in February 2011. They returned with a guilty verdict on that offense, which means Collman could get a sentence of up to 60 years. Collman’s sentencing hearing is set for 9am on Nov. 5.

11/6/20 Trial Day 10 Friday: Closing arguments by Deputy prosecutor Craig Matheson & defense attorney Laura Martin. An attorney read a brief agreed-upon statement detailing how a detective had searched Miller’s electronics but found nothing relevant to the case. With that, the defense rested without calling any witnesses. Rebuttal by deputy prosecutor Bob Langbehn. Jury started deliberations. Jurors deliberated for about four hours Friday. Superior Court Judge David Kurtz sent them home for the weekend, and instructed them to resume their discussions Monday, 11/9/20.
11/9/20 Trial Day 11 Monday: Jurors reconvened Monday morning, and shortly afterward informed the court that they had reached a verdict. The judge & legal teams from both sides were informed, and directed to be in court at 1pm to hear the jury’s decision. Miller died of an apparent suicide early Monday morning, just before 10am in his Edmonds home, just hours before the jury pronounced him guilty in the 1972 cold-case murder of then 20-year-old Jody. As soon as the jury was seated, Judge David Kurtz informed them that Miller had died, but despite this the court would proceed with reading the verdict. The jury foreman then passed Kurtz the slip of paper with the verdict: guilty as charged of first-degree murder.

The plea deal came with multiple stipulations, including that the teen must remain in mental health counseling for the duration of his detainment and probation, that he cannot have unsupervised contact with anyone under the age of 18 outside of fellow detainees, and he must pay $500 in restitution to the Crime Victims Compensation Fund.

1/30/20 Update: MCDonough plead guilty Jan. 31 to a felony count of harboring a felon & her sentencing is set for Nov. 13. She faces up to 9 months in prison. 11/20/20 Friday Day 4 of Trial: State witness: Dr. Stephen Boudreau, an expert in forensic pathology, conducted the autopsy on Kat West. He said a significant amount of force must have been used to cause Kat’s head injuries. He said it’s pretty unlikely a fall could have caused this injury. Said because of the nature of Kat’s injury, if the injury did not occur in the area where her body was found, there would have been a blood trail. There was no blood trail. The state rested their case. The judge & Jeff West’s attorney John Robbins said we can expect to see Jeff take the stand & testify. Defense witness: Nancy Martin (Kat's mother). The state did not be cross examining Kat’s mother. West changed his mind in testifying, saying instead he will exercise his right to remain silent. The court allowed West to confer with his & Kat’s family members about taking the stand. His attorney has also advised him on the repercussions testifying can carry. Defense rests. Closing arguments (were after lunch). The state & the defense have given their closing arguments. The defense took 3x as long to make their case. The prosecution will now give their final rebuttal before it’s left to the jury to decide. The defense objected to a charge of reckless manslaughter. Judge ruled he will not allow the jury to consider criminally negligent homicide. The jury is expected to begin their deliberations about 5pm. The jury is now deliberating. They will decide to charge Jeff West with murder, reckless manslaughter, or find him not guilty. After nearly two hours (another tweet says after 1 hour) of deliberation, jurors have three questions for the judge. Question 2: jurors asked when the time of death of Kat was called. The judge said he cannot comment on evidence, and that the jury will have to sort this out themselves. Questions 3: jurors requested better body cam video of a police officer talking with Jeff. The judge said better video cannot be provided, but they can help jurors in playing the video. 7pm: Jurors are back to deliberating on convicting West. 10pm: The jury has decided, there is a verdict. Verdict: West is found guilty of reckless manslaughter in the murder of Kat. West will be held in jail for 60 days, until the sentencing hearing. Reckless manslaughter is the lesser charge. It is a Class B felony punishable by 2 to 20 years in prison. The judge accepted the verdict & the jurors are released. Sentencing hearing is scheduled for 1/11/21 at 1:30m, the earliest available date. West’s bond was revoked. He will stay in jail until sentencing.

The plea deal came with multiple stipulations, including that the teen must remain in mental health counseling for the duration of his detainment and probation, that he cannot have unsupervised contact with anyone under the age of 18 outside of fellow detainees, and he must pay $500 in restitution to the Crime Victims Compensation Fund.

However, the Lewis County Prosecutor’s Office learned Salazar potentially had new information regarding charges of witness tampering filed against another suspect, Jerald Thompson, originally scheduled to go to trial next week. Meyer said he couldn’t disclose the new information, but said Salazar could now be a witness in Thompson’s trial. In that event, prosecutors hope to sort out a plea agreement with Salazar before Thompson’s trial begins. 3/4/20 Update: Hughes agreed to plead guilty to the count of child 🤬🤬🤬🤬🤬🤬🤬🤬🤬🤬🤬. According to a plea agreement filed in the case, Hughes & the government have agreed to a sentence of 96 months (8 years) with a minimum term of five years of supervision after his release. As part of the agreement reached on Wednesday, Hughes must plead guilty to the Rutland County charges before his sentencing in federal court which is scheduled for July 2. Hughes had been expected to change his plea on March 9 but the local agreement is still being worked out. Any sentence from the state is expected to be served at the same time as the federal prison sentence. Plea entered: guilty as to Count 3 of the Indictment. Because Marquez was 16 at the time of the crime, he can petition for release after 20 years. Review hearing on 3/28. Judge will wait to sentence Marquez until after he appears as a witness in the trial of his older brother, Jonathan Adamson.

11/23/20 Update: Sentenced to a total of 360 months, or more than 26 years & will be eligible for parole after 20. They're waiting talk of an appeal. He referred to Ben as his best friend in his own statement. His attorney insinuated that Adamson's & Marquez's 16 year sister told them that Ben had sexually assaulted her. Neither is allowed within 500 feet of Ben's dad for the rest of their lives. Marquez was allowed to withdraw guilty pleas to additional charges, leading to his convictions on only first-degree murder & first-degree assault due to his assistance.

*Sentencing Hearing (both cases) (@ 1pm PT) – WA – Benjamin Everett Eastman III (16) (June 23, 2018, Randle; found June 28, 2018) – for *Jonathon Robert Adamson (21/now 23) arrested (6/30/18), charged (7/2/18) & arraigned (7/11/18 & 3/7/19) with a total of 10 counts- 1st degree aggravated murder, 1st degree aggravated assault, 1st degree kidnapping, 1st degree rape, 1st degree rendering criminal assistance, unlawful disposal of remains, 2 counts of tampering with physical evidence & 2 counts of tampering with a witness. Plead not guilty to all charges. $10M bond.
Trial was set to start 8/5/19, plead guilty instead. Adamson’s plea agreement included an agreed-upon sentence of 510 months, or 42 & ½ years to life in prison, provided he meet requirements set by the Lewis County Prosecutor’s Office, including providing a full & accurate account of Eastman’s death.

*Charged with 2 counts of custodial assault based on allegations (he assaulted two corrections officers after they had confronted him about violating a jail policy).

Thursday, Nov. 19th:
*Sentencing Hearing (@ 9am CT) – in MI/TX – Michael Lee Swearingin (32) & Jenna Kay Scott (28) (Jan. 4, 2019, Temple; found in Clearview, OK 1/9/19) – for *Ginell Marie McDonough (Army Staff Sgt.) (37/now 38) (Mark’s wife) arrested (1/11/19) & charged (2/19/19) for harboring a fugitive & charged with obstruction of justice. $75K bond reduced to $10K, released on bond with GPS monitor.
Maxwell also was hiding out in McDonough’s Michigan home, according to law enforcement officials. McDonough hasn’t been charged yet with a crime in Texas, and she was released from the Michigan jail after her bond was decreased from $75K to $10K.
Trial was set to begin on 2/11/20, but plead guilty.

1/30/20 Update: McDonough plead guilty Jan. 31 to a felony count of harboring a felon & her sentencing is set for Nov. 13. She faces up to 9 months in prison. According to her attorney, Michael Oaks, her defense team is seeking probation as punishment for her part in covering up the murders of two innocent people. Muskegon County Circuit Judge Annette Smedley has agreed to a sentence of time served and probation, court records show.
11/13/20 Update: Sentencing was rescheduled to 11/19/20.
11/19/20 Update: Muskegon County authorities have dropped the case against McDonough who had pleaded guilty in February to a felony count of harboring a felon. The case was dismissed Friday. Muskegon County Chief Assistant Prosecutor Tim Maat said McDonough has been cooperating with authorities & agreed to testify against her husband Cedric Marks.

Wednesday, Nov. 25th:
*Appeal Hearing (@ pm ET) – FL – Jerry Michael “Mike” Williams (31) (Dec. 16, 2000, Tallahassee; found Dec. 9, 2017) – *Denise Merrell Williams Winchester (29 @ time of crime/49/now 50) arrested & charged (5/7/18) with 1st degree murder, conspiracy to commit 1st degree murder & accessory after the fact. Plead not guilty. No bond (denied 6/19/18).
*Also was charged (8/10/18) with 3 counts of insurance fraud. Plead not guilty. Bond set at $50K for each count. State dropped fraud charges (1/22/20).
Her ex-husband Brian Winchester (45) was indicted (8/9/16) for kidnapping, domestic assault & armed burglary of Denise. Plead no contest (10/16/17) to plea agreement where assault charges were dropped. Sentenced 20 years in prison. They were married in Dec. 2005 & separated in 2012, divorced in 2016. 6/1/18: Brian took a plea deal with immunity & confessed to killing “Mike”.
Williams was found guilty (12/14/18) on all counts. Sentenced (2/6/19) to life in prison without the possibility of parole. Judge also sentenced her to an additional 30 years for helping to plot the murder.

1/22/20 Update: Appeal hearing. The state announced it is dropping insurance fraud charges. In documents filed with the court Tuesday morning. Prosecutor Jon Fuchs said their main goal of ensuring Denise Williams did not profit from her husband’s death has been fulfilled. 5/23/20: No decision until June – courts are closed for COVID-19.
11/25/20 Update: On Wednesday, 11/25/20, The 1st District Court of Appeal in Tallahassee ruled that there wasn’t enough evidence presented to hold Williams’ murder conviction. “Because Denise did not do or say anything to ‘aid’ or ‘abet’ Brian in the murder of Mike, as those terms originally were understood to mean; and she did not ‘counsel,’ ‘hire,’ or ‘procure’ Mike’s murder beforehand (i.e., she did not get the ball rolling); we reverse her conviction (murder) as a principal to first-degree murder,” judges wrote. The judges denied Williams’ request to acquit her of conspiracy to commit murder charges. “Denise next contends the evidence cannot sustain her conviction for conspiracy to commit murder,” judges wrote. “Because the evidence shows that Denise & Brian had an agreement to kill Mike & that Denise intended for Brian to kill Mike, we disagree.” Although her life sentence for murder was reversed, Williams will serve 30 years behind bars for the conspiracy charge.
 
Marks’ attorneys told Judge Steve Duskie of the 426th Judicial District Court that the COVID-19 pandemic has interfered with their ability to investigate the case.

Bell County District Attorney Henry Garza argued the judge should deny the motion, saying the court did not have the authority to preclude the death penalty.

After hearing the attorneys debate the issue, Judge Duskie denied the motion.

The defense also asked the judge to issue a stay in setting a trial date during the COVID-19 pandemic would put everyone’s health at risk. Judge Duskie denied that motion, saying there is no plan to set a trial date for the next three to four months.
