A German citizen working in Ireland, where he has been accused of fraud. Released from prison (4/24/28). Charged (7/16/20) with 1 count of homicide & 1 count of alleged destruction of wife’s body while on cruise.
Trial began on 9/30/21.
Faces another year in prison, while pros investigate case; Judge will decide 1/26/18, postponed. Judge gave him 6 more months of detention. 4/24/18 was released from prison.

*Trial continues (Day 6) (@ am ET) - WV – Riley Grace Crossman (15) (reported missing May 8, 2019, Berkeley Springs; found May 16, 2019, near Tuscarora Pike in Berkeley County) - *Andrew (“Andy”) Jackson McCauley, Jr. (41/now 43) (mom’s BF) arrested & charged (5/16/19) & indicted (1/7/20) & re-indicted (6/17/21) with 1st degree murder, concealment of a deceased human body & felony charge of death of a child by a custodian by child abuse. Plead not guilty. Held without bond.
Trial was set to begin on 4/26/21. Jury selection began on 4/16 & jurors will be from Morgan County. Jury: 12 jurors & 2 alternates. These jurors will be let go & a new jury will be selected. First trial was cancelled due to COVID.
Trial began on 9/27/21. Jury selection started & finished on 9/17/21. Juror will come from Jefferson County & transported to the Morgan County courthouse. Trial expected to last 2 weeks. Jurors: 9 men & 7 women (i.e. 4 alternates).

Found Deceased - WV - Riley Crossman, 15, Martinsburg, Morgan County, 7 May 2019 *arrest*
9/30/21 Thursday, Trial Day 4: State witnesses: Brandy Eggeman, a certified dog trainer who assisted in discovering Crosssman’s body. Eggeman testified her dog Rock was altered to the odor of human decomposition in the back of a green pick-up truck that McCauley had allegedly been driving. Eggeman also mentioned Rock was alerted by the presence of decomposition, screws, & “drywall on some foliage” where Crossman’s body was located. West Virginia State Police Sgt. Jeanette also a white powdery substance located on the victim's body. The jury heard a recorded conversation (May 15, 2019) phone call between Crossman’s mother Chantel Oakley & McCauley. The defendant said in the conversation he had taken cocaine & heroin on the night of Crossman’s disappearance. Deborah Clavette - She was the one who saw his truck.
DA James said he plans to call forensic pathologist Dr. Piotr Kubiczek, two state forensics analysts & McCauley’s former work supervisor to testify. Testimonies are expected to continue into next week. No other info available. Trial continues on 10/1/21.
10/1/21 Friday, Trial Day 5: State witnesses: Special Agent Ryan Burke FBI cell expert was sent to Berkeley Springs by the FBI back in May of 2019 & the prosecution referenced cell tower data recorded from his initial investigation. The prosecution also showed the jury a record of McCauley’s phone activity leading up to Crossman’s phone going offline & the period of time that followed. RC's boyfriend. Dr. Piotr Kubiczek, first deputy chief medical examiner with the state Office of the Chief Medical Examiner, did not conduct the autopsy on the remains of Riley Crossman, but reviewed the report & reached similar conclusions. West Virginia State Police 1st Sgt. Wolfe. Owner Howard Ruark (McCauley worked for construction company Ruark Enterprises). Co-worker Johnny Walter rode together to a work site on May 8.
Jurors additionally heard more than 2 hours of interrogation from the day when authorities found Crossman’s body. McCauley voluntarily came in for questioning. West Virginia State Police Corporal F. Edwards asked him several times about the route he took from Hedgesville to Berkeley Springs. The defendant said he took State Route 9 back, later amending the statement to say he took a detour near Route 9 to avoid construction. He denied ever being on Tuscarora Pike or Apple Harvest Drive that day. State rested their case. Trial continues on 10/4/21.


Tuesday, October 5th:
*Trial continues (Day 11) (@ 9am PT) - CA – for *Elizabeth A. Holmes (34/now 37) (CEO of Theranos) charged (March, 2018) & indicted (6/14/18) & arraigned (6/15/18) with 9 counts of wire fraud & 2 counts of conspiracy to commit wire fraud and charged & indicted (4/11/20) with fraud relating to a patient's blood test. Another count of wire fraud was added in 2020, bringing the total number of felony charges to 12. Plead not guilty. No bond. Faces a maximum sentence of 20 years in prison & up to $2.75 million in fines, plus restitution, & $250K for each individual count of wire fraud & conspiracy.
Defrauding investors out of $700 million in funding for their blood-testing startup Theranos.
Trial began on 8/31/21 with jury selection. 12 jurors of 7 men & 5 women (6 Caucasians, 4 Hispanics & 2 Asians) with five alternates (2 men & 3 women). Juror #7 excused & replaced with alternate #1. Now jurors are 8 men & 4 women. Alternates 1 man & 3 women.
Trial began on 9/8/21.

*Trial set to begin (@ 8:30am MT) – CO – Jonelle Renee Matthews (12) (went missing on Dec 20, 1984 after entering her home at 8pm, Greeley, found July 23, 2019 by construction workers at an oil & gas site in rural part of Weld County near County Road 49 & County Road 34½) – *Steven Dana Pankey (33 @ time of crime/69/now 70) indicted (10/9/20), arrested & charged (10/12/20 in Meridian, ID.) with 1st degree murder after deliberation, 1st degree felony murder, 2nd degree kidnapping, with sentence enhancers for using a weapon in a violent crime & 2 counts of crime of violence. Plead not guilty. $5M cash-only bond.
Trial set to begin on 10/6/21 (thru 11/5/21). Will be 12 jurors & 3 alternates.

9/22/21 Update: Weld County District Attorney Michael Rourke said at the hearing the motions came down to preliminary rulings on evidence. Much of the evidence related to information learned during the course of pre-trial witness interviews. The first related to a possibility of two people testifying about what their 12-year-old daughter said at the time of Jonelle’s disappearance. Rourke explained the parents would only be asked to speak if the daughter could not testify herself. Viorst said the girl came “out of nowhere” as a “brand new witness,” but Rourke said the girl was interviewed by a Greeley police officer in 1984. In another filing, Viorst took issue with a statement by Russel Ross, the last adult known to have seen Jonelle alive & someone with whom Pankey had a labor dispute years before. The details of Pankey & his ex-wife’s fallout with Pankey’s father-in-law were the subject of another motion by Viorst. Rourke said Viorst could object at trial if Pankey’s ex-wife’s testimony posed an issue, but argued the motion, much like the others, was asking Kerns to issue preliminary rulings about evidence that should be ruled on during the trial. The final motion addressed Wednesday related to the operator of a salvage yard where Pankey disposed of a vehicle describing Pankey as creepy, evil & angry. Rourke said the statement wasn’t to make character judgments about Pankey, but could come up if the operator was asked why he remembered Pankey in particular. Kerns determined he would have to deal with the issues as they came up in the trial. Next hearing on 9/30/21.

4/10/21 Update: Trial is set to begin on 4/12/21 has been cancelled due to COVID. Bentaas was scheduled for trial Monday in Minnehaha County court in Sioux Falls. Randy Sample with the Minnehaha County State’s Attorney's office said that both sides were in agreement for a reset & that a new date has not yet been scheduled.
7/27/21 Update: Bentaas scheduled for a change of plea hearing at 9am on 10/8/21. Her last court date was supposed to be a jury trial starting on April 12 that was canceled & not rescheduled. It is unknown which of the three "not guilty" pleas Bentaas plans to change during her next hearing. Charged with first- & second-degree murder & first-degree manslaughter. A sentencing hearing is also scheduled for Bentaas after her change of plea hearing. The sentencing hearing is set for 9am. on 12/2/21. Both hearings will be presided over by Judge Bradley Zell.

Mr Belling’s Italian lawyer Luigi Conti told that his trial, which was due to begin earlier today, has been pushed back until October 26 so that a consultant can be appointed to “transcribe the wiretapping in prison.

10/5/21 Tuesday, Trial Day 7: The 12-member Morgan County jury will resume deliberations. McCauley was found guilty Tuesday of first-degree murder, concealment of a body & death of a child by a custodian by child abuse. It took the jury about four hours over the course of two days to reach a verdict. McCauley faces life in prison. Sentencing is set for 11/4/21.

Merrell, following her plea Tuesday, was sentenced to a decade in prison on the accessory charge & 2 concurrent five-year sentences on the child neglect charges. She received credit for the time she has been incarcerated since her arrest in 2017, meaning she has about six more years on her sentence.
*Cory M. Hagwell (29/now 32) (BF) – 6/28/21: Plead no contest to aggravated murder & 2 counts of child neglect. Sentenced (7/1/21) to 30 years in prison.

She was actually sentenced to 21 years but had nine suspended as part of a plea deal.
*Thomas Wayne Ferguson (42) (mom’s BF) - Ferguson committed suicide in his jail cell, hanging by sheets, May 23, 2018-case dismissed.

10/6/21 Wednesday, Trial Day 12: Juror #4 is in the courtroom & says she is a Buddhist, which teaches forgiveness. She says in the beginning of trial she thought she could be fair to both sides, but now she's worried about Holmes' future. Juror #4 says "Now I’m thinking what happens if [Elizabeth Holmes] has to be in [prison] for a very, very long time & I feel guilty & it’s my fault." Judge Davila notes jurors can't consider Holmes' punishment in deliberations. But she says she still thinks about it "all the time." "It will stay with me. I keep thinking about that, every day of my life." She adds she'll stay on only "if I don’t have to vote. I'd be ok." Prosecutors want the juror excused, because her beliefs seem sincere. Defense counsel doesn't ask for her to go, but also doesn't object. The judge excuses her. Judge Davila is on the bench. He says Juror Alternate #2 who would have replaced Juror #4 also expressed "similar concerns" to the clerk about continuing service, they're going to call that juror in for some questions. Juror Alternate #2 asks to speak to the judge alone. He says no. She says English is not her first language & "it’s [Holmes'] future. I don’t know if I’m 100% ready to participate in something like this, being English not my first language & I could make a mistake." Judge Davila notes that the community respects the "rich rich collection of individuals" who come to the Bay Area. He recognizes English isn't her first language & the lawyers know they can't use complicated words so that the jury understands the evidence. Neither prosecutors nor defense counsel want the juror to go, so the judge is keeping her on the panel & putting her in Juror #4's seat.

9/17/21 Friday, Trial Day 59: Jury deliberations won't resume until 1:30pm due to a scheduling conflict. Verdict has been reached. The jury deliberated for a total of 7 ½ hours. Defense is objecting to the reading of the verdict because Durst can't be there in person. Robert Durst GUILTY of murdering Susan Berman. (The judge ordered the verdict read without Durst present because Durst was exposed to COVID and test results are not back.) Statement from Kathie Durst's family on Susan Berman verdict. 10/14/21 Sentencing Day 3: A psychiatrist Dr. Jeffrey Rowewho testified for the defense Thursday said Nuñez suffered from PTSD, ADHD & learning disabilities. He also talked about Nuñez's relationship with his abusive father when it came to the abuse of Jeremiah. The sentencing hearing will continue Friday, 10/15/21.
10/15/21 Sentencing Day 4: Nuñez was facing up to 24 years in prison, but the judge combined two of the tampering with evidence charges, taking three years off the maximum sentence. And was sentenced to 21 years in prison.

9/7/21 Update: Next closed hearing for Larry English on 9/15/21 which is the capture him on video & played at trial for the jury. 10/1/21 Update: Arbery’s mental health records can’t be used as trial evidence. The decision by Superior Court Judge Timothy Walmsley further limits defense attorneys’ efforts to portray Arbery as an aggressive young man with a troubled past when the case goes to trial soon, with jury selection scheduled to start Oct. 18. The judge ruled that Arbery's medical privacy, even in death, trumped the rights of the men standing trial to a robust defense. And he concluded that a registered nurse's "highly questionable diagnosis” that Arbery suffered from mental illness during his first & only visit to a mental health services provider in 2018 could unfairly prejudice a trial jury. “There is no evidence that the victim was suffering from any mental health issue, or had otherwise decompensated, on February 23, 2020,” the date Arbery was killed, the judge's ruling said.
10/4/21 Update: Defendant requested that Court limit the State's presentation of Officer Duggan's body cam video. State filed response to defendant's Motion in Limine. State's response to defendant's Motion in Limine re vanity plate. Defendants have requested that this Court limit the State’s presentation of certain photographic evidence depicting the front of Travis McMichael’s truck which shows a representation, similar to the State of Georgia State Flag from 1956 thru 2001, contending that it is not relevant & is prejudicial. Trial starts on 10/18/21.
10/12/21: Court officials preparing for the trial of three men charged with chasing & killing Arbery mailed jury duty notices to 1,000 people, a huge number that illustrates the challenge the judge & attorneys face in finding impartial jurors for a case that sparked a national outcry. Jury selection is scheduled to begin Monday, 10/18/21. A total of 600 people are being told to report Monday morning to a courthouse annex building. An additional 400 will be on standby to show up Oct. 25 if there are not enough qualified jurors in the first batch.
10/15/21: English's attorney filed a "motion to quash" the subpoenas for English & his wife, Amy English. Attorney J. Elizabeth Graddy states in the motion that Larry English already provided testimony in a deposition on Sept. 24. He was granted the ability to give the recorded deposition because of health reason & the possibility that he would not be able to attend the trial. "Mr. English is afflicted with sarcoidosis & needs a heart transplant. Although Mr. English’s condition is matter of record, the threat that these proceedings pose to his life appears unappreciated," a portion of the motion states. "If Mr. English appears for trial & gives testimony, doing so may kill him. As for asking the court to reject his wife's subpoena, a portion of the motion states, "Amy English’s knowledge is limited to privileged marital communications, all of which is hearsay." "The Englishes never enlisted the McMichaels to do what they did & do not want to be part of any effort to justify the McMichaels' actions," a portion of Graddy's May 2020 statement says.
Federal charges: *Travis James McMichael (34/now 35) & *Gregory Johns McMichael (64/now 65) indicted (4/28/21) & charged (5/11/21) with Federal crimes of 1 count of interference with rights (hate crime), 1 count of attempted kidnapping & 1 count of using, carrying & brandishing firearms during & in relation to a crime of violence & Travis: 1 count of discharging a firearm. 9/7/21 Update: Next closed hearing for Larry English on 9/15/21 which is the capture him on video & played at trial for the jury. 10/1/21 Update: Arbery’s mental health records can’t be used as trial evidence. The decision by Superior Court Judge Timothy Walmsley further limits defense attorneys’ efforts to portray Arbery as an aggressive young man with a troubled past when the case goes to trial soon, with jury selection scheduled to start Oct. 18. The judge ruled that Arbery's medical privacy, even in death, trumped the rights of the men standing trial to a robust defense. And he concluded that a registered nurse's "highly questionable diagnosis” that Arbery suffered from mental illness during his first & only visit to a mental health services provider in 2018 could unfairly prejudice a trial jury. “There is no evidence that the victim was suffering from any mental health issue, or had otherwise decompensated, on February 23, 2020,” the date Arbery was killed, the judge's ruling said.

Defendants have requested that this Court limit the State’s presentation of certain photographic evidence depicting the front of Travis McMichael’s truck which shows a representation, similar to the State of Georgia State Flag from 1956 thru 2001, contending that it is not relevant & is prejudicial. 10/12/21: Court officials preparing for the trial of three men charged with chasing & killing Arbery mailed jury duty notices to 1,000 people, a huge number that illustrates the challenge the judge & attorneys face in finding impartial jurors for a case that sparked a national outcry. Jury selection is scheduled to begin Monday, 10/18/21. A total of 600 people are being told to report Monday morning to a courthouse annex building. An additional 400 will be on standby to show up Oct. 25 if there are not enough qualified jurors in the first batch.
10/15/21: English's attorney filed a "motion to quash" the subpoenas for English & his wife, Amy English. Attorney J. Elizabeth Graddy states in the motion that Larry English already provided testimony in a deposition on Sept. 24. He was granted the ability to give the recorded deposition because of health reason & the possibility that he would not be able to attend the trial. "Mr. English is afflicted with sarcoidosis & needs a heart transplant. Although Mr. English’s condition is matter of record, the threat that these proceedings pose to his life appears unappreciated," a portion of the motion states. "If Mr. English appears for trial & gives testimony, doing so may kill him. As for asking the court to reject his wife's subpoena, a portion of the motion states, "Amy English’s knowledge is limited to privileged marital communications, all of which is hearsay." "The Englishes never enlisted the McMichaels to do what they did & do not want to be part of any effort to justify the McMichaels' actions," a portion of Graddy's May 2020 statement says.

Judge Davila is on the bench. He says he received a note from a juror who said her mother-in-law just passed away & it was "sudden news." The juror may have to travel to the Midwest, but she doesn't know details yet. He says his friend "probably won’t make it much longer," and that may cause another break in the trial, because "if there is a memorial service I would like to attend."

10/19/21 Tuesday Trial Day 5: State witnesses: Pediatrician Dr. Marion Forbes continued testimony. Detective from the Kyle Police Dept. for a second time. That detective had pulled phone records, search records & photos and videos off of both Stevie & Dazrine’s phones during his investigation in 2018. The adopted dad for the couple’s youngest daughter. No other info available yet. Trial continues on 10/20/21.
10/20/21 Wednesday Trial Day 6: The State rested their case. The defense did not bring additional witnesses or evidence forward before resting its case. Stevie did not testify. During closing arguments Wednesday afternoon, the defense argued the state hadn’t proven without a reasonable doubt that it was actually Stevie & not Stevie’s wife, who was responsible for the boy’s murder. Trial continues on 10/21/21 with jury deliberations.
10/21/21 Update: A Hays County jury found Williams guilty of capital murder after about 8 hours of deliberations. Williams will spend life in prison without the possibility of parole.

*Trial continues (Day 5) (@ am CET) - Germany - *Irmgard Furchner (18 @ time of crime/95/now 96) Indicted (Feb. 5, 2021) on 10,000 counts of accessory to murder in Nazi Camp. Fuchner is accused of having contributed as an 18-year-old to the murder of 11,412 people when she was a typist at the Stutthof concentration camp between 1943 & 1945.
Trial began on Oct. 19, 2021. Trial is scheduled to continue over the next few months. Sessions are limited to about two hours a day, based on medical advice.
After trying to escape the trial in late September, leaving the retirement home in Quickborn where she lives & traveling by taxi to the outskirts of Hamburg, she was arrested several hours later & placed in police custody for five days before being fitted with an electronic wrist tag.

10/22/21 Friday, Trial Day 9: State witnesses: Ed Dentzel, host of the “Unfound” podcast. Remainder of interview with Pankey played. Gregory McHugh, a retired special agent with the FBI, testified about a November 1986 contact with Pankey for an unrelated matter. Daren Ford, lab director at the Northern Colorado forensics lab, explained the digital forensics he performed on Pankey’s electronics collected in the search warrant. Sgt. Nathan Taylor of the Sun Valley Police Dept. testified to a 1997 interaction he had with Pankey while working at the Ketchum Police Dept. Detective Mike Prill. Prill said his work on the case included digitizing handwritten reports, updating media such as tapes and going back over evidence to ensure a sound chain of custody. When Prill & Detective Robert Cash arrived at Pankey’s home in Twin Falls, Idaho, they recorded audio of the interaction, which was played in court Friday. He’s expected to be prosecutors’ final witness before defense attorney Anthony Viorst begins calling his own list of witnesses next week. DA Rourke expects Prill’s testimony to take up the full day Monday, with Viorst’s cross-examination likely taking a portion of Tuesday morning. The trial continues 8:30am Monday, 10/25/21.

9/30/21 Update: The Italian trial of Belling has been postponed so that telephone calls he made from prison can be transcribed. Mr. Belling’s Italian lawyer Luigi Conti told that his trial, which was due to begin earlier today, has been pushed back until October 26 so that a consultant can be appointed to “transcribe the wiretapping in prison”. It is understood that while in it is prison he made a number of phone calls to his nephew in Germany as well as to his mother-in-law, You Xiangzhen. The conversations were recorded & an application has been made to have them transcribed & produced as evidence. At a short hearing in Rome yesterday, You Xiangzhen filed a civil action against Mr. Belling, seeking damages if he is convicted of killing her daughter. Mr. Belling is currently in Germany, but is expected to attend the trial in Italy at a later date according to Mr. Conti his attorney.

10/27/21 Update: Smith was set to be sentenced Wednesday in Natchitoches District Court. However, the district judge recently signed a motion continuing the sentencing date until after the trial of her ex-girlfriend Hanna Barker. Smith plead guilty in July to several charges in a plea agreement with the State to avoid a capital murder trial where the death penalty could have been an option if she was convicted. Instead, she received an 80-year sentence for manslaughter, conspiracy to commit first-degree murder & cruelty to a juvenile. A condition of the plea is for Smith to testify truthfully against Barker, who is charged with first-degree murder. Barker had been scheduled to go to trial last month, but the date was pushed to March. The jury pool for Barker’s trial will come from St. Landry Parish, with the actual trial to be held in Natchitoches Parish. Should Smith not testify truthfully then the Natchitoches Parish District Attorney's office reserves the right to withdraw the plea & prosecute Smith on the original first-degree murder charge.

*Sentencing Hearing (@ 10:30am ET) - IN – Annalysa McMillian (19) (Nov. 26, 2019, shot & killed by back seat passenger, Marion) - *Austin Mark Smith (22/now 23) charged (12/3/19) with reckless homicide, criminal recklessness while armed with a deadly weapon (AR15 rifle). Plead not guilty. Held without bond. Posted bond (12/10/19) of $1K.
Trial was set to begin on 10/5/21 plead guilty instead (9/27/21).

9/27/21 Update: Hearing was held. State appears by Scott Hunt, defendant is present in person & by Counsel Craig Persinger. Plea agreement filed. Guilty plea held. Order on Guilty Plea issued. The Court orders a Pre-sentence Investigation Report to be made & filed & sets sentencing hearing on 10/25/21 at 10:30am. 10/20/21: Pre-sentence investigation report filed by Grant County Probation Dept.
10/25/21 Update: The judge noted his relatively clean record & that he hadn't really been in any other trouble. Judge accepted the plea deal. Sentencing: Reckless homicide defendant recklessly kills another human being: Term: 5 Years; Jail Credit: 10 Days; Suspended: 4 Yearrs 351 Days; Concurrent with Prior Sentence: to Count 2; Comment: Court imposes 5 years with 14 days executed & 4 years 351 days suspended & served on formal/supervised probation; credit of 10 actual days; pay restitution, upon filing of appropriate documents and/or hearing be held; be evaluated by Reentry Court & if admitted, participate & successfully complete the program; not to own or possess a firearm; submit DNA sample; pay court costs & fees in the sum of $435-due on or before 10/25/22; bond shall be released to Craig Persinger.
For Criminal recklessness committed with a deadly weapon: Confinement to Commence: 10/25/2021: Indiana Dept. of Correction; Term: 2 Years 180 Days; Jail Credit: 10 Days; Suspended: 2 Years 166 Days. Concurrent with Prior Sentence: to Count 1
Comment: Court imposes 2.5 years with 14 days executed & 2 years 166 days suspended & served on formal/supervised probation.
