Plead not guilty. Held without bond.
Trial was set to begin on 4/26/21. Jury selection began on 4/16 & jurors will be from Morgan County. Jury: 12 jurors & 2 alternates. These jurors will be let go & a new jury will be selected. First trial was cancelled due to COVID.

Found Deceased - WV - Riley Crossman, 15, Martinsburg, Morgan County, 7 May 2019 *arrest*
9/30/21 Thursday, Trial Day 4: State witnesses: Brandy Eggeman, a certified dog trainer who assisted in discovering Crosssman’s body. Eggeman testified her dog Rock was altered to the odor of human decomposition in the back of a green pick-up truck that McCauley had allegedly been driving. Eggeman also mentioned Rock was alerted by the presence of decomposition, screws, & “drywall on some foliage” where Crossman’s body was located. West Virginia State Police Sgt. Jeanette also a white powdery substance located on the victim's body. The jury heard a recorded conversation (May 15, 2019) phone call between Crossman’s mother Chantel Oakley & McCauley. The defendant said in the conversation he had taken cocaine & heroin on the night of Crossman’s disappearance. Deborah Clavette - She was the one who saw his truck.
DA James said he plans to call forensic pathologist Dr. Piotr Kubiczek, two state forensics analysts & McCauley’s former work supervisor to testify. Testimonies are expected to continue into next week. No other info available. Trial continues on 10/1/21.
10/1/21 Friday, Trial Day 5: State witnesses: Special Agent Ryan Burke FBI cell expert was sent to Berkeley Springs by the FBI back in May of 2019 & the prosecution referenced cell tower data recorded from his initial investigation. The prosecution also showed the jury a record of McCauley’s phone activity leading up to Crossman’s phone going offline & the period of time that followed. RC's boyfriend. Dr. Piotr Kubiczek, first deputy chief medical examiner with the state Office of the Chief Medical Examiner, did not conduct the autopsy on the remains of Riley Crossman, but reviewed the report & reached similar conclusions. West Virginia State Police 1st Sgt. Wolfe. Owner Howard Ruark (McCauley worked for construction company Ruark Enterprises). Co-worker Johnny Walter rode together to a work site on May 8.
Jurors additionally heard more than 2 hours of interrogation from the day when authorities found Crossman’s body. McCauley voluntarily came in for questioning. West Virginia State Police Corporal F. Edwards asked him several times about the route he took from Hedgesville to Berkeley Springs. The defendant said he took State Route 9 back, later amending the statement to say he took a detour near Route 9 to avoid construction. He denied ever being on Tuscarora Pike or Apple Harvest Drive that day. State rested their case. Trial continues on 10/4/21.
Tuesday, October 5th:
*Trial continues (Day 11) (@ 9am PT) - CA – for *Elizabeth A. Holmes (34/now 37) (CEO of Theranos) charged (March, 2018) & indicted (6/14/18) & arraigned (6/15/18) with 9 counts of wire fraud & 2 counts of conspiracy to commit wire fraud and charged & indicted (4/11/20) with fraud relating to a patient's blood test. Another count of wire fraud was added in 2020, bringing the total number of felony charges to 12. Plead not guilty. No bond. Faces a maximum sentence of 20 years in prison & up to $2.75 million in fines, plus restitution, & $250K for each individual count of wire fraud & conspiracy.
Defrauding investors out of $700 million in funding for their blood-testing startup Theranos.

*Trial set to begin (@ 8:30am MT) – CO – Jonelle Renee Matthews (12) (went missing on Dec 20, 1984 after entering her home at 8pm, Greeley, found July 23, 2019 by construction workers at an oil & gas site in rural part of Weld County near County Road 49 & County Road 34½) – *Steven Dana Pankey (33 @ time of crime/69/now 70) indicted (10/9/20), arrested & charged (10/12/20 in Meridian, ID.) with 1st degree murder after deliberation, 1st degree felony murder, 2nd degree kidnapping, with sentence enhancers for using a weapon in a violent crime & 2 counts of crime of violence. Plead not guilty. $5M cash-only bond.
Trial set to begin on 10/6/21 (thru 11/5/21). Will be 12 jurors & 3 alternates.

Found Deceased - CO - Jonelle Matthews, 12, Greeley, 20 Dec 1984 *arrest 2020*
9/22/21 Update: Weld County District Attorney Michael Rourke said at the hearing the motions came down to preliminary rulings on evidence. Much of the evidence related to information learned during the course of pre-trial witness interviews. The first related to a possibility of two people testifying about what their 12-year-old daughter said at the time of Jonelle’s disappearance. Rourke explained the parents would only be asked to speak if the daughter could not testify herself. Viorst said the girl came “out of nowhere” as a “brand new witness,” but Rourke said the girl was interviewed by a Greeley police officer in 1984. In another filing, Viorst took issue with a statement by Russel Ross, the last adult known to have seen Jonelle alive & someone with whom Pankey had a labor dispute years before. The details of Pankey & his ex-wife’s fallout with Pankey’s father-in-law were the subject of another motion by Viorst. Rourke said Viorst could object at trial if Pankey’s ex-wife’s testimony posed an issue, but argued the motion, much like the others, was asking Kerns to issue preliminary rulings about evidence that should be ruled on during the trial. The final motion addressed Wednesday related to the operator of a salvage yard where Pankey disposed of a vehicle describing Pankey as creepy, evil & angry. Rourke said the statement wasn’t to make character judgments about Pankey, but could come up if the operator was asked why he remembered Pankey in particular. Kerns determined he would have to deal with the issues as they came up in the trial. Next hearing on 9/30/21.

4/10/21 Update: Trial is set to begin on 4/12/21 has been cancelled due to COVID. Bentaas was scheduled for trial Monday in Minnehaha County court in Sioux Falls. Randy Sample with the Minnehaha County State’s Attorney's office said that both sides were in agreement for a reset & that a new date has not yet been scheduled.
7/27/21 Update: Bentaas scheduled for a change of plea hearing at 9am on 10/8/21. Her last court date was supposed to be a jury trial starting on April 12 that was canceled & not rescheduled. It is unknown which of the three "not guilty" pleas Bentaas plans to change during her next hearing. Charged with first- & second-degree murder & first-degree manslaughter. A sentencing hearing is also scheduled for Bentaas after her change of plea hearing. The sentencing hearing is set for 9am. on 12/2/21. Both hearings will be presided over by Judge Bradley Zell.

Plead not guilty. $500K bond.
Godfrey says 3/2/19 is the last time she saw Noah. 11 yr. old daughter in CPS custody.

9/22/21 Update: Weld County District Attorney Michael Rourke said at the hearing the motions came down to preliminary rulings on evidence. Much of the evidence related to information learned during the course of pre-trial witness interviews. The first related to a possibility of two people testifying about what their 12-year-old daughter said at the time of Jonelle’s disappearance. Rourke explained the parents would only be asked to speak if the daughter could not testify herself. Viorst said the girl came “out of nowhere” as a “brand new witness,” but Rourke said the girl was interviewed by a Greeley police officer in 1984. In another filing, Viorst took issue with a statement by Russel Ross, the last adult known to have seen Jonelle alive & someone with whom Pankey had a labor dispute years before. The details of Pankey & his ex-wife’s fallout with Pankey’s father-in-law were the subject of another motion by Viorst. Rourke said Viorst could object at trial if Pankey’s ex-wife’s testimony posed an issue, but argued the motion, much like the others, was asking Kerns to issue preliminary rulings about evidence that should be ruled on during the trial. The final motion addressed Wednesday related to the operator of a salvage yard where Pankey disposed of a vehicle describing Pankey as creepy, evil & angry. Rourke said the statement wasn’t to make character judgments about Pankey, but could come up if the operator was asked why he remembered Pankey in particular. Kerns determined he would have to deal with the issues as they came up in the trial. Next hearing on 9/30/21.

4/10/21 Update: Trial is set to begin on 4/12/21 has been cancelled due to COVID. Bentaas was scheduled for trial Monday in Minnehaha County court in Sioux Falls. Randy Sample with the Minnehaha County State’s Attorney's office said that both sides were in agreement for a reset & that a new date has not yet been scheduled.
7/27/21 Update: Bentaas scheduled for a change of plea hearing at 9am on 10/8/21. Her last court date was supposed to be a jury trial starting on April 12 that was canceled & not rescheduled. It is unknown which of the three "not guilty" pleas Bentaas plans to change during her next hearing. Charged with first- & second-degree murder & first-degree manslaughter. A sentencing hearing is also scheduled for Bentaas after her change of plea hearing. The sentencing hearing is set for 9am. on 12/2/21. Both hearings will be presided over by Judge Bradley Zell.
*Sentencing Hearing (@ 9:30am PT) – CA – Noah McIntosh (8) (last seen about Feb. 24, 2019, reported missing Mar. 12, 2019, Corona; not found yet) – for *Jillian Marie Godfrey (36/now 38) “mother” arrested (3/13/19), charged (3/15/19) & arraigned (4/15/19) with felony willful child cruelty (endangerment). Plead not guilty. $500K bond.
Godfrey says 3/2/19 is the last time she saw Noah. 11 yr. old daughter in CPS custody.
Godfrey plead guilty (12/19/19) & was released from custody (10/15/20) on own recognizance.

*Sentencing Hearing (@ 9am MT) - CO - Dylan Nicholas Redwine (13) (last seen alive Nov. 18, 2012 when he arrived at airport, reported missing on Nov. 19, 2012, Vallecito; found about 8 miles up Middle Mountain Road, a dirt road that cuts through the San Juan National Forest, about 100 yards from the road, directly off an ATV trail on June 27, 2013 & Nov. 1, 2015 his skull was found by hikers about 1.5 miles thru rough terrain from where his remains were found, by road 5 miles.) - *Mark Allen Redwine (50 @ time of crime/55/now 59), "father" indicted (7/20/17), arrested (7/21/17 in Bellingham, WA) & charged (7/21/17) with 2nd degree murder & 2 counts of child abuse resulting in death. Plead not guilty. $750K bond.
Jury Trial began on 10/29/20 with jury selection & ended 11/5/20 after Judge Wilson declared mistrial on 11/9/20.
Re-Trial began on 6/14/21 with jury selection & ended 6/21/21 selecting the final 16 & trial started with opening statements in the afternoon on 6/21/21 and ended with closing arguments on 7/15/21. 12 jurors & 4 alternates (11 men & 5 women). 1 juror was excused for having a fever (7/8/21).
