No more questions from the State. Defense's turn.On 5/12/22, Conner says she had been a homicide detective for about a year. She had been a cop for 9 years before that. Defense asking about APD's policies and procedures, which is a handbook given to each APD officer.

Defense asks is there a difference between being in custody and being arrested?Conner says they’re not free to leave when in custody, which is typically an arrest.

Defense asking about whether or not policies and procedures were followed. Asking about the interrogation process, seat placement, whether or not Armstrong had her phone. Conner clarifies that her time with Armstrong at APD was an interview, not an interrogation.

Conner says she did not ask her any questions on the theft of service charge.

Conner says in the beginning she was under arrest so Miranda would’ve applied. She would’ve gone to jail after, Conner says.

Defense asked what the rule is when they have to stop interviewing. Conner says it has to be clear and unequivocal, with no room for interrogation. Conner says this is how she was basing how to end the interview.

Conner says she had planned to read Armstrong her Miranda Rights, but since she learned she was no longer under arrest, she never did.Conner says someone has to be clear and unequivocal when they demand an attorney for an interview/interrogation to stop. Defense is pushing Conner to answer whether or not Armstrong invoked her right to an attorney, which was not granted. State objects, saying this issue has been litigated before the trial began.

Was not running to the bathroom after being shot in the head. Two times. She was on the ground.
The garage apartment looks small and I believe the bathroom was off the kitchen. There has been some talk that she may have been backed into the kitchen and "fell" backwards into the bathroom. IDK but the kitchen may have been close to the front door.

Jones with the protection objects to the defense line of questioning, pertaining to how the interview is being interpreted. Jones says that the court already ruled on this. Judge says defense may continue but to be aware the legality has already been set.


Conner says the warrant ultimately was a good warrant - despite Conner saying otherwise at the time. Defense says that could’ve been cleared up with one question. Conner says they never got to that point in the conversation.

Conner admits that the warrant was good all along. Since Conner never verified her DOB, she never realized that the warrant was still active. Essentially, APD let Armstrong, their eventual murder suspect who had an active warrant for her arrest, free after less than a 30-minute interview.

Armstrong: "I would love to leave...you just arrested me in front of all my neighbors…it was incredibly humiliating." However, she doesn't leave right away.
She just shot a woman dead but she feels humiliated for being taken away in front of her neighbors watching! Sounds about right, KA. :mad:

Jones objects again, “this is a detective not a lawyer.” Defense continued but Jones quickly objects again pertaining to defense’s questioning on Armstrong invoking her right to an attorney.

Defense: Are you representing to this jury if she stood up and walked out you’d let her go?Conner: Absolutely.

Defense brings up that Armstrong would still need to be escorted out.

Why would she keep receipts?
I wonder whether she was in the process of getting a full identity change with that alias used on the receipt—New passport, SS, drivers license. Kept the receipt to establish some more forms of ID.

Defense questioning if APD/Conner truly was allowing her to leave if that was her right.Conner says no one told her to stay in Austin or remain in Texas. APD never instructed her not to travel. Conner agrees that on 5/12, she was free to travel anywhere she wanted.

So why didn't she get up and leave? She's told she can leave, says she wants to leave several times yet doesn't leave? Seems to me that her not leaving was an intentional act to preempt the questions, statements and recording of same becoming inadmissible.

Det. Conner says Armstrong was not a suspect at this point, just a person of interest, but she did become more suspicious after interview.

We’re now jumping to contents of Armstrong’s bag when she was brought back to Houston from Costa Rica. Included:
-a receipt for cosmetic surgery on June 23 under “Alisson Paige”
-receipt for new T-Mobile account-passport belonging to Christine Armstrong

State is having Det. Conner handle two passports: Kaitlin’s & Christine’s. There is a Costa Rica stamp on May 18 in Christine’s but not in Kaitlin’s.

Asks when you have to stop interviewing. Det. says if somebody invokes their Miranda rights it has to be made clear.
Armstrong in interview: “If you’re reading me my rights, I should have an attorney”
Question over whether or not that was a clear statement or posed as a question.

Defense: "Did anyone from APD tell Armstrong to stay in Austin? Did anyone tell her to remain in Texas? Did anyone give her any instruction about not traveling?"
