A nursery in England admitted to corporate manslaughter after a 14-month-old boy died in 2022.

Noah Sibanda died in December 2022, having been "physically restrained face down on a cushion, with a blanket over his face and a leg placed over him" at Fairytales Day Nursery in Dudley, England, the Crown Prosecution Service said.

More than three years later, the nursery admitted to one count of corporate manslaughter and a Health and Safety at Work Act offense on Wednesday, March 25, per the CPS.

From 25 March 2026:
private nursery has admitted corporate manslaughter over the death of 14-month-old Noah Sibanda who died after being suffocated while staff tried to make him fall asleep.

Toddler Noah died at Fairytales Day Nursery on 9 December 2022 having been physically restrained face down on a cushion, with a blanket over his face and a leg placed over him.

Latewood and Cookson, both from Dudley, and the nursery, which is no longer in operation, are expected to be sentenced on 16 April.
The full charges admitted by the defendants were:
  • Kimberley Cookson - gross negligence manslaughter
  • Fairytales Day Nursery Limited - corporate manslaughter and failing to comply with a duty under the Health and Safety at Work Act 1974
  • Deborah Latewood - failing to comply with general duties under the Health and Safety at Work Act 1974
