Seems as if Sandra had serious luck to avoid having to pay the consequences of her actions for so long regarding so many wrongs. Has her luck finally run out?

Reading over the details of the case makes me very angry. Dezirae was a beautiful innocent child who deserved to be protected and now her unborn sibling needs protection.

Albert Einstein’s words come to mind “The world is a dangerous place, not because of those who do evil, but because of those who look on and do nothing.”

I hope many will take the time to sign the petition.

Willis Sheldon said he will not keep any of the $ 500,000 the state was ordered to pay him for the death of his daughter.

Judge Helen Toor approved a settlement Wednesday in Sheldon’s lawsuit against the Vermont Department for Children and Families over the death of Dezirae Sheldon.

Dezirae died days after her second birthday in 2014. Her mother’s boyfriend, Dennis Duby, is charged with second-degree murder in the death. A motion for a change of venue in the case has been granted, but the new venue has not been chosen and a trial date has not been set, a court official said Thursday.

Sheldon has two more lawsuits pending, one against the hearing officer who reviewed Dezirae’s case and another against the lawyers who had been charged with representing the child’s interests.

Costello said $500,000 was the highest allowable award in such a case under state law, and that Dezirae’s mother, Sandra Eastman, waived any claim in the case.

Sheldon said he is putting half the money in a trust for Dezirae’s half-sister, Destinay Brown — who is not Sheldon’s child — and is looking for a use for the other half.

“We’re either going to donate it to a children’s hospital, or we would like to check into doing something for a park in Dezirae’s name,” he said.

What he won’t do, he said, is spend a penny on himself.

“I don’t want the money,” he said. “I want nothing to do with it. I want everyone to know it was never about the money. The lawsuit is the lawsuit. I’d give everything up if I could just have Dezirae back, but I can’t have that.”

Duby admits to murder in death of Dezirae Sheldon

Dennis Duby has told police a few different stories about how his 2-year-old stepdaughter, Dezirae Sheldon, suffered the head injuries that led to her death.

On Monday he admitted he killed her, pleading guilty to second-degree murder in Rutland Superior Court.

As part of a plea deal, he faces at least 13 years in prison when he is formally sentenced next month in a case that prompted calls for change in how Vermont deals with the state supervision of children.

“I have a life sentence,” Duby, 34, said in court, his first public statements since Dezirae’s death more than three years ago. “I live with it every day.”

“The sole caregiver for Dezirae was Mr. Duby,” the prosecutor said. “Up until today, Mr. Duby, in a series of interviews with Vermont State Police, had put forth a number of explanations.”

Those included not knowing what happened, and falling asleep and waking up after hearing a loud noise and finding Dezirae had fallen and injured herself.

“None of those stories were, from the state perspective, consistent with the medical evidence,” the prosecutor said.

However, if the state had gone to trial with the case, Levine said, there were risks.

“The state could not have specifically explained to the jury how in fact this injury happened,” the prosecutor said. “The jury would be left to conclude by circumstantial evidence that based on the severity of the injuries and the timing of the injuries that it must have been at least willful and wanton disregard of life.”

Levine said that with Duby admitting to an act that caused Dezirae’s death, a plea agreement was put on the table.

As part of the deal, Duby will receive a sentence of 20 years to life in prison, with all but 13 years suspended. That means he will have to spend at least 13 years behind bars.

Dezirae's family isn't satisfied with the settlement. They wanted him locked up for life.

"I'm not sure that you could equate number of years in prison with the death of a toddler," said Linda Johnson from Prevent Child Abuse Vermont.

Dezirae's family issued WCAX News a statement that says in part: "We are saddened that the theme of the Vermont judicial system is to offer a plea deal to avoid a lengthy trial. Dennis should spend the rest of his life in jail with no chance of hurting any other children."

"It will never bring this child back," Johnson said.

Dennis Duby, stepfather of 2-year-old Dezirae Sheldon, will serve at least 13 years in prison for killing the toddler.

The toddler’s mother and biological father say the sentence is too lenient.

“If my giving Mr. Duby a life sentence, or even two or three life sentences, would somehow bring Dezirae back of course I would do that in a second,” Judge Cortland Corsones said, “but we all know that that won’t happen.”

Eastman, speaking in court Tuesday, said if Dezirae were alive today she would be 5 years old and preparing to start kindergarten.

“Dezi had the rest of her life ahead of her. She will never go to school, graduate, wear a cap and gown. She will never go to school dances or to prom,” Eastman said. Dezirae, she added, could have grown up to be a doctor, lawyer, or even the first woman president.

“None of us will ever know what could have been,” Eastman continued. “We only know what is, and that is, that she is in heaven and that Dennis has stolen her from all of us and we will never have her back.”
