Scott A Macklem was gunned down in a college parking lot on November 5, 1986 at approximately 9 am. Before cell phones and long before the internet, police focused on one person and never looked at any other suspects. This person was Temujin Kensu, who was known as Fredrick Freeman at the time of the crime. (He changed his name after he went to prison for religious beliefs). There are no less than 20 things wrong with Kensu's conviction to include:
1) airtight alibi - Kensu had nearly a dozen witnesses placing him over a 450 miles from the crime
2) he wasn't allowed to testify at his own trial
3) his primary alibi witness, Michelle Woodworth, wasn't allowed to testify either
4) Kensu passed a polygraph exam; Michelle Woodworth passed one also
5) The prosecutor (Robert Cleland) put his own friend and personal pilot on the stand to testify that Kensu "could have" chartered an airplane, but didn't provide a shred of evidence to the jury
6) There was NO physical or forensic evidence tying Kensu to the crime
7) A shot gun shell box found in an adjacent parking lot had a print that did NOT match Kensu's
8) Many of Kensu's alibi witnesses didn't even like Kensu
9) Kensu's car had broken down the night before making it even LESS likely he would use it to drive 450 miles to commit a crime
10) the distance and alibis made it impossible for Kensu to have driven the distance to commit the crime and be seen by so many witnesses
11) One person who was in the parking lot during the crime was "hypnotized" to enhance his memory about the license plate of the suspected killer.
12) The license plate combinations given by the hypnotized witness didn't tie a vehicle to Kensu
13) Kensu's trial attorney David Dean was drug addicted and later disbarred for drug use
14) Kensu's trial attorney David Dean had JUST completed probation for drug use before taking Kensu's case
15) Philip Joplin, a jail house snitch, testified at trial that Kensu admitted to the murder when they were in jail, but later recanted claiming he received favor from the prosecutor in exchange for his testimony
16) The victim in this case, Scott Macklem was the son of a prominent mayor in a small town and was highly rumored to be dealing drugs.
17) There were calls into the police station after Kensu was in custody stating that the suspect was seen driving a Ford Escort on I-94, but when this information was turned over to the police - it wasn't investigated because they already "had their guy."
18) Kensu won several federal habeas corpus appeals citing his innocence, but those were overturned by a timing technicality.
19) The prosecutor in the case was running for Attorney General of Michigan at the time of the murder and the victim’s father financially donated to his campaign, so it is believed they never searched for the real killer because they didn't want the fact Scott was dealing drugs to muddy their family name.
20) Several pilots have come forward discrediting the reliability of the testimony of the pilot Bob Evans who was a friend a pilot for the prosecutor in this case. Read those letters here: Pilot Letters and Cleland Closing Remarks - Google Drive
21) Delta County Private Invesitagtors are stading by Kensu
21) His case was covered by CourtTV - they agree something is very fishy about this case.
22) Australia's podcast by Jack Laurence covered this case and has a surprise recent quote from a juror
23) Kensu is supported by University of Michigan Innocence Clinic. They will tell you they are highly skeptical of cases but are 100% certain Kensu is innocent and they've supported him pro-bono for over 15 years.
24) Private investigators Bill Proctor and Herb Welser speak on Kensu's innocence
25) Law Enforement Today supports Temujin Kensu's innocense
26) Khaliah Ali, daughter of famed boxer Muhammad Ali, supports Kensu's innocence.
27) Democratic leaders urge Governor Whitmer to free Kensu because of his overwhelming evidence of innocence.
The travesty represented by this case has been recognized by virtually all who have examined it from an independent perspective. This includes the late former Senator Carl Levin, former Senator, a former Chief Justice of the Michigan Supreme Court (Thomas Brennan), the current Chief Justice of the Michigan Supreme Court (Bridgette McCormack), a retired career Federal Prosecutor, eight former FBI agents, a former Michigan State Police polygraph expert, a former detective/sergeant for the Michigan State Police, and a retired Lieutenant Detective (Herb Welser) who spent 26 years in the very same police department in Port Huron, Michigan where Temujin was arrested.
