"Ryhley Mattison, Alexander "AJ" Martin, Dante Carlson and Anthony "Tony" Carlson have filed a lawsuit against Nicolae Miu and his insurance company.

According to the lawsuit, the victims are also asking for damages from Miu's insurance company. [...] The victims are demanding a jury trial for the lawsuit. "
Thanks for posting, @daybreaking. Im curious about how the lawsuit will play out. After his conviction I recall that NM showed remorse about killing Isaac Schuman.
Such a tragic loss that didnt need to happen, it's too late now, but wish NM would have minded his own business, walked away and ignore the young group trying to have a fun day.

From article:

Insurance companies can be added to lawsuits that are seeking damages due to negligence when they are insuring the person being sued.

I have only just heard about this case, no one deserved to die, no one deserved to attacked, no one deserved to be called any kind of predator, all Nick did was to cross paths with them. Yeah maybe he should have walked away, but the way they went for him was horrific. At the end of the day if they left him alone and minded their business, no one would have gotten hurt.

-- Surviving victims of the Apple River stabbing filed a lawsuit against Nicolae Miu and his insurance company.
-- The suit seeks the following damages: physical and psychological injuries, and conscious pain and suffering caused by NM’s actions the day of the incident.
-- Theres been no dollar amount for damages disclosed at this time.

In addition, I wasnt able to find any indication that the lawsuit has been settled yet.

Yeh, that is where I am on this.

In my humble opinion, he was 60% responsible for the murder but the group of teens was 40% responsible.

I know courts don't work that way.. .but either group, walking away from this escalation, would have fixed it.

NONE of those 'kids' deserve a dime and i still think some of them should have been charged also. I've rewatched the trial and still feel the same. Alcohol and showing off is what escalated the encounter.

He brought a knife into a name calling episode. He was supposed to be the adult. Granted, the kids should have left him alone but they did not deserve being attacked with a knife.

Well the kids did physically throw him down several times so it was definitely not just a name calling episode.

He had a knife because of the tubing for the ropes, it was in a pocket. He didn't go get one then come back intentionally to hurt someone. Then he was surrounded and pushed under water by a 'mob' of Drunk Teens/20somethings. Those kids are not 'innocent' victims. In desperation i'd have done the exact same thing. If he had taken a rock off the bottom of the river and hit someone in the head and killed them, would they still sue? There is guilt on BOTH sides. He should have ignored them and walked away, but once they circled him, it was fight, no longer flight, that was necessary.

I'm pretty sure he brought the knife out of his pocket before they pushed him down, correct?

I thought it was after the big push down... but not certain at all.

According to witness accounts and video evidence in the Apple River stabbing case, Nicolae Miu pulled out a knife after being pushed into the water. The initial confrontation involved Miu being slapped and pushed into the river. After being pushed, he emerged from the water with a knife and began stabbing people.

Specifically, a witness video showed Miu falling into the water and then coming up with a knife, subsequently stabbing one of the individuals who had pushed him. Miu himself denied having the knife before the incident and claimed he was acting in self-defense after being attacked, according to a report from NBC News.

same applies to the convicted man IMO.

I agree... BOTH were at fault. He should have walked away and ignored, they shouldn't have followed and most shouldn't have even gotten involved at all.

No, this video shows it (warning: extremely graphic): GRAPHIC CONTENT: Apple River stabbing video released

You can see him feeling/checking the knife in his pocket when he approaches the group with his snorkel at the beginning of the video.

Mmm, actually I think in that video, the most important part is covered up by the news banner at the bottom.

This youtube video, which is not very graphic at all, shows it much better:

Watch from about 32:55, you will see he takes it out before anyone pushes him down.

Good point. I watched the video and sure enough, he has the knife out before he gets slapped into the water.

Thanks. Appreciate seeing that!
