K.A. is one sick puppy, he goes to court for a competency hearing on nine counts of Possession of Child Pornography later this month and the homicide and hiding Kristin's corpse charges have been dismissed after being found incompetent.

RACINE — A Sturtevant man accused of first-degree homicide is now facing nine counts of possession of child pornography.
Local law enforcement learned about the alleged sexually explicit images and videos as well as a membership to a child pornography website during an investigation into Keith M. Abbott, 49, for the stabbing death of a Racine woman in early 2011, according to a criminal complaint.

A 2011 homicide case that ended with the defendant being found mentally incompetent is open again after a Rock County judge found he is now competent to assist in his defense.

Keith M. Abbott, 51, of Sturtevant stood mute in Rock County Court on Friday to charges of first-degree intentional homicide and hiding a corpse.

Court Commissioner Larry Barton entered a not guilty plea on Abbott’s behalf.

A man accused of murdering a Racine woman in 2011 and dumping the body in rural Rock County might finally go to trial.

Rock County Judge Michael Haakenson on Wednesday found Keith M. Abbott, 53, competent to stand trial and set a jury trial for the entire week of Sept. 18.

Haakenson made the ruling despite defense attorney Walt Isaacson's statements that Abbott suffers from hallucinations, including that he talks to “John the devil.”

The setting of a trial date offered relief to the mother and sister of the victim, who have attended nearly all the hearings over the past six years, including previous competency hearings at which Abbott was sometimes found competent but incompetent at others.

Abbott has spent time in treatment for mental health problems and is on medication to reduce the intensity and frequency of his hallucinations, said forensic psychiatrist Craig Schoenecker, who testified Wednesday by phone.

Abbott also exhibits odd physical movements in court--a nearly constant shaking of one hand and rocking forward and backward in his chair.

Neither the physical tics nor the hallucinations are enough to keep the former rural Palmyra man from understanding court proceedings or assisting with his defense at trial, Schoenecker said.

Miller's sister and mother on Wednesday told The Gazette that Abbott is faking his mental problems. Some of Abbott's past evaluators have said Abbott is malingering. Others saw his mental problems as real.

Haakenson appointed Dr. David Robinson of Burlington to evaluate Abbott for purposes of the not guilty by reason of mental disease or defect plea.

Haakenson set a hearing for March 29 to consider Robinson's report.

After Haakenson's ruling, Isaacson said his client intended to enter a plea of not guilty by reason of mental disease or defect.

After many turns in the case, including several terms in mental-health facilities after being found incompetent to stand trial, Abbott pleaded not guilty by reason of mental disease or defect Jan. 25.

Wednesday, Abbot withdrew his plea and entered an Alford plea to a reduced charge, second-degree intentional homicide.

Judge Michael Haakenson found Abbott guilty and set sentencing for Dec. 19.

Abbott was also charged with hiding a corpse. That charge was withdrawn as part of a plea agreement.

Nearly seven years and uncounted tears since a woman’s body was found in a remote Rock County ravine, someone is going to prison for it.

Haakenson sentenced Abbott to 35 years in prison Tuesday in Rock County Court for second-degree intentional homicide. Abbott gets credit for 2,512 days he has spent in custody, trimming nearly seven years from that total.

For some people age 54, it would be a life sentence, Haakenson said.

Miller’s mother, Susan Earl, told of how she had last seen her daughter on Christmas Day, 2010. She remembers Miller’s hug and kiss and words: “I love you, Mom.”

Earl imagines her daughter’s body in that ravine, wondering if animals got to it.

Cheryl Miller also spoke Tuesday. She last saw her sister standing in the bed of Abbott’s truck, the same truck where her blood was found. Cheryl keeps picturing her sister’s body in the truck bed.

Miller had two children, a boy, now 18, and a girl, now 9. Her son suffers from “demons” at the loss of his mother, her sister said.
