WV - Kyneddi Miller, 14-year old starved to death, mother arrested - 4/20/24

The proposed bill would require the disclosure of age, gender, and county of residence of a child fatality or near-fatality; whether the incident was the result of abuse and/or neglect; the name, age, and city/town of resident of the alleged perpetrator if known; a summary of the cause and circumstances; a summary of actions taken by DoHS in response; a summary of prior reports made to DoHS over a three-year period regarding the child or alleged perpetrator and actions taken; and the name of the child in the case of a fatality.

The bill is a response to the actions of DoHS regarding the death of 14-year-old Boone County girl Kyneddi Miller earlier this year. Law enforcement officers in Boone County found her in what they called a “skeletal state” due to years of malnutrition. Miller’s mother and grandparents are facing criminal charges.
West Virginia Lawmakers Hear Proposals for Possible Child Welfare Legislation

"I think this topic has come up because it's frankly the reaction to some of the events that have happened in the state and the lack of information that is there, and unfortunately that's raised, if you will, concerns or even suspicion as to what's going on," Del. Bob Fehrenbacher said.

The case of Kyneddi Miller, a homeschooled teenager found in Boone County apparently starved to death, is a large driving force behind changing these codes.

BOONE COUNTY, WV (WOWK) — The trial of Kyneddi Miller’s mother and grandparents will not be moved out of Boone County, a judge ruled on Friday.
[snip]
The trial is now being moved to Jan. 29, 2025, after Julie Miller, Kyneddi’s mother, and Donna Stone, her grandmother, waived their right to a fair and speed trial.

BOONE COUNTY, W.Va. (WCHS) — It has been one year since Boone County deputies made a discovery that sent shockwaves through the state.
[snip]
So much has happened in the past year with this case because not only is it still playing out in court with murder charges for Kyneddi's mother and grandparents, but the case also marked a turning point for the state where several systemic issues came to light in one tragedy.
One year later: Impact of Kyneddi Miller's tragic case still felt

not much was accomplished today at the hearing. Because the three are being tried together nothing can move forward until all three have been found competent to face trial. Recall that grandfather, Jerry Stone, was found not competent and time was given by the court for medical providers to attempt to restore his competency. That has apparently not happened and his doctors asked for and were granted an additional 150 to accomplish it back in March. Meanwhile, attorneys for Julie Miller, Kyneddi's mother, requested a competency evaluation for her, which has been completed but no report has been given the court yet.

So far nobody has filed any motions to sever the case so . .
---------------------------
We are still in what I’m going to call a holding pattern in this matter until we have a final determination of competency,” Boone County Circuit Court Judge Stacy Nowicki-Eldridge said.

They are all due back in court in late July.

At a hearing for Julie Miller and her parents, Donna Stone and Jerry Stone on Sept. 26, the court received the results of a mental evaluation for Jerry Stone, which was requested in May 2024. The judge ruled that he is not competent to stand trial in the April 2024 death of his granddaughter, 14-year-old Kyneddi Miller.

Judge Stacy Nowicki-Eldridge ruled that the state can use the original statement from the 14-year-old’s grandmother, Donna Stone, and jail calls from the mother, Julie Miller, at a trial that is still scheduled for Dec. 2.

Mother, grandmother indicted in Kyneddi Miller’s death receive trial dates

Kyneddi Miller’s mother, Julie Miller, and grandmother, Donna Stone, appeared in court Friday for a pretrial hearing where Stone’s lawyer, Timothy Gibson, and Miller’s lawyer, Ron Walters, Jr., both filed a motion for the trials to be separated.

Julie Miller’s trial will remain on Dec. 2, 2025, while Donna Stone’s trial is now set to start Feb. 24, 2026. Both women are charged with “murder by a parent, guardian or custodian by failure to provide necessities” and with “child neglect resulting in death.”

Walters also filed another motion for the pool to fill out a jury questionnaire. He also says he has a computer belonging to Kyneddi, but was with Stone or in the home. Walters says they have been trying to “crack” the computer.
[snip]
There will be an oral argument on Nov. 20 regarding that computer.

a red herring IMO, mom is hoping something on that computer can be used to suggest Kyneddie starved herself and wanted to die, so we can all go home now, nothin to see here.
