I initially favored a death sentence, even if symbolic in California. Now, however, I think LWOP will be more of a punishment for a 19 year old perpetrator.
 
LWOP will seem endless. No Death Penalty sought due to his pleading Guilty last month.

Chabad of Poway Shooter Slated To Plead Guilty In Federal Case

John Timothy Earnest, 22, who previously pleaded guilty to murder and other state charges in connection with the April 27, 2019, shooting, is now set for a Sept. 17 change of plea hearing in San Diego federal court.

The hearing was scheduled one day after federal prosecutors stated in a court filing that the death penalty would not be pursued against Earnest, who faces more than 100 hate crime counts in his federal case.

He previously signed off on a conditional plea agreement in the federal prosecution, though the terms of that agreement have not been publicly disclosed.

About two weeks after the federal change of plea hearing, Earnest is slated to be sentenced to life in prison without the possibility of parole, plus 137 years to life, in the state's case.
 
California synagogue shooter pleads guilty to more than 100 federal hate crimes

The California man who opened fire on a Poway synagogue in a 2019 attack that killed one person and wounded others pleaded guilty to more than 100 federal hate crime charges Friday.

John T. Earnest, 22, earlier this year pleaded guilty to state counts and agreed to a sentence of life in prison without the possibility of parole.

Federal prosecutors and Earnest will jointly recommend a life sentence plus 30 years, the U.S. Attorney's Office for the Southern District of California said. Earnest pleaded guilty to a 113-count indictment.

Sentencing in the state case has been scheduled for Sept. 30. Online court records did not appear to show when sentencing is scheduled in the federal case.

"Earnest’s attorney said Earnest wanted to make a statement but Judge Peter Deddeh refused, saying he did not want the hearing to become “a political forum” for white supremacist views."

“I’m not going to let him use this as a platform to add to his celebrity,” the judge said. There was no visible reaction from Earnest, who stared straight ahead.

"Minutes after the shooting, Earnest called a 911 dispatcher to say he shot up the synagogue to save white people. “I’m defending our nation against the Jewish people, who are trying to destroy all white people,” he said."

''SAN DIEGO (AP) - A 22-year-old white supremacist was sentenced Tuesday to life in federal prison for killing a woman and injuring three others when he burst into a Southern California synagogue in 2019, adding to a life sentence he received three months earlier in state court.

John T. Earnest declined to speak in a courtroom full of victims, families and congregants. In state court, his attorney said he wanted to speak but a judge refused, saying he didn't want to give a platform for his hate-filled speech.

Earnest's attorney, Ellis Johnston III, said his client acknowledged his actions were “inappropriate,” a statement that was greeted with skepticism by prosecutors. Peter Ko, a federal prosecutor, said Earnest's expression of regret came shortly after the shooting in a phone call to someone else.

U.S. District Judge Anthony Battaglia said the federal and state life sentences would run one after the other instead of concurrently, acknowledging it was symbolic but that it was meant to send a strong message. The judge denied a defense attorney's request to have Earnest stay in state prison.''

By the time the 19-year-old gunman ran off, three had been injured. Gilbert-Kaye was shot and killed, trying to shield the rabbi.

John Earnest, the man who took her life, was arrested soon after the shooting. He pled guilty and was sentenced to life in prison on state and federal charges. An online manifesto revealed his anti-Semitic beliefs.

Now, five years later after the shooting, Kaye and her aunt, Randi Grossman, are preparing to commemorate a sobering anniversary.

“It’s not easier. It does not get easier over time," Kaye said. “She was my best friend, my soulmate, loving and caring."

“I miss her love, her guidance. She was an extraordinary force for good this world. She’s gone, but still in my heart,” said Grossman.​
