Exclusive: Man who had received immunity is a third target in Bobo investigation

Prosecutors plan to indict at least one more person in the Holly Bobo case, according to documents obtained today by The Jackson Sun.

According to the documents, prosecutors plan to indict Shayne Kyle Austin, who previously had been granted immunity in exchange for his cooperation in the investigation.

The state voided the immunity agreement because Austin was not completely truthful and forthcoming, according to an email from Assistant District Attorney General Beth Boswell to Austin’s lawyer, Luke Evans. The email was sent on March 27.

“When we indict your client, I will give you a courtesy call informing you,” Boswell told Evans in the email.

We have John Dylan Adams, Zachary Adams' brother, whom as The Jackson Sun reported, saw Zachary Adams with Holly after the kidnapping.

Jason Wayne Autry, 39 years old was the next to charged in Holly's murder.

Shayne Kyle Austin, 38 years old, who was given immunity, but now prosecutors are saying they plan to indict (I assuming as a co-conspirator?

Prosecutor can't comment on 3rd man; District attorney seeks dismissal of complaint over voided immunity deal in Bobo case

District Attorney General Hansel McCadams said Wednesday he could not comment on whether his office plans to present charges against Shayne Austin to a grand jury in the Holly Bobo case.

The district’s attorney office is seeking dismissal of a complaint Austin’s attorney filed in Decatur County Chancery Court. The complaint states that prosecutors told Austin’s attorney they plan to indict Austin after nullifying an immunity agreement they had offered him in exchange for his cooperation in the investigation of Bobo’s kidnapping and murder.

MPD: Austin has criminal record in city

A third person being investigated in connection to the Holly Bobo case has a criminal record in Murfreesboro, including a DUI and a charge of walking down a major street with a shotgun, according to police documents.

Shayne Austin, 29, identified as suspect by a prosecutor in an email, may be indicted alongside Jason Wayne Autry and Zachary Adams, who have both been charged with first-degree murder and especially aggravated kidnapping in the Bobo case.

Man Suing State To Keep Immunity Deal In Bobo Case

Another man named in connection with the Holly Bobo case has sued the State of Tennessee in order to protect his immunity.

So far, Zach Adams and Jason Autry have been charged with kidnapping and killing Bobo.

Court records have indicated that Shayne Austin may also be indicted in connection with the case. Prosecutors granted Austin immunity if he could help with the TBI investigation, which apparently included finding Bobos' body.

Newschannel 5 learned that a tip from Austin helped lead to a massive search of Adams' property back in February.

Holly Bobo's mother speaks out for 1st time since arrests

Holly Bobo’s mother spoke out for the first time following a motions hearing for one of the two men charged with kidnapping and murdering the nursing student in April 2011.

“I'm asking people, please not forget what this is all about and that his justice for my daughter,” Karen Bobo said. “I don’t want people to be distracted by the sideshow the attorneys are putting on in court.”

The Bobo family has been present for every court hearing involving the case against Zachary Adams and Jason Autry.

Judge Declines To Issue Gag Order In Holly Bobo Case

A Decatur County judge has declined to issue a gag order in the case against one of the two men charged in the murder and kidnapping of Holly Bobo.

Circuit Court Judge Charles Creed McGinley said Wednesday he would not be issuing the order "at this time" in the case of 39-year-old Jason Autry.

A gag order would bar those involved in the case from speaking publicly about it. McGinley said he has not granted a gag order in 26 years as a judge. However, the judge also advised the defendant to "exercise his right to remain silent."
The request was filed by prosecutors after Autry gave an exclusive interview to NewsChannel 5 from jail. McGinley advised everyone involved in the case to "try the case in the court and not in the media."

The state objected to the broad content of our interview and claimed the comments made by Autry and his attorney, Fletcher Long, could intentionally or unintentionally pose a substantial likelihood of prejudicing a fair trial because of the publicity.

Attorney General Beth Boswell claimed Long inappropriately allowed NewChannel 5 to interview his client while he was being held in segregation at Riverbend Maximum Security Prison.

Judge Charles Creed McGinley ruled today that there will be no gag order in the cases involving two men charged with the first-degree murder and aggravated kidnapping of Decatur County woman Holly Bobo.

State prosecutors made a motion requesting the gag order on Tuesday.

McGinley announced his decision today during a status update hearing for defendant Jason Autry, who faces the murder and kidnapping charges along with Holladay resident Zachary Rye Adams.

Man arrested in Holly Bobo case released, Brother remains jailed

One of the two brothers recently arrested in the ongoing investigation into the disappearance and murder of nursing student Holly Bobo has bonded out of jail.

Jeffrey Pearcy, 42, was arrested in Henderson County on May 29 on charges of tampering with evidence and accessory after the fact.

He was released on a $25,000 bond late Wednesday afternoon following an arraignment earlier in the day.

Under the conditions of his bond he must wear a GPS monitoring device and have no contact with a witness in the case.

One of two brothers charged in connection to the disappearance of nursing student Holly Bobo will have his preliminary hearing next week.

Wearing a bullet proof vest, Mark Pearcy appeared in a Decatur County courtroom Monday where a judge appointed Jackson attorney Michael Cash his public defender.

Now that he has representation, Pearcy’s preliminary hearing will take place next Monday.

Jeffrey Pearcy is one of the latest men accused in the Bobo case.

"I have no video. I have not seen a video, never even heard of the video until I was questioned about it the day of my arrest," Pearcy said.
