New Orleans Police are asking the public's assistance with locating a critical missing juvenile.

Missing is Eriel Lynette Mack-Mariscal (pictured), White female, now Age 8. Please note the pictured image of her is from when she was approximately age 2.

The legal guardian of the child, a resident of Louisiana, reportedly passed away in 2020 and whoever took custody of the child is not known. The family members of the child claim to have no knowledge of the child's whereabouts.

Anyone with information regarding Eriel Lynette Mack-Mariscal is asked to call Child Abuse detectives at 504-658-6045.


NEW ORLEANS — The New Orleans Police Department is asking for the public's help in an unusual missing child case.

NOPD is looking for any information about 8-year-old Eriel Lynette Mack-Mariscal. Police say Mack-Mariscal's legal guardian, a resident of Louisiana, reportedly passed away in 2020, and whoever took custody of the child is not known.

Details of Disappearance​

Eriel was last seen at the Children's Hospital & Care Center in New Orleans, Louisiana on July 30, 2019. She has never been heard from again. She may have had contact with someone in May 2020, but authorities were unable to verify this and the person who allegedly last saw her is now deceased.
A relative of Eriel's who lived in New Orleans was granted guardianship of her by the Washoe County Family Court in Reno, Nevada in 2018. The relative was instructed to file guardianship paperwork in Louisiana, but never did, and eventually stopped responding to court officials' requests.
In November 2021, the Washoe County Family Court hired a private investigator to look into the matter and find Eriel. Her guardian, and other members of her biological family, were interviewed, but all of them said they did not know her whereabouts. She was officially reported missing on December 9 that year.
The circumstances of Eriel's disappearance are unclear. Authorities will continue to search for her until they've verified her location and well-being.

Wow. NAMUS and The Charley Project both say she would currently be 5, but those news articles say 8. And everything lists her as white/caucasian, but the shared photo shows a child who has darker coloring than falls in the typical range for white children, IMO. Even if she is actually white, if she doesn’t look white and the last known photo of her is so old, it will be all the harder to locate/identify her.

And she was missing before her guardian died? Was there no criminal investigation when the legal guardian of an infant didn’t know where that infant was?
 
They need to find grounds to arrest the guardian until that person's memory magically improves. You don't get to be given custody of a precious child and then claim you don't know where they are.

The second (potential) guardian. Someone was appointed as a guardian in Nevada in 2018. This person never fully filed paperwork. In November 2021, this person was interviewed and did not know Eriel's whereabouts. This perspn was alive at least long enough to be interviewed as to where Eriel was.

I'm curious what motivated the bench warrant?

Based on this though, I'd guess that The Charley Project and NAMUS are incorrect: This case was filed 10/30/2018, and The Charley Project has her birthdate as 10/28/2018. If her date of last contact was in July 2019 as NAMUS and The Charley Project say, it wouldn't make sense for there to be a photo of her a year and a half later, and that is the only photo. I also think it'd be unusual for this to happen like this within two days of the child's birth

There is another case that may be related for Guardianship of a Minor (not ELMM, but possibly a sibling). That was filed in 3/18/2018, but a request for immediate temporary guardianship was denied 04/09/2018 and the case was closed (possibly dismissed) 06/04/2018.

No, we don’t sleuth or share social media for anyone who is not named a victim or a suspect. If there is social media for the deceased individual who reportedly last saw her, that might be allowed.
 
LSU's missing persons database, which is linked by NOPD News, has ELMM listed: Eriel Lynette Mack-Mariscal - LA Repository for Unidentified & Missing People It says "Fracture of left upper arm. Last confirmed contact with MP Eriel Mack-Mariscal was at the Children's hospital & Care Center in New Orleans."

If that fracture was on July 30, 2019 when she was at Children's Hospital & Care Center, I would have hoped that the hospital would have done a basic check against child abuse, and ideally have seen that whoever brought her in was not properly documented as her legal guardian, which should have triggered further investigation.

There seem to be failures at every level, and LE really needs to come out with something better about what they're doing to find this little girl.
 
A reporter at WWL TV is investigating and mentions the contradictions in the reports. She has asked New Orleans PD for clarification, but has not yet received a response.

In 2021, the Washoe County court told the guardian she needed to file more guardianship papers. The NOPD said she did not respond to the order. The court hired a private investigator who spoke with the guardian and other family members, who claimed: “to have no knowledge of the location of the missing juvenile.” Mack-Mariscal was formally reported missing shortly after.

In May of 2024, the NOPD issued another bulletin asking for any information on Eriel’s whereabouts. It also stated that the guardian died in 2020, though that appears to contradict the 2021 bulletin. WWL Louisiana asked the NOPD whether it was the same guardian and so far the NOPD has not clarified.

Based on the history of actions on the guardianship case posted up thread, I believe what is being miscommunicated is that DJ (now deceased) was originally being processed as EMM’s guardian back in 2018. There was a lot of paperwork being done and it appears that DJ may have been actively working with them to finalize guardianship through 2019. Communications continued to go out electronically through 2020 but DJ was no longer responding. An investigator was then added to the case. This was the first pandemic year for the US and discovering that DJ had died likely took time. I do not think that the reporters are correctly wording the actual circumstances. The investigator obviously did not interview DJ in2021 after her death and no other guardian had been appointed. I think the investigator likely discovered that DJ was no longer living and the mother who is listed in the guardianship papers (and therefore presumably still the legal guardian since guardianship had never been successfully transferred) said that she doesn’t know where EMM is.
