James Holmes, the 24-year-old former neuroscience graduate student who's been charged in the gruesome movie theater shooting in Aurora, Colo., last month, had asked a fellow graduate student about a mental condition called dysphoric mania weeks before the shooting, the New York Times reported.

DENVER -- In a phone conversation about accused murderer James Holmes, A University of Colorado police officer discussed putting Holmes on a mental health hold in June, but his psychiatrist, Dr. Lynne Fenton, declined, sources told CALL7 Investigator John Ferrugia.

But two days after Holmes' interview, neuroscience program director Daniel Tranel wrote a strongly worded email urging the admissions committee not to accept him to the school.

"James Holmes: Do NOT offer admission under any circumstances," wrote Tranel, a professor of neurology.

None of the documents further explain why Holmes' application was denied. University spokesman Tom Moore said Thursday that Holmes was academically qualified but officials did not see him as a "good personal fit for our program." He declined to elaborate.

Blumberg said in an email Thursday that he has no specific recollection of Holmes, noting officials interview many applicants each year. Tranel was not granting interview requests Thursday, a spokesman said.


A court hearing Thursday in Denver examined Holmes' relationship with University of Colorado psychiatrist Lynne Fenton, to whom he mailed a package containing a notebook that reportedly contained violent descriptions of an attack.

Fenton testified that she met with Holmes only once, on June 11, and that she believed their privileged relationship was limited to that day.

When Chief Deputy District Attorney Karen Pearson asked Fenton if she had a doctor-patient relationship with Holmes on July 19, when he mailed her the package, Fenton said, "I believe I did not."

Defense attorneys presented the judge a "client summary" that Fenton filled out after her meeting with Holmes. They argued the document was enough to establish that the confidential nature of her relationship with Holmes was ongoing.

Psychiatrist Dr. Lynn Fenton, who met with Holmes once previously, testified she could be reached at the number that Holmes dialed but said she was not aware Holmes had called the number before the attack.

Defense attorney Tamara Brady said that Holmes placed the call to the after-hours number at a hospital at the University of Colorado, Anschutz campus.

Fenton did not speak to Holmes on the phone.

Hospital marketing director Brad Fixler said the switchboard did receive a seven-second call at 12:31 a.m. on July 20, about eight minutes before 911 dispatchers began receiving calls about the shooting. But he said the caller hung up without saying anything.

"We did not receive any calls asking specifically for Dr. Fenton nor any other psychiatrist at our hospital," Fixler said.

During the hearing, the prosecution asked the judge to allow for more DNA samples along with fingerprints from Holmes. According to the prosecution, there is a palm print on the exit door of the theater they want to match.

The judge handing the James Holmes case has granted the prosecution's motion to add ten more charges and amend 16 other already existing counts....

The 16 other amended counts appear to have been amended to correct victims' names. The names have been redacted in the motion granting the amending charges and prosecutors will not say why because of the gag order in the case.

Holmes was wide-eyed and blinking and he twitched with a facial tick, 7NEWS reporter Marshall Zelinger reported from the courthouse. Later Thursday, a new mugshot of Holmes was released by the sheriff's office that showed a wide-eyed Holmes with short hair.

At times, Holmes looked out of the corner of his eye toward victims in the gallery and turned around to look at news reporters at the end of the hearing.

“FERPA does not protect Mr. Holmes’ application records because he did not matriculate here. In other words, FERPA only protects the records of students who enroll here, not those who only apply but did not enroll,” Moore said.

Like UI, none of the other schools included names of other prospective students. All of the schools included Holmes’ academic history, except the University of Kansas, which blacked out his Graduate Record Examinations results. Most of the disclosures include basic personal information, including Holmes’ home address, phone number and email address, but the University of Alabama and Birmingham removed those items. Texas A&M even included the family income range that Holmes listed.

Arapahoe County District Judge William B. Sylvester issued his order Tuesday. Prosecutors argued Thursday that they needed the print from 24-year-old James Holmes to compare with a print found on the inside of a theater exit door, as well as a DNA sample for comparing with other evidence collected by investigators.

In the filing, prosecutors assert that Holmes and Dr. Lynne Fenton ended their doctor-patient relationship after Holmes made threats to someone, who reported those threats to the CU police. Later in the filing, prosecutors appear to indicate that the person who contacted police was Fenton. In both cases, though, the name of the person contacting police is redacted.

ARAPAHOE COUNTY — Attorneys for Aurora theater shooting suspect James Holmes asked a judge Thursday to postpone a preliminary hearing scheduled next month.

Judge William Sylvester made no final decision and said the issue would be further discussed at the next hearing in the case, scheduled Oct. 25.

Family of Aurora theater shooting victim files suit against Cinemark

The family of AJ Boik, one of 12 people killed in the Aurora theater shooting, have filed a lawsuit against Cinemark, claiming the theater company was negligent in failing to provide adequate security the night of the shooting.

This CNN article is a bit older but I hadn't seen the info on the Univ. of Iowa in any other articles and found it interesting.

Fenton testified that Holmes' defense team contacted her after the shooting and asked that she send the notebook back to Holmes via them.

In 2011, the University of Iowa rejected Holmes' graduate application, with one official saying "Do NOT offer admissions under any circumstances," according to documents obtained by CNN.

A second university official agreed not to make the recommendation for Holmes' admittance.

After graduating high school in 2006, Holmes studied neuroscience at the University of California at Riverside where he lived in typical dorm settings. In the apartment complex where he lived, students who were there during Holmes' time don't recall him.

While numerous students and staff told 9Wants to Know they clearly know the name and Holmes' ties to the university, no clear recollections of him emerged.

9Wants to Know spent a significant amount of time looking for students and staff in the Biological Sciences building who would have likely interacted with the suspect. Nobody remembered Holmes. Not even students who graduated the same year.

One faculty member said a professor who did know Holmes and wrote him a recommendation letter is under a gag-order.
