IMHO, we can't assume that DM killed LB right away. He may have drugged her up, gagged her, tied her up. DM and MS are very sick people. They're sitting there knowing EXACTLY what they did to LB. There'll be a special place in Hell for the two of them when they finally die in prison. MOO

Agreed. If DM killed LB shortly after he picked her up, why wait until the next morning to take her body to the farm? He could've killed her, brought her body to his farm, and been back home by 10pm. Instead, there is some kind of all-nighter type event that required ordering a new bed the next day.

It's true that LB's phone was never used after 7:03pm and DM went on a suspicious 1 hour mission from 7:20-8:20pm. But then there's a strange silence from both DM and MS until almost 1am. IMO this is when DM and MS carried out the "hurt" phase of their plan to hurt, remove, and eliminate LB.
 
With all the money to be made in the "Escort" business, I am surprised DM did not take the opportunity to get involved somehow.
 
On July 12, Code says, a calendar entry is made on Millard's iPhone stating "barn smell check."

In other texts from July 21, Millard says to Smich, "Tomorrow after dark, BBQ mission (I don't want Marlena there for that though, think on it)." Smich responds, "I don't think taking Marlena will be a problem. She can wait in the front while we r out back talkin to that girl. If u know what I mean."

Now Code is running through the events from July 23 to 24. He calls this a "critically important time," as it relates to the allegations of the incinerator being used.

Millard texts Smich that afternoon and says, "bbq has run its warm up, it's ready for meat." Code tells the jury to consider that text in the context of what the intent for the incinerator was.

"Mr. Millard stored a screen capture of this search result in the Dells Hard" folder of his office computer. Some 36 minutes later, at 11:14 p.m., three photos are taken by Mr. Millard's iPhone depicting Mr. Smich standing in front of The Eliminator, and standing in front of the airport hangar, holding what appears to be the long metal rake or ash scraper from The Eliminator. Just over an hour later, at 11:20 p.m., two photos are taken by Mr. Millard's iPhone of certain objects burning inside The Eliminator."

He kept it because he seemed to get off on killing people. Another trophy like TB’s keys on his key chain and his truck in his hanger and then in his trailer in his Moms drive away.

On Oct. 13, 2012, Smich texting Millard saying "you still gotta keep everything on the low. Cuz ppl kno to much." On Nov. 6, Millard texts Smich saying, "some people already know too much, can't talk about that real life ****."

Code is also talking about how Sgt. Falconer testified that the forensics software he used could not recover all of the deleted text messages on the devices he had. Some of them were between Millard and Babcock, and some were between Millard and Ward-Jackson.

Code now also bringing up how in his cross-examination of Falconer, Millard put to him several photos that he had altered in Photoshop.

Code also says "Neither the metadata nor the date and timestamps indicated any of the signs or indicia that he would expect to see if there had been some kind of manipulation, alteration or Photoshopping of these texts or images."

Justice Code said that DM did the search, however this does not mean that DM asked the cremation temperature question. The image in evidence shows a Question and Answer, the question appears to have been asked by someone else online. So DM executed the search, then found the Q&A already posted online, and simply did a screen-shot to retain.

That way, the question couldn't be linked back to him by the police... but .. he kept the screenshot....ooooops.

I don't buy it. Millard leaves for an hour and takes LBs phone, in my opinion he's clearing his head. She's already dead. He comes back at 8:20. Smich texts Millard at around 12:40 asking what he's up to. So obviously Smich wasn't with Millard just prior to that. So the amount of time Millard has to get his act together is between say 8:20 and 11:40, just over three hours. In that time he has got to wrap the body, presumably in bedsheets and move it to the van. He probably attempts to deal with the mess on the mattress, and go through the loot. Those three hours would go quick. IMO it is more likely LB was killed in those 13 minutes between 7:13 when Millard finishes a 6 minute phone call and 7:26 when Millard abruptly leaves.
 
"Mr. Ward-Jackson could not assist in explaining the subject matter of these missing text messages," Code says. <-- why would they even ask him about messages between DM and LB phones?

The following clarifies the unrecoverable messages were not from MWJ to LB, but were multiple messages, from MWJ - DM, and from DM to LB

We're thinking that DM was only gone from 7:20-8:20pm based on the cell pings? What time did the pings show him back at Maplegate? Wasn't it around 7:30pm when he texted MS that there was something left for him at the top of the stairs? Was DM still home at that time?
 
Code asks the jury if they're okay with carrying on a little longer before a break. They nod yes, but a few of them are starting to look a little bleary-eyed this afternoon. More than one juror has been rubbing their eyes, while another has been fanning herself with her notes quite a bit.

Code is now talking about the police search of Millard's farm property, where both incinerators were discovered. The Eliminator was in the treeline, while the homemade one was in the barn.

Code is now telling the jury to look at photos of the inside The Eliminator, and to see if it resembles "ashy stone" as depicted in Smich's rap. "Also consider whether a human body would or would not fit in The Eliminator," he says, noting there is a photo of Dr. Tracy Rogers standing inside the main chamber.

He also had to deal with disposing of his old mattress, sheets, etc. That was probably one of the "missions" he was on that night; he probably took the mattress away from home and burned it or dumped it somewhere. The clean-up probably took a good chunk of his night, so he probably didn't get around to moving her body until the morning.

Yes, the "present at the top of the stairs" text to Smich was 7:26PM.

Just because LB didn't use her phone during that time, didn't mean that she didn't have it with her in a purse or something and didn't receive a call or text so she didn't use the phone.

I think she was killed during a sexual encounter with DM, fueled by drugs, later in the evening. But of course that's just one of many possibilities here.

Think he kept stuff because he was careless. He just didn't think he'd ever get caught. If he was in the slightest bit worried he could have just zeroed his phone and Smich's. Nope, he was just smarter than everybody else. And the motive? I'd suggest it was more likely to be the $3K that LB was carrying with her more than the love triangle. It was win win for Millard, girlfriend is happy AND he scores some loot.

Just don't see LB not touching her phone during an hour long drive. And this time there is no warning to Smich to not be outside when he gets home. No texts from Isho about meeting, so I doubt that was it.

I agree that he left a huge evidence trail because he was careless and arrogant.

I don't think the $3k was a motive though, since he appears to have planned to kill LB long before July 3.

I do though think that it was an added bonus.

I thought he was communicating with MWJ about getting "domes" that night? And when were the unrecoverable text messages between him and MWJ?

LB was really into DM. Pretty sure once she was with him, she wouldn't have been contacting other people while in his presence. Unless someone contacted her via text or phone call, which according to her records, it appears that no one did.
