Because a loophole in Alabama law allows it, in that local law is not in harmony with state law.

I don't think this loophole is limited to AL State (where Municipal courts are those created by cities and towns, and hear misdemeanors and infractions), some that conduct jury trials (often limiting juror count), and some not allow jury trials.

I'm afraid had this not been such a high-profile case, I think the Municipal Court could have easily called on Act 2013-353 and 2013-361, which provide enabling authority for the creation of pre-trial diversion programs in state as well as municipal courts in Alabama. Under the Act, any pretrial diversion program established pursuant to this article must be under the supervision of the presiding judge for the municipality pursuant to any rules and regulations established by the municipal governing body. IMO, more reason to seek state legislation to make a hoax a serious offense.

I might be in the minority , but IMO, if she had any remorse, she would come clean and confess as to where she was and what she was doing while LE and concerned citizens were out searching for her. I don’t deserve to know, but they do.

She’s showed her true colors by saying nothing and continuing to be the spoiled brat that she is. She needs to spend jail time. Though I’m sure not holding my breath.

Clearly, CR knew she'd be moving her case from a Court of Limited Jurisdiction to a jury trial and heeded the advice of her lawyer to remain silent (or risk anything she said to be used against her). And this would apply whether she talked to authorities, MSM, or social media -- it could all come in as evidence. IMO, it's remaining silent that's probably been the punishment here. I think she's dying to do the media circuit to garner SM followers, and probably land a reality show! JMO

Regarding her silence about where she was during her "kidnapping", I think there's a reason that she doesn't want the public to know where she was. I don't for a minute think that she was suffering, in the woods, in an abandoned home, I think she was quite comfortable. This blew up on her and she didn't expect it. I don't think she wants to tell her story, she just wants it to go away and be forgotten. If the truth could help her, her attorney would have shared it by now. All JMO.

She seemed, after all, to be crafting an attention-getting image and an attention-getting, fabricated tale of woe.

Now she has attention and I hope she hates it.

I would like to see the courts request a mandatory psych eval. I wanna know why she lied. Is she attention seeking or something more? Histrionic Personality Disorder or?
Is it something she can control or is impulsive? Ultimately the goal would be for her NOT to do this ever again and correct her ways.
 
Just listened to the 911 Call by CR (Crime Stories w/NG) reporting the toddler on the Interstate and when Police arrived at the scene, they only found CR's Mercedes-- unlocked, with the engine running. CR left all of her personal belongings in the vehicle except for her phone.

This woman was in her right mind -- no distress in her voice reporting the wandering child. CR essentially responded to questions asked by the Dispatcher versus reporting an emergency situation to authorities.

This type of hoax needs a different crime classification than Misdemeanor. :mad:

This may not be the end of Russell’s charges. We also learned prosecutors have empaneled a grand jury in this case.

“You will have to talk with the great attorney general’s office about [forthcoming charges],” added Anthony. “I don’t know. We were invited to talk to the grand jury. We turned that down. We don’t need to put her before someone when we are dealing with this right now.”

The Attorney General’s Office declined to comment.

Anthony admitted Russell was nervous about the hearing, stating she knows she made a mistake.

“She understands what’s happened, she’s apologized for what transpired,” Anthony answered. “I don’t want to her to have any type of breakdown. We are handling her with kid gloves.”

To date, investigators admit they still don’t know Russell’s whereabouts during the 49 hours she was missing. Appealing the case to circuit court will force the state to put on evidence and witnesses to prove their case and show why they’re recommending a custodial sentence. They will also need to prove why they’re seeking more than $17,000 dollars in restitution.

“Eventually you will find out the why of it,” Anthony said, eluding to possible evidence that may come out in court. “You can stop saying she was out 48 hours with some guy, you can stop saying she was out at the Red Roof Inn.”

The defense has fourteen days to file an appeal.

They don’t want her to have a meltdown and are treating her with kid gloves. I don’t know whether to say we need to be respectful of someone with issues or let her have it. I think the latter. She planned what she did without a single thought as to what would happen to anyone related to the incident - first responders, searchers, her family, etc. She apparently didn’t give a darn as to what would even happen to her $$$$$ car Daddy paid for. Someone could have easily hit it, totaled it, and been injured. This is such a ridiculous comment for them to make. Oh poor Carlee. (Sarcasm)
 
I think if she'd stayed in someone's empty house, or a real estate property that was vacant aka waiting for a new owner--- that should be considered breaking & entering !

I really wish we knew what happened. I still do not see her running, in the dark without her cell phone for light, into the trees and bushes, stumbling along, finding that drainage “path”, perhaps climbing through a gap in that fence, and so on. All by herself in the dark? Um… no. Just no. Even if she acted alone and had practiced it. No way.
