A photo image /evidence that MC was HIT is missing. It was claimed to be deleted but at this point may never have existed. If you are hurt by someone, first thing you do is document it. Quentin C says he saw it was red/swollen. Ok. No one told her to make sure she saved the pic? And she deleted it.. it doesn't add up. This interaction is what started it ALL and why Dante and Tony pounced on an old, unfit, confused looking old man.

MC's testimony was never shared publicly, not even a transcript. There were so many holes/inconsistencies in the stories of the Carlson party and the Teens, imo. Would love to hear her version of events, are they as wildly spectacular? (She's the one who stomped over and just started railing on NM, knowing nothing of the situation.... she just decided to add to the anger and tension/create a mob mentality)

So... first degree intentional Homicide? That's a reach, based on the evidence we've seen.

• Owen Peloquin, who was part of Isaac Schuman’s tubing group, described their initial encounter with Nicolae Miu on the Apple River that day. He recalled first Miu “standing really weirdly” with a snorkel in “ankle-high” water, then said Miu “weirdly sprinted at us”
  
  • The State then played a snippet of Jawahn Cockfield’s video, where Miu can be seen making contact with the group while lunging for what appears to be a snorkel or goggles in the water. As he did so, one teen can be heard asking, “what is he on?” and as Peloquin says to Miu to “get away”

APPLE RIVER STABBING TRIAL: Asked why he approached Isaac Schuman & teenage tubers, Miu said he saw group w/ a phone he thought might be the missing phone he was searching for... He testified, he then stumbled on rocks just as he was trying to get closer look at the phone.

Prosecution failed to provide any evidence that NM threw the first punch. Strange that of all the witnesses, MC is the one who elected not to testify on camera and not to have her testimony heard.

Court TV purports to have a written transcript of her testimony, however, wherein she stated that NM hit her with his left hand on her left cheek. When it was explained to her that was physically impossible she then stated that she gets her left and right mixed up!

ETA: The investigator who spoke to MC after the incident saw no marks on her face.

Teenagers started this w/the "looking for little girls" nonsense, MC and RM escalated it by getting in his face and ordering him to leave, then DC sent things through the roof once he started punching NM. Nobody tried to defuse the situation at all.

HUDSON, Wis — The homicide trial of Nicolae Miu could see its most dramatic moment Tuesday as prosecutors are expected to wrap their case, opening the door for the defendant to take the stand in his own defense.

Miu, 54, is charged with one count of first-degree intentional homicide and four counts of attempted first-degree intentional homicide for a deadly stabbing spree that took place on the Apple River on July 30, 2022. Prosecutors say Miu pulled a knife during a confrontation with people from two separate groups, fatally stabbing 17-year-old Isaac Schuman of Stillwater and wounding four others, one of those victims nearly dying as well.

Miu's legal team calls the explosion of violence a clear case of self-defense, saying Miu was surrounded by more than a dozen people who were screaming, taunting, and physically attacking him.

After waiving his right to remain silent, Nicolae Miu took the stand to defend himself against charges of first-degree homicide and attempted first-degree homicide.

Attorney Aaron Nelson opened the defense's case by showing an image of two women confronting Miu on the Apple River on July 30, 2022. Miu, noticeably thinner than he was on video and in photos from that day, described how Madison Coen and Ryhley Mattison were yelling at him before getting physical. He said the women put their hands on him, squeezing his arm and pushing him, recalling that the yelling was very loud and his heart rate began climbing. Miu said he started developing what he called "tunnel vision," and voices became garbled and unintelligible.

11:10 a.m. - Nicolae Miu is testifying in his own defense ​

The defense is questioning Miu in his own defense. He shared he was in bad health on the day he was tubing down the river, having had bypass surgery previously. He described his fitness on July 30, 2022, as "very poor." Miu broke down in tears talking about his dog, "his baby … his angel."

He testified Ernesto Torres Chaguez called him the morning of July 30, 2022, to bring a pocketknife to the river to cut the string that is used to tie the tubes together. At some point on the river that day, Miu testified he volunteered to look for Ariel Chaguez Leyet's phone that had gone missing in the river — he brought his snorkel and goggles with him, along with his pocketknife. Miu admitted to lying to Hart in the interrogation video about not having a knife with him. But he said he did not have the intent to harm anyone — he only left his group to look for the phone.

NM testified that his level of fear was at a 2 and that was about a second prior to reaching for his knife.

No, not in any way. However, the Carlson group's arrival with physical attacks did IMO.

NM's description of the sort of catalyst moment after which everything went off:

"He said the women put their hands on him, squeezing his arm and pushing him, recalling that the yelling was very loud..."
"When Nelson asked him what happened next, Miu said he used his left hand and 'pushed her away from my face,' insisting he didn't intend to harm Mattison or injure her in any manner."

We do not have MC's testimony of that same catalyst moment, but IMO NM's description is plausible with what is seen in the video. In particular, it seems more plausible to me than the idea that NM held a knife in his right hand (is he right-handed?) then punched the glasses off of MC's face with his left hand. But less-plausible and implausible things can still be the truth.

I'm finding him very believable. I didn't realize the quadruple bypass was as recent as it had been. I think when it was spoken of before, they were using current dates. Seems like things absolutely got worse with MC and she was the first to make it physical. And i'm not surprised after watching her in the video. Find it also very telling she is the only one that didn't want her audio OR visual testimony seen/heard.
