That is my understanding as well. So, I am sure the State considered the family in their decision. I just disagree with the decision because I do not believe that the results produce the best outcome for the victims, or all of humanity for that matter. But dang if this case doesn't challenge...

If evidence is "mishandled" in any way...on any case..it will always have an impact on the side that relies on the strength (or weakness) of the evidence. In this case, the benefit on appeal will be in favor of the defense. Unfortunately. I don't think it will be a smoking gun that changes...
