In DC it's a bit different in that in addition to the PDs office there are criminal defense attorneys who essentially sign-up on any given day and are assigned clients who are arraigned that particular day who do not have an attorney already. The courts simply go down the list as each case comes...

That also means that the Misfits likely would have known LE was at the car without needing to get close to where the Kia was. They could be on one of the little roads running parallel to 95 and be far enough away that no one would even notice even if they drove that section multiple times.

I think we may see a lot of very questionable defense arguments that try to absolve one or all of guilt and/or place the blame elsewhere. I don't think anything they can come up with will change anyone's opinion given the facts already known, but it's always possible.
