I think the atty for the suing party issues a summons and then a process server serves it to the parties being sued. JMO

I don't know if Mr. Plesea has insurance or funds to pay for his care, but if it is being paid by Medicare, I understand that the residence that one has will be used to offset the cost of that care upon the death of the spouse that has been living in the home. JMO
