The state wants to prevent Drew Peterson from getting police information to use as evidence in the court proceedings involving a felony gun charge filed against him.

Will County Assistant State's Attorney Domenica Osterberger asked a judge June 13 to quash Peterson's subpoena.

Drew Peterson’s teen son testifies before grand jury

"Drew Peterson’s teenage son by Kathleen Savio testified before the grand jury Thursday.

Dressed in a suit and tie, Thomas Peterson, 15, left the Will County Court Annex building at about 4:15 p.m. in a red Mercedes driven by his attorney Robert Novelle.

Although the boy was not available to speak to reporters, his father lambasted authorities for putting a teen through the grand jury process.

“That’s grueling for an adult let alone a 15-year-old kid,” Drew Peterson said shortly after his son returned home from hours of testimony in front of the grand jury investigating his mom’s death and his step-mom’s disappearance.

Peterson said he hired Novelle to represent his two teen sons to “protect them from the state police.”

Police interviewed both boys in November at the Will County Children’s Advocacy Center. Peterson said he had brokered a deal with the state to allow the interviews in return for a promise to keep them out of the grand jury process.

“Well, they lied,” Peterson said.

Shortly after the testimony, police subpoenaed both boys to testify before the grand jury. Novelle then filed a motion to quash the subpoenas served to Thomas Peterson and his brother Kristopher, 13."

When it comes to friends and enemies, Drew Peterson can count the Internet among the latter.

Two separate allegations in as many weeks against the former police sergeant have created a tsunami in the blogosphere, first with reports that Peterson exchanged flirtatious online chats and e-mails with an unknown woman and then with a true crime author alleging Peterson asked him to write a book pinning his third wife’s homicide on his missing fourth wife.

"CHICAGO (WBBM) -- While the search for Stacy Peterson continues, Drew Peterson has been busy exchanging romantic e-mails on a chat room claiming he is going to be set up with a disgraced pop star.

The series of e-mails made public between Peterson and a woman named Ashley begin in March...with Peterson writing "How much broken glass do I need to crawl through to get a date with you?"

Ashley writes "a date? When and where?"

In April he writes, "Guess who I might get a date with as a publicity stunt? Britney Spears...a night on the town in Chicago."

Peterson's publicist Glen Selig says that Peterson did exchange emails with the woman, but says it was all innocent flirting and the in the end Ashley wanted more -- which Drew couldn't give her."

Friends and family of missing Bolingbrook woman Stacy Peterson rejoiced after state lawmakers Thursday sent to the governor's desk legislation that could affect the possible prosecution of the chief suspect in her disappearance, her husband, Drew.

"It's a good Stacy day today," said her close friend Sharon Bychowski. "Now Stacy's life has more meaning than it did."

Prosecutors pulled Drew Peterson's second teenage son in front of the grand jury Thursday, and the experience left the youth feeling sick.
"I've got a headache," Peterson's 13-year-old son, Kristopher, said upon returning home from his long appearance before the grand jury. When asked by his father if he told the truth at the hearing, Kristopher nodded.

The State Police have named Peterson a suspect in Stacy's disappearance and have classified the case a "potential homicide."

Drew Peterson's third wife has been silent for four years, and his fourth wife has not been heard from in nine months.

A bill on the governor's desk could allow them to speak.
It would give a judge the authority to allow hearsay evidence at a criminal trial passed through both the state House and Senate and is now waiting for the governor's signature.

Pelkie would not say if the hearsay bill now on the governor's desk was drafted with Peterson in mind.

"(Glasgow) can't comment on a specific case," he said.

Peterson's attorney, Joel Brodsky, contends the proposed law has no bearing on any potential murder case against his client, and he cited Giles v. California, the same case Glasgow went to Washington to hear.

"Because of the Giles case, the new hearsay law does not make a whit of difference," Brodsky said.

Judge Richard Schoenstedt said Monday he would rule on July 30 on a motion to dismiss weapons charges against former Bolingbrook Police officer Drew Peterson.

In May, Peterson, whose fourth wife Stacy disappeared Oct. 28, was charged with unlawful use of a weapon for possessing a short-barreled assault rifle. Subsequently, a grand jury indicted him on the charges.

Peterson's attorney, Joel Brodsky, has asked the court to dismiss the charges because, as a former police officer, Peterson is exempt from such restrictions.

JOLIET, Ill. - A Will County judge modified Drew Peterson's bond Monday, allowing him to leave Illinois on vacation with his children while the judge mulls a defense motion to dismiss felony weapons charges.

But other friends of Peterson, Len Wawczak and his wife, Paula Stark, say Peterson signed the folding gun over to Paula Stark the day after the State Police pulled Peterson's firearm owner's identification card.

Stark and Wawczak made the admission after being confronted with a State Police evidence receipt for a Ruger .357 Magnum revolver and a North American Arms .22-caliber revolver seized from their home March 19. Stark's name is on the receipt.

The couple said the .22 is the folding gun Mims spoke of on the "Nancy Grace" show.

May, the lawyers representing Drew Peterson and his uncle asked a Will County judge to stop the court proceedings in Kathleen Savio’s newly reopened probate case until a later date.

Around 3 p.m. Wednesday, they changed their minds.

A wrongful death lawsuit would give him the opportunity to depose — or question — the state police and others to find out what they know.

“It would almost be like a private grand jury,” Brodsky said.

"Lawyers representing the estate of Drew Peterson's third wife are now free to file a wrongful-death lawsuit against Peterson after his attorneys withdrew a motion Thursday that sought to block them.

But attorneys for Kathleen Savio's estate said that a wrongful-death lawsuit against the former Bolingbrook police sergeant likely won't be initiated until after the grand jury investigating Savio's death was discharged.

"That's something we'll have to look at," said John Q. Kelly, a New York attorney representing the Savio family."

"Joel Brodsky, one of Peterson's attorneys, said he withdrew his motion to delay the court proceedings to reopen Savio's estate because he expects the Illinois Appellate Court to make its decision in the next couple of months.

And besides, he said, if Savio's attorneys file a wrongful-death lawsuit, he'll have subpoena powers to interview grand jury witnesses."

Peterson lawyer says couple lied about wearing wires

Friends reportedly recorded talks with ex-cop after disappearance of Stacy Peterson

A Bolingbrook couple who said in a published report that they had secretly recorded for police their conversations with Drew Peterson made up the story after a falling-out with Peterson over money, his attorney said Wednesday morning.

"No way this happened," attorney Joel Brodsky said in an interview with WGN-Ch. 9, referring to the reported wires worn by Len Wawczak and Paula Stark, who have been friends of Peterson's for years.

In addition, there is "no way" that Illinois State Police and prosecutors would allow undercover witnesses to talk to the news media, Brodsky said, adding that if indeed there are tapes, he might have a legal basis for having them excluded from any future trial because their existence had not been disclosed to Peterson.

Brodsky said Peterson also was confident that he had said nothing incriminating to the couple and asserted that any tapes would prove his innocence.

As CBS 2's Joanie Lum reports, Peterson attorney Joel Brodsky said the couple just wants to "sell their story," and that they are trying to extort money from his client. Brodsky also questions why the sensitive information they claim to possess would be released now.
