ENHANCED PUNISHMENT FOR KIDNAPPING INVOLVING A MINOR

The Federal kidnapping crime provide special rules for offenses involving children. Where the victim is under the age of 18 and the offender has obtained the age of 18 and is not apparent grandparents brother sister aunt uncle or person having legal custody sentencing levels are increased to reflect the severity of the offense.

Under 18 U.S.C. § 1201(b) there is a presumption that if the defendant fails to release the victim within 24 hours after they are illegally seized, confined, or kidnapped there is a rebuttable presumption that the person has been transported in interstate or foreign commerce. This presumption was placed in the law to allow the FBI to be come involved in cases where a missing person has been missing for at least 24 hours.

Thank you! I was aware that FBI becomes involved in missing children's cases seemingly overnight and now I know that it's tied to the federal statute above (i.e., illegally seized, confined, or kidnapped -- and the presumption that the person transported in interstate or foreign commerce).

Honoring Kamille “Cupcake” McKinney in Birmingham

Thursday, October 22 is the one-year anniversary of the heartbreaking, tragic news that the body of 3-year-old Kamille “Cupcake” McKinney was discovered. She was taken ten days earlier on October 12, 2019.

On this anniversary the Birmingham City Council and President William Parker have partnered with the organization Angels Arms Operation Exploited and Missing Persons for the first annual “Never Again” Memorial and Tribute for Cupcake.

The event will take place this Thursday at Tom Brown Village Community Center (555 41st Place North, Birmingham, AL 35222) from 5:30 p.m. to 6:30 p.m. and will feature guest speakers, a school supply giveaway and more.

The case has been bound over to the grand jury. Jefferson County District Attorney Danny Carr said the grand jury was still operational despite the pandemic.

The last movement in the case happened Tuesday, Oct 6. According to court documents, Stallworth’s attorney, Roderick Livingston, was allowed to withdraw himself from the case because he was hired by the public defender’s office that represents Brown.

A Jefferson County grand jury indicted Patrick Stallworth, 40, and Derick Irisha Brown, 30, on capital murder of a child under the age of 14 and capital murder during a kidnapping in the slaying of 3-year-old Kamille “Cupcake” McKinney. The indictments were issued following the December 2020 grand jury session.

The pair also has been indicted federally of kidnapping and one count of conspiracy to kidnap a minor. They could face the death penalty in both state and federal court if convicted. The U.S. Attorney General has not yet announced whether the death penalty will be sought on the federal charges.

A Jefferson County grand jury in December indicted Patrick Stallworth and Derick Irisha Brown on capital murder of a child under the age of 14 and capital murder of a child during a kidnapping. Those are state charges.

Stallworth and Brown have also been indicted on one count of kidnapping and one count of conspiracy to kidnap a minor. Those are federal charges.

The state charges come after the pair were indicted federally with kidnap by a grand jury in July. In August they were arraigned and pleaded not guilty.

On Tuesday afternoon Jefferson County Judge Clyde Jones set a March 31 date for a pre-trial hearing.

Thanks, @PommyMommy for the added clarification. It's a shame this case can't be fast-tracked together with both state and federal charges, and/or that it took so long for the state to indict these evildoers.

I agree! It may take a bit longer since our state is being hit pretty hard by Covid right now too, but hopefully justice will come for Cupcake sooner rather than later!

Birmingham Housing Authority to spend $6M on upgraded security at its sites | The Birmingham Times
The Housing Authority of the Birmingham District (HABD) has earmarked $6 million to make security upgrades in its public housing sites.

Several children have lost lives in public housing over the past 24 months including four-year-old Jurnee Coleman; three-year-old Kamille ‘Cupcake’ McKinney, and two-year-old Major Turner.

Tuesday marks two years since 3-year-old Kamille “Cupcake” McKinney was kidnapped during a birthday party in Birmingham. Ten days later, her body was found in a dumpster.

Online court records show Patrick Devone Stallworth and Derick Irisha Brown are due in Jefferson County Circuit Court in February 2022 for a pretrial hearing.
