Judge adds suspect Derick Brown to McKinney case gag order
Special District Judge Clyde E. Jones signed an order Tuesday amending a previous gag order, adding suspect Derick Irisha Brown.

Brown will not be able to make any public statements concerning the Kamille “Cupcake” McKinney case. In the order, it states that this decision will not include or relate to statements by the defendant to her attorney(s).

Family mourns death of Kamille ‘Cupcake’ McKinney through holidays
For the first time since Kamille “Cupcake” McKinney passed away, her family is speaking out.

ST, Cupcake’s grandmother, said she’s holding onto the precious memories of their angel and that the love for her will never go away.

ST said she’s not too sure about Thanksgiving plans this year. Yet, in the face of all that pain in a season when seemingly everyone else is holly, she relies on her faith and still gives thanks to the city of Birmingham, and even the country, for their support.

In the spirit of love and charity, the Evelyn S. Hardy Men of Distinction Male Chorus of Sixth Avenue Baptist Church presented a love offering of song and a Thanksgiving basket to the family of Kamille “Cupcake” McKinney.

VS, director of male chorus for the church, said when the attention fades, families who experience a sudden loss like McKinney’s family often feel forgotten and wanted the McKinney family to know that they’re still praying for them as “Cupcake” will never be forgotten.

“We also want to know that we’re thinking of them during this time of the year and that we’re going to be there for them,” he said.

The presentation was held at the home of Kamille’s grandmother house.

Patrick Stallworth capital murder case headed to grand jury
  • Judge Jones ruled that he has found enough probable cause to send the capital murder case of Patrick Stallworth to a grand jury.
  • Levels of meth and trazodone were ingested into KM's body which sat in a construction dumpster at a Center Point apt complex for ten days.
  • The DNA of Stallworth, Brown and KM was found in blood stains on a plastic sheet around a mattress laying in the living room of Brown's apartment.
  • Detective Jonathan Ross testified that Stallworth bought nearly $20 worth of candy from a gas station minutes before approaching teens looking for a girl near Tom Brown Village the day of Cupcake's disappearance.
  • Stallworth originally lied about knowing anything about KM's disappearance.
  • After her body was found, he admitted to offering children candy at the Tom Brown Village the night she vanished and his account of watching KM die.
  • After returning to Brown's apartment, Ross said Stallworth told them he first saw the child with Brown on the couch watching television.

Testimony: Drugs found in Kamille McKinney’s decomposed body

Testimony and questioning by Stallworth’s defense attorney, Derrick Collins, indicated Stallworth has told detectives he had nothing to do with the abduction or killing of Kamille.

Instead, Stallworth’s attorney indicated, Brown was solely responsible and Stallworth lied because of his love for Brown. Collins has previously said Brown has made statements implicating Stallworth and it was disclosed Tuesday that it was Brown who told detectives where Kamille’s remains could be found.

Five minutes after buying the candy, two preteen girls were leaving cheerleading practice from Hayes K-8 when the two approached them in a blue SUV, Ross said. One of the girls, age 11, reported Stallworth told her, "I’m looking for a girl that looks like you,'' Ross testified.

The girls said the man offered them candy. They became apprehensive and the other girl said, “Let’s go.” There was security video from Hayes to back up their story, but it was not close enough to show the occupants. The girls described the female with the male as “dark-skinned” and “chunky.”

Other children told police a man in a vehicle that matched Stallworth’s SUV was giving out candy in the housing community, and said eventually Kamille got into the vehicle with them. “She was crying,” Ross testified a 10-year-old boy told him.

… Phone records put Stallworth at Tom Brown Village at the time of the abduction, and it was Stallworth who had a prescription for Trazodone. Also on the night of the abduction, testimony showed, Stallworth went to a convenience store near his home to buy an energy drink and a pill for erectile dysfunction.

New details emerge about kidnapping, killing of Kamille "Cupcake" McKinney

BIRMINGHAM, Ala. —

A Jefferson County Circuit Court judge on Tuesday ruled he has found enough probable cause to send the capital murder case of Patrick Stallworth, the man accused of kidnapping and killing 3-year-old Kamille "Cupcake" McKinney, to a grand jury.

Prosecutors said the DNA of Stallworth, Brown and McKinney was found in blood stains on a plastic sheet around a mattress laying in the living room of Brown's apartment.

[Detective] Ross admitted that Brown's hints of McKinney's body being left in a nearby dumpster helped a specialized FBI unit to find her remains after emptying a large construction trash bin out in a Jefferson County landfill.

According to Ross, Stallworth originally lied about knowing anything about McKinney's disappearance.

However, after her body was found, he admitted to offering children candy at the Tom Brown Village the night she vanished and his chilling account of watching the young girl die.

After returning to Brown's apartment, Ross said Stallworth told them he first saw the child with Brown on the couch watching television.

Ross also testified that Stallworth's DNA was not found on McKinney's body.

Meth, sedative found in Kamille ‘Cupcake’ McKinney’s body, court testimony reveals

According to the prosecution’s argument, the evidence reveals Stallworth and Brown were together for the entirety of the Saturday McKinney disappeared. They say, around noon that day near Tom Brown Village, Stallworth and Brown offered candy to middle school girls. Surveillance video shows Stallworth purchasing candy at a Shell station near Tom Brown just minutes before interacting with the girls. Surveillance video from a Center Point Parkway gas station also shows Stallworth purchasing a pill for erectile dysfunction and an energy drink later that night. Prosecutors said phone records substantiate Stallworth’s admission that he was at the Tom Brown Village on Oct. 12. Stallworth admitted to giving children candy at the housing authority, prosecutors said. The prosecution also pointed to a video from a Tom Brown resident showing an interaction between a man and children, who then follow him off-camera.

During lead homicide Detective Jonathan Ross’ testimony Tuesday, he said children told Birmingham police investigators they saw McKinney get into a vehicle matching the description of Stallworth’s SUV. The children said the driver had been handing out candy at Tom Brown Village, Ross testified.

Parents of slain children mourn 5-year-old’s slaying

Three children under the age of six have died in violence in a span of less than six months in Birmingham, and the parents of those lost are pleading for it to stop.

According to the defense, there was no DNA evidence of a sexual assault and no indication that she was killed or abducted by Stallworth. The defense claims he went to sleep at his apartment and upon waking, saw Brown and McKinney on the couch. Stallworth then told Brown to take McKinney back home before he fell asleep again, the defense said. According to the defense, when Stallworth woke up, Brown was next to him in bed, and there was no sign of the child.

Prosecutors said Stallworth was interviewed multiple times and denied knowing anything about McKinney. After her body was found, he told investigators a different story. His defense says he lied in earlier interviews because “he loved Brown.” The defense says Stallworth’s presence at his apartment is not evidence of a crime and that it was Brown who told investigators where to find McKinney’s body.

On Friday, suspect Derick Irisha Brown appeared in court after being charged with capital murder for the death of Kamille “Cupcake” McKinney, a Birmingham 3-year-old.

In Patrick Stallworth’s court appearance earlier this week, prosecutors argued that Brown was with Stallworth for the entirety of the Saturday McKinney disappeared. Prosecutors say that on that day around noon, Brown and Stallworth were seen offering candy to middle school girls near the Tom Brown Village housing community.

In Stallworth’s court appearance, prosecutors said that there was evidence of a mattress inside the suspects’ apartment indicating a mixture of blood and DNA from Brown, Stallworth and McKinney. His defense team argued Stallworth was asleep for much of the time McKinney was at their apartment.

During Brown’s court appearance, Birmingham Police Detective Jonathan Ross said Brown testified in an interview that she saw Patrick Stallworth sexually assault McKinney in their apartment.

Brown’s defense claims within the FBI DNA report it was noted that Stallworth’s DNA was found on Cupcake’s fingernails and Brown’s was not. Brown’s defense provided a jail photo in which a small scratch is visible on Stallworth’s torso.
