The trial of Casey Anthony, who is charged with murdering her toddler daughter, will be a "battle of the experts" because of circumstantial evidence in the case, a judge said Thursday as he picked which specialists defense attorneys could hire with public funds.

During Thursday's hearing, Orange County Circuit Judge Belvin Perry denied requests to spend public money on four expert witnesses and forensic tests requested by Anthony's defense attorneys. The judge nixed a trace evidence expert, a cell phone expert, a jury consultant and money for a car to replicate evidence found in Anthony's car. "A blanket order to seal, the court finds that the defense at this time has not met its burden to show that a serious and imminent threat to a fair and partial trial has been met," Perry said.

Perry approved spending public money on 10 other experts, including a bug expert, a forensic anthropologist, a forensic botanist and famed forensics expert Henry Lee, who has worked on the Phil Spector and JonBenet Ramsey cases. Those experts can give opinions on body decomposition based on plant growth and insects found around a body.

Perry denied a request from Anthony's attorneys to seal all records related to the public funding of her defense. The defense attorneys had argued their release would jeopardize her right to a fair trial by revealing defense strategy.

On “In Session,” Vinnie Politan said, “Wow! Again, I am just absolutely shocked at the difference that we’re seeing inside this courtroom … and the way the judge is approaching everything. He is thorough, he is fair, and he’s getting stuff done.”

Politan said Perry was walking a tight rope in trying to give Anthony a fair trial but also watch taxpayer dollars.

“I think he’s doing a fine job of walking that tight rope,” said former federal prosecutor Sunny Hostin. ”His reasoning is very judicial … And I don’t think he’s giving the prosecution more leeway than he is giving the defense, and vice versa.”

WFTV-Channel 9 anchor Vanessa Echols noted that Chief Circuit Judge Belvin Perry Jr. had refused a defense request to have its financial records sealed.

&#8220;The defense is having its wings clipped, for sure, after flying through $340,000,&#8221; WFTV&#8217;s Kathi Belich reported. &#8220;The judge is clamping down now on defense spending.&#8221;

Belich noted that Perry rejected defense requests for a jury-selection consultant and for two forensic pathologists (the defense gets one instead). But Perry allowed the defense to keep Dr. Henry Lee and some other out-of-state experts.

WFTV-Channel 9 listed setbacks today in a hearing on expenses for the indigent defendant:

***Her attorneys asked that she not have to attend hearings. &#8220;Casey Anthony doesn&#8217;t like people criticizing her appearance or actions, so she asked to stay in jail during future hearings,&#8221; WFTV&#8217;s Kathi Belich said. But Chief Judge Belvin Perry said she would have to attend most of them, saying he didn&#8217;t want to give her grounds for an appeal.

***The defense wanted to keep its experts&#8217; names secret, but Perry &#8220;made defense attorney Jose Baez name names,&#8221; Belich said.

***The defense wanted to buy two cars &#8212; with taxpayer money for $6,000 &#8212; to conduct air tests; Perry denied the request.

Why that request? &#8221;While it may sound like a silly idea, it gives you a sense of how closely the defense wants to challenge the so-called sniff test showing the odor in the car of Casey&#8217;s was from decomposition,&#8221; WESH-Channel 2&#8217;s Bob Kealing said.

Trial date, timetable for evidence, depositions set in Casey Anthony case

Orange-Osceola Chief Circuit Judge Belvin Perry set May 9, 2011 as the trial date in the first-degree murder case.

Depositions of the state's expert witnesses and law officers must be completed by Sept. 30. Defense expert witnesses must review evidence by Oct. 31.

Perry's order also establishes a timetable for witness lists to be submitted and defense motions to be heard. Depositions must be finished by Oct. 31.

Casey Anthony: Why is the state seeking the death penalty? Could be six reasons

In a response to a defense motion, prosecutor Jeff Ashton notes there are 15 aggravating circumstances that could lead to the death penalty, and nine wouldn&#8217;t apply to Anthony, WESH&#8217;s Amanda Ober reported. &#8220;Four clearly apply to Casey Anthony, and the defense should have no problem figuring it out,&#8221; Orlando defense attorney Richard Hornsby told Ober. And that&#8217;s the snarky tone of Ashton&#8217;s reply to the defense&#8217;s request.

Hornsby said those circumstances are that the victim was younger than 12, that Anthony was the parent; that the crime was premeditated; and that the crime involved aggravated child abuse. But prosecutors could also argue that Anthony stood to benefit monetarily from Caylee&#8217;s death and that the crime was especially heinous, atrocious or cruel.

Ashton has hinted at the cruel nature of the murder when he described Caylee&#8217;s mouth as being duct-taped and suggested that the toddler might have looked into the murderer&#8217;s eyes, Ober said. &#8220;I don&#8217;t think there can be anything more compelling or riveting in proving cruel, atrocious or heinous than that description, &#8221; Hornsby said.

Casey Anthony: Jose Baez in baffling performance outside courthouse

Jose Baez had a pretty good day in court yesterday as Casey Anthony&#8217;s attorney. But you wouldn&#8217;t have known that afterward when he walked away from reporters outside the courthouse.

It was a baffling moment in this long-running Anthony saga. Baez asked reporters not to follow him to his car and put that request specifically to WFTV-Channel 9&#8217;s hard-driving Kathi Belich. She wouldn&#8217;t agree to his request, so Baez walked away. From everyone.

It was simply strange. Why would Baez miss a chance to cite his successes in front of Chief Judge Belvin Perry? Why would Baez let his reactions to Belich color his dealings with the press corps? (She&#8217;s just trying to do her job, and she doesn&#8217;t represent the entire media.) Why would Baez give his detractors more ammunition to complain about his style?

Maybe next time Baez should let defense attorney Cheney Mason handle the questions. Mason knows how to handle pressure and pesky reporters. They can come in handy when you have a good story to tell.

Judge Sets Deadlines In Casey Case

Judge Belvin Perry has ordered the state to complete their depositions of expert witnesses by Sept. 30 and the defense by Feb. 28, 2011.

Depositions of law enforcement officers must be done by Sept. 30 and all other witnesses by Oct. 31.

He also ordered the defense to come up with a list of expert witnesses, and provide any reports and motions by Nov. 30.

Perry also set dates about once a month for status hearings and wants the trial to start May 9, 2011.

Casey Anthony Murder Trial Date Set
Prosecution Outlines Reasons For Death Penalty

The filing came in response to a motion by Anthony's defense team requesting the state be compelled to outline which circumstances it's going to argue. Under state law, there are 15 so-called aggravating circumstances. At least one of them must be proven for a defendant to receive the death penalty. In his response, state prosecutor Jeff Ashton said nine of the 15 circumstances clearly do not apply to Casey. He then went on to point out four that he said clearly apply to the case.

They are, as written in state law:
&#8226;The capital felony involved aggravated child abuse
&#8226;It was premeditated
&#8226;The victim was under the age of 12
&#8226;The defendant was the victim's parent

There are two other aggravating circumstances the state may or may not try to prove. One of them is that the defendant benefited financially from the victim's death. The other is that the alleged slaying was especially heinous, atrocious or cruel.

Defense attorney Richard Hornsby said he believes the state has already tipped its hand in regard to claiming Caylee's murder was especially cruel. "It's my belief that Jeff Ashton has already put the defense and entire public on notice that he's going to try to prove that by that presentation in court about how the duct tape may have been placed over Caylee's mouth and how she might have seen the eyes of her killer as she took her last breath," Hornsby said.

In a second filing, the state requested what Hornsby called a "tit for tat." Prosecutor Jeff Ashton asked that the court compel the defense to reveal the mitigating circumstances it will try to prove to argue against the death penalty. In other filings on Thursday, Anthony's attorneys asked Judge Belvin Perry to reconsider previous rulings made by Judge Stan Strickland, who stepped down from the case in April. The defense specifically wants Perry to provide it access to George Anthony's grand jury testimony, as well as records from the volunteer search group Texas EquuSearch.

Casey Anthony Murder Trial One Year Away

"We're going to see a type of trial that Orange County has definitely never seen, and Florida has never seen. It&#8217;s going to be something to see along the lines of OJ Simpson, Michael Jackson," said Richard Hornsby, legal analyst.

This week, newly appointed Judge Belvin Perry will hear outstanding motions including death penalty objections. Hornsby said those are mostly formalities filed in case laws ever change.

Motions that could have a bigger impact include whether photos of Casey before Caylee's death or Roy Kronk&#8217;s past can be used as evidence. "It's going to be a critical issue in the case because that seems to be the defense&#8217;s entire argument that another person may have placed the body there while Casey Anthony was in jail," Hornsby said.

UPDATED: Jury Coming From Other Counties

On Monday morning, Judge Belvin Perry agreed to bring in a jury from another Florida county. However, the trial will still be held in Orange County. Anthony's defense said she can't get a fair trial here. They said there's too much hostility towards the young mother accused of killing her child. The judge granted the change, but the trial will still be held here. Judge Perry, along with the defense and state, will go to another county that&#8217;s similar to Orange in population, racial composition, economic status and median income. Jury members will be sequestered and once the judge decides which county to pick the jurors, Perry will impose a gag order on the attorneys.

The defense said this wasn't their first choice, but there&#8217;s nothing they can do. "We&#8217;re just going to have to deal with it,&#8221; said Jose Baez, Anthony&#8217;s attorney. &#8220;There's very little on the law that deals with these issues. A lot less judicial discretion. But if this is what Judge Perry feels this is where should be held, we'll be fine with it.&#8221;

Another motion discussed Monday was those so-called party pictures of Anthony at clubs and bars. The defense wants them thrown out, but the state said it shows her whereabouts when her daughter was reportedly missing. Judge Perry did not rule on the motion, but said he has some concerns about them.

The judge is giving both sides until the end of March to agree on which pictures would be used.

Chief Judge Belivin Perry said he will grant a change of venue motion at the appropriate time. Once the judge picks a location, he will tell the attorneys and then place a gag order on them.

Baez then argued for pictures of Anthony partying, supposedly during the time that Caylee was missing, to be sealed. Judge Perry deferred a decision on that motion, asking both parties to work together on which photos they intend to use.

On Tuesday, the defense will present arguments against the death penalty, which they contend is unconstitutional.

Judge Perry said he will rule at a later time as to the location for selecting a jury and said he&#8217;ll take into consideration both side&#8217;s arguments in selecting a site and at some point he&#8217;ll contact jurisdictions as relating to jury selection. &#8220;The jury will be sequestered. They will be brought back to Orange County. They will be kept at an undisclosed location,&#8221; Judge Perry said. &#8220;I will be entering a gag order [for the attorneys]. I will be doing that at a sufficient time.&#8221; He also said he had no concern over protesters, if there were any, and said the sheriff&#8217;s office and police department will deal with any issues if they arise.

The state, though, argued that they photos should be allowed, both the photos of Casey before and after the date of the alleged incident in June 2008. &#8220;The court will defer ruling,&#8221; Judge Perry said after hearing both side. &#8220;The state and the defense, since you are required to exchange photos with each other, I&#8217;m going to give you till March 2011 which photos you are intending to use. We shall have a hearing no later than the 31st of March to go over those photographs and hear any other arguments you might have.&#8221; While Judge Belvin Perry next deferred any specific decision on a "motion to exclude", he then quickly denied the defense motion to "dismiss defective indictment" without hearing arguments from either site. Both had already presented their arguments in writing.

The court then began discussing a "motion to compel" filed by the defense seeking certain documents they feel have not been turned over to them. &#8220;We will table this one here and, uh, if there&#8217;s an expert witness for bench notes, list that expert saying you haven&#8217;t gotten it and I&#8217;ll have the state file a written response,&#8221; Judge Perry said, adding that Baez will get 10 days to submit and the state will get 10 days after that to respond.

The jury in the trial of Casey Anthony, who is charged with killing her 2-year-old daughter, will be selected from outside Orlando and then returned to Central Florida for the murder trial, a judge ruled on Monday. Chief Judge Belvin Perry ruled at a hearing that the 12 potential jurors and six potential alternates in Anthony's trial will be chosen from somewhere in the state of Florida outside Orlando. The jury will also be sequestered, Perry ruled.

Baez also played a two-minute video presentation that showed coverage of the nearly two-year-old case, including interviews with citizens saying that Anthony is guilty.

Later in the hearing, Perry denied a request from defense attorneys to dismiss the indictment against Anthony. In regard to the pictures showing Casey Anthony partying during the time Caylee was missing, Perry asked prosecutors to narrow down the images they may want to use at the trial. Anthony's defense team will then have the opportunity to challenge the admissibility of the selected photographs.

As Anthony left the courtroom Monday, she smiled at her mother, Cindy Anthony, and said, "Happy Mother's Day." Cindy Anthony attended the hearing with her husband, George Anthony, and their attorney, Brad Conway.

In a hearing Monday, Judge Belvin Perry decided to order a jury be selected elsewhere and brought to Orange County for Casey Anthony's murder trial. "The defendant's motion for change of venue will be granted at the appropriate time. I will enter an order prior to us proceeding to somewhere in the state of Florida to select a jury. I will review and take into consideration the comments by the defense and the state in selecting a site," Perry said. Perry also explained that there would be a gag order regarding the location of the trial.

Baez then argued the second motion in which the defense wants pictures of Anthony partying, supposedly during the time that Caylee was missing, to be sealed. Baez said that his absurd to suggest that a person who goes to a night club or a party is a bad mother or does not love their child. Perry deferred a decision on that motion, asking both parties to work together on which photos they intend to use.

Regarding dismissing the defective indictment, Perry denied the motion.

Perry said today he will grant the motion at a later date and will be issuing a gag order so the attorneys cannot discuss the matter publicly. Perry said the jurors will be brought back to Orange County and be kept in an undisclosed location.
&#8226;Jail logs
Casey Anthony's attorneys want the judge to keep the list of names of people who visit her in jail private. Visitation logs are public record unless sealed by a judge.
Today, Mason told Perry this motion will need to be argued at a later date.
&#8226;Party Pictures
After Casey Anthony's arrest, dozens of pictures taken from various online social-networking sites have emerged and portray her as a "party girl."
Perry did not rule on the motion today, but said the matter will have to be addressed before trial. The judge said the state and defense will have to determine which party photos will be used by the end of March. Perry said that's when he will hear arguments about the pictures and rule. "I have some concerns about some of the photographs," Perry said. "It's hard to rule on these in a vacuum without hearing both sides."

Her legal team want to keep out dozens of statements about Anthony and her family made by friends and family &#8212; statements the defense contends are hearsay. These friends and acquaintances offered their opinions of Casey Anthony's character, motives and undisclosed intentions and character of truthfulness. These opinions should not be admissible in court, her attorneys argue.
Perry said the issue will be addressed later. He asked the defense to narrow the focus to the hearsay items that gives them greatest concern. He also is going to reserve ruling on issue of 911 calls made by Anthony's mother, Cindy Anthony.

Her attorneys argue in a motion that Casey Anthony was indicted on several charges, including premeditated murder and criminal neglect of her daughter. But they say there is so little information on the indictment that the legal team can't possibly defend her.

Anthony lawyer shows clip of media "frenzy"

Chief Judge Belvin Perry ruled that the 12 potential jurors and six potential alternates in Casey Anthony's trial will be chosen from somewhere in Florida outside Orlando, brought back to central Florida and then sequestered during the trial.

Jose Baez, Anthony's lead attorney, told the judge that South Florida residents had the least media exposure to the case and argued that the jurors shouldn't be picked from Jacksonville, Tampa or Pensacola. The Jacksonville area recently has had two missing girl investigations that resemble Anthony's case, while Tampa's proximity to Orlando had exposed residents there to the case, Baez said. He faulted Pensacola for not having the same demographic makeup as Orlando.

Near the conclusion of Monday's hearing, Baez played a roughly three-minute clip of the Orlando-area media coverage of the case. There were some technical difficulties during the playback of the video and the video appeared pixelated at times.

On Tuesday, the defense will present arguments against the death penalty, which they contend is unconstitutional.

&#8220;The fact that someone is generally aware of it isn&#8217;t going to be the reason that they&#8217;re cut [from the jury],&#8221; Deen told WESH&#8217;s Dave McDaniel. &#8220;Timothy McVeigh got a jury. O.J. Simpson got a jury.&#8221;

Where will the jury come from?

&#8220;You want someplace big enough that they&#8217;re going to absorb that news and not make it something special,&#8221; Deen said. &#8220;More people so there&#8217;s more chance that somebody in the world hasn&#8217;t been reading about this every day.&#8221;
