MILFORD — The trial of a man charged with killing the mother of his still-missing toddler more than three years ago in Ansonia is “on target” to happen this fall, his lawyer said in court Tuesday.

Jose Morales, 46, appeared before Judge Peter Brown Tuesday at Superior Court in Milford, where his lawyer, Edward Gavin, said he is still reviewing evidence in the case turned over by prosecutors.

The latest round of discovery consisted of 600 police bodycam videos, Gavin said.

I don't understand this ruling. Surely a defendant has the right to see the evidence that will be used against him. This bodes ill for any future appeal overturning a conviction (if Morales is indeed convicted.


I can't decide if the little girl is dead or if he gave her to someone to raise. Any thoughts?
No, Morales was not denied seeing his evidence, but the Judge instead told him that he could review his evidence with his attorney Gavin:

Brown denied the request, telling Morales that Gavin could review the evidence with him.

At the time of Morales's request, Gavin earlier stated he'd reviewed more than 248,000 pieces of evidence before receiving eight additional discovered disks from the prosecutor.

It poses a big problem for the jail when inmates have documents in their cells. Case evidence inside the jail is like gold for jail informants/snitches that are known to steal docs and use the information to make up stories that they heard certain details -- looking for any break to get out of jail early.

In another case I'm following in Florida, the defense attorney requested permission to mail his client (housed separately) transcripts of wiretap recordings in evidence but this was would require the jail staff to make voluminous copies of pages of the transcript for the inmate and retain the originals, as they do with all correspondence received by inmates. Here, the court and the defense came up with a compromise to allow the inmate an MP3 player to listen to wiretap recordings by the government. MOO

Judge Brown denied Morales request to see all documents- meaning the documents that the States Attorney has as well. Judge Brown said Morales can only see the documents that his own lawyer has. Morales stated that his cell mate has their own documents but what Morales didn't know is that his cell mate is representing himself in his own case. Morales requested these documents only because of the case out in Wisconsin where the defendant represented himself in the Christmas parade case.

As far as my niece being dead or alive-there is no evidence that my niece Vanessa was harmed during this whole nightmare. I firmly believe that he gave my niece Vanessa to someone else. A neighbor spotted my niece standing next to a dark colored car while her father was fighting with the car seat. Hopefully I answered all your questions regarding my sisters-in-law case and the disappearance of my niece Vanessa.

10/24/22 Update: Morales appeared in tan prison scrubs & a shaved head for the brief hearing Monday. Supervisory Assistant State's Attorney Howard Stein told Judge Peter Brown the state is in the process of disclosing a "plethora of digital evidence" to defense attorney Edward Gavin. Gavin said he had already gone through 248,000 pieces of evidence before receiving eight additional discs of discovery from Stein on Monday. Before concluding the hearing, Gavin told Judge Brown that his client had requested the written materials in the case to be turned over to him while in custody. Morales is being held at the Cheshire Correctional Institution in lieu of a more than $5 million bond. Brown denied the request, telling Morales that Gavin could review the evidence with him. The case is continued to 1/10/23 while his attorney reviews the evidence in the case.

The attorney, Edward Gavin, did not detail the evaluation concerning 46-year-old Jose Morales, but said he would share a draft report before meeting with Judge Peter Brown and Supervisory Assistant State’s Attorney Howard Stein next month.

Huh?

So, in January, the defendant's Attorney (Edward Gavin) tells the court --
the case was "on track" for a trial this fall.

And on 4/4, he told the judge an evaluation of his client has been completed, and said he would share a draft report before meeting with Judge Peter Brown and Supervisory Assistant State’s Attorney Howard Stein next month. “We’re making progress here,” Gavin told the judge Tuesday.

Did I miss that a competency evaluation was requested by the court?

I'm not understanding the secrecy behind any evaluation of a defendant. o_O

We all know that all court proceedings are halted until a decision that the defendant is competent to proceed is rendered.

Not sure what's going on since the defendant last wanted to keep copies of the discovery in his jail cell with him-- instead of meeting with his lawyer to view the discovery. (Judge denied Morales's request).
 
@Seattle1 = do we even have a trial date yet? I do not have that in my notes. Nor the request for competency hearing - so do not know when that happened either. But then the CT courts don't release too much... and I can not access it to look.
 
@Niner -- no trial date has been set with the court that I'm aware of. Only the suggestion the defense will be ready in the fall after viewing all that bodycam footage.

Gavin said he believes the case should be ready for trial this year, absent any further discovery issues.

“I know that we are on target for a fall date for the trial,” he said.

Thinking about this child today. I do wonder where she is and who she's with. I will continue to remain hopeful.

The reality that she was taken away from her loving mother, and no hint of a report she's safe elsewhere, learning of an early death for baby Vanessa is beginning to sound like a better option. JMO
