Tsarnaev may face state trial for Sean Collier death

"Middlesex District Attorney Marian T. Ryan plans to bring convicted Boston Marathon bomber Dzhokhar Tsarnaev back to Massachusetts to face state charges of murdering MIT police officer Sean Collier and other crimes in the days after the Marathon attacks, even though a federal judge last month sentenced Tsarnaev to death....

“When you come into Middlesex County and execute a police officer in the performance of his duties and assault other officers attempting to effect his capture, it is appropriate you should come back to Middlesex County to stand trial for that offense,” Ryan said in a statement. Tsarnaev also faces several other state charges, including carjacking and kidnapping.

In addition, Ryan suggested that convicting Dzhokhar Tsarnaev of state charges could act as an insurance policy in case Tsarnaev successfully appeals his federal conviction. Ryan noted that the federal convictions are “not yet final.” His convictions and sentence are subject to an automatic appeal...."

Stephen Silva, 22, pleaded guilty in December 2014 to possession of a firearm with an obliterated serial number, conspiracy to distribute heroin, and six counts of distributing heroin...

Lawyers for Boston Marathon bomber argue for new trial

"Defense attorneys on Tuesday argued that Tsarnaev’s conviction and sentence were tainted by the law, which affected half of the 30 criminal counts he faced.

The high court found the law overly broad in a hearing on an unrelated case two days after Tsarnaev was sentenced.

“It’s really impossible to unpack what weight that (ruling) might have had on the jury’s deliberations, in their weighing of aggravating and mitigating factors,” defense attorney William Fick said. “It requires a redo of the entire sentencing proceeding.”

Federal prosecutors questioned the relevance of the argument, given the magnitude of the attack. Tsarnaev’s attorneys admitted on the first day of the trial that he played a role in the bombing, and the 22-year-old apologized before sentencing.

“There is absolutely no reason to believe … the result would have been any different,” had the charges had no reference that Tsarnaev and his older brother were in possession of a handgun during the attack, said Assistant U.S. Attorney William Weinreb.

U.S. District Judge George O’Toole did not immediately rule on the request..."

Man who lent gun to Boston Marathon bombers to be freed

"...U.S. District Judge Mark Wolf sentenced Stephen Silva, who was arrested in July 2014, to time served plus three years' supervised release for the charges that he pleaded guilty to last year.

Silva was not accused of playing any role in the April 15, 2013, bombing at the Boston Marathon finish line, which killed three people and injured 264, but admitted having possessed a handgun with its serial number filed off.

He testified in March that he lent that gun, a Ruger P95, to Dzhokhar Tsarnaev, who told him he wanted it to rob college students in Rhode Island...."

Boston bomber Tsarnaev loses bid for new trial, ordered to pay $101M in restitution

"...The judge's order instructs Tsarnaev to pay a total of $101,124,027 to 49 individuals, to be placed in the Massachusetts Victim Compensation Fund.

The 22-year-old Tsarnaev, however, clearly has no way to disperse that amount, meaning the restitution order will effectively be a symbolic gesture.

The released documents include previously unreported tidbits such as a Medicaid card found in Tsarnaev’s college dorm room; already documented descriptions of Tsarnaev’s interaction with authorities after his arrest; and prosecutors’ objections to the testimony of a well-known Catholic nun.

Prosecutors: Marathon bomber showed 'opposite of remorse'

"BOSTON (AP) — Boston Marathon bomber Dzhokhar Tsarnaev gave a stunning courtroom apology when he was sentenced to death in the deadly 2013 attack, but just after he was captured, he showed "the opposite of remorse," prosecutors said in court documents released Wednesday..

In newly released court documents, prosecutors said Tsarnaev expressed anything but regret when he was questioned by two FBI agents after his capture days after the bombings. They included the description of Tsarnaev in a motion to limit the testimony of Sister Helen Prejean, a Roman Catholic nun and staunch death penalty opponent made famous by the 1995 film, "Dead Man Walking."

Prosecutors argued that Prejean's testimony should be excluded, calling it a "thinly disguised way for Tsarnaev to offer statements of remorse" without having to make them under oath, be cross-examined by prosecutors and allow jurors to gauge his sincerity for themselves. They argued that if Prejean was allowed to testify, they should be allowed to confront her with other statements Tsarnaev made to FBI agents after his capture..."

Boston Marathon bomber's lawyers appeal his conviction and death sentence

"Lawyers for Dzhokhar Tsarnaev filed an appeal on Friday of his conviction on murder and other charges related to the 2013 Boston Marathon bombing, court papers show.
